The self -reported Sanitary Sewer Overflow (SSO) 5-Day Report submitted by Carolina Water Service Inc of North
Carolina indicates violations of permit conditions stipulated in the subject permit and North Carolina G.S. 143-215.1.
Violations include failing to effectively manage, maintain, and operate the subject collection system so that there is
no SSO to the land or surface waters and making an outlet to waters of the State for purposes of G.S.
143-215.1(a)(1), for which a permit is required.

I am writing to provide additional information regarding the above noted sanitary sewer overflow. On 11/9/15 at
approximately 3:00 pm Carolina Water Service Inc. of NC received a telephone call from: Union County informing us of a
manhole that was overflowing near the intersection of Idlewild Road and Mill Grove Road. Our staff were on site at
approximately 3:10 pm to investigate the incident.
When operations staff arrived they found the stream "Fork Crooked Creek" had breached its banks and was flooding the
area. The shopping center parking lot that was near the area was also flooded and rain water was inundating the
manhole. The manhole overflow was not due to a blockage of any kind but due to severe natural conditions and inflow
from the creek and other areas. The manhole was located in a high traffic area and nothing could be done until the
water receded since the whole area was flooded and under water.
The area had received an unprecedented amount of rainfall for nearly nine days straight. Our rain gauge located at our
wastewater treatment plant located in the same area recorded 5.42" of rainfall for the nine day time period. The day of
this particular event the area received 1.84" of rainfall. I have enclosed a copy of that report for your review.
The rain slowed and the water receded on 11/9/2015 at approximately 6:10pm at which time staff investigated the
collection system. Staff installed temporary bag inserts in manholes that were located near the creek and ditches until
such time a more permanent solution could be found. There were no known fish kills or other known impact to the
tributary.. There was no known impact to public health.
The staff of CWSNC takes pride in the compliance and environmental stewardship of our facility. Please accept this letter
as demonstration that the actions taken were prompt and complete and that the SSO was unintentional and due to
severe natural conditions.

A review has been conducted of Hemby Acres' self reported Sanitary Sewer Overflows
(SSOs) 5-Day Report(s) for February 2009. This review has shown Hemby Acres to be in
violation of the requirements found in Collection System Permit WQCS00233 and/or G.S. 143-
215.1(a)(1). The violations that occurred during February 2009 are summarized in Attachment
A.
Remedial and corrective actions, if not already implemented, should be taken to prevent
further SSOs. As of December 1, 2007, any reportable SSO may be issued a Notice of Violation
(NOV) and some may be assessed a civil penalty. Civil penalties will be issued for SSOs based
on volume, volume reaching surface waters, duration and gravity, impacts to public health, fish
kills, and recreational area closures. Other factors considered in determining the amount of the
civil penalty are the violator's history of spills, the cost of rectifying the damage, whether the
spill was intentional, and whether money was saved by non-compliance.
Be advised that G.S. 143-215.6A provides for a civil penalty assessment of not more than
twenty-five thousand dollars ($25,000), or twenty-five thousand dollars ($25,000) per day when the
violation is of a continuing nature, against any person who is required but fails to apply for or to
secure a permit required by G.S. 143-215.1. Penalties may also be assessed for any damage to the
surface waters of the State that may result from the unpermitted discharge.

The SSOs highlighted in Attachment A are overflows that the regional office has
determined, after review of the CS-SSO 5-day report, that may result in a civil penalty
assessment. You may provide any additional information for the justification of these SSOs
as to why these spills do not meet the criteria listed in this letter for civil penalty
assessment.

Violation letter to provide any additional justification for the identified SSOs as to why
these spills do not meet the criteria listed in this letter for civil penalty assessment.

Stone Ridge Drive SSO of 11/13/09

We are in receipt of your letter concerning the above referenced item. We believe due to our timely
response and the fact that the discharge was exceptional, unintentional, temporary and caused by
factors beyond our control a civil penalty would not be considered.
We received a telephone call from our afterhour's answering service at approximately 4:30 pm on
11/13/09 about a manholeoverflowing in the street at the intersection of Stone Ridge Drive near
Beacon Hills Road. Our on call staff was immediately dispatched and was on site within one hour. The
8" sewer main was determined to have a blockage due to rags, grease and roots. The operator
contacted a company to have the line jet cleaned and vacuumed. The blockage was cleared and the
overflow was stopped at approximately 7:30pm on 11/13/09. The overflow did reach a storm water
ditch but there was no impact to the stream or fish kills of any kind.
The sewer main on Stone Ridge Drive was previously cleaned on 3/9/09 as part of the collections
systems 10 % annual sewer maintenance cleaning. We have never had any prior problems with
overflows or blockages on this particular street. All areas were properly cleaned and lime applied to the
affected areas. There was no impact to public health and no public recreational areas were closed due
to the location of the spillage.
