1. Mr. Tony Parker of the Mooresville Regional Office of the NC Division of Water
Resources (DWR or the Division) conducted a compliance evaluation inspection (CEI) of
the subject wastewater collection system (WWCS) on August 22, 2019. The assistance
provided by Mr. Billy Swink during the inspection by was greatly appreciated. A copy of
the inspection report is attached for your records and inspection findings are summarized
below.
Site/System Review
2. The following system components were inspected:
a. Various manholes were inspected with no deficiencies.
b. Two pump stations were inspected. Some issues noted. Please see attached report.
c. One aerial crossing inspected. No issues.
3. As you are aware, owners of permitted collection systems must comply with their permit
and all rules listed under NC Administrative Code 15A NCAC 02T .0400, et seq. The
system status is outlined below:
a. 15A NCAC 02T .0403(a)(1): Requires that the system be effectively maintained
and operated at all times to prevent discharge to land or surface waters and any
contravention of ground or surface water standards.
Observations: The system is free of reportable spills.
Compliance Status: Compliant

b. 15A NCAC 02T .0403(a)(2): Requires that a map of the wastewater collection
system be developed and actively maintained.
Observations: The Town had detailed paper maps available including as-
builts.
Compliance Status: Compliant
e. 15A NCAC 02T .0403(a)(5): Requires that the permittee or its representative
inspect high -priority sewers (HPS - as defined in 15A NCAC 02T .0402(2)) at least
once every six months and document the inspections.
Observations: The system has one High Priority line or aerial crossing.
Compliance Status: Compliant
f. 15A NCAC 02T .0403(a)(6): Requires that the permittee or its representative
conduct a general observation of the entire wastewater collection system at least
once per year.

Observations: Most of the collection system is within the street right of ways or
adjacent to the curbs and some well mowed back or side lots and thus are visually
inspected daily. All activities are well documented.
Compliance Status: Compliant.
15A NCAC 02T .0403(a)(7): Requires that overflows and bypasses from the
system be reported to the Division's Mooresville Regional Office in accordance
with 15A NCAC 02B .0506(a), and that public notice must be provided as required
by G.S. 143-215.1C.
Observations: The system has not had any reportable spills or history of such.
The NC regulations and statutes, which cover the reporting requirements for SSOs,
are found in NC Administrative Code 15A NCAC 02B .0506(a) and NC General
Statute 143-215.1 C, respectively. You may access the NC regulations online at the
NC Office of Administrative Hearings (OAH) website at:

General Assembly's website at:
http://www.ncga.state.nc.us/gascripts/Statutes/StatutesTOC.pl. You may wish to
review them to ensure you are fully familiar with all requirements.
When reporting SSOs to DWQ, you must call the Mooresville Regional Office
(MRO) at 704-663-1699 during normal business hours. If outside normal business
hours, you must report the spill to the NC Division of Emergency Management at
1-800-858-0368. Please note that all reportable SSOs must be reported within 24

hours of the occurrence, or first knowledge, of the SSO. Please also note that voice
mail or faxed messages are not considered as the initial verbal report. You must
talk to and report the spill to a live person.

h. 15A NCAC 02T .0403(a)(8): Requires that a grease control program be developed
and implemented as follows:
1. For public owned collection systems, the Grease Control Program shall
include at least bi-annual distribution of grease education materials by the
owner or representative.
Observations: Educational information is mailed out two times per year and is
available at Town Hall.
15A NCAC 02T .0403(a)(10): Requires that documentation be kept for all
activities you undertake to comply with the requirements of 15A NCAC 02T .0403,
subparagraphs (a)(1) through (a)(9), for a minimum of three years, with the
exception of the map, which shall be maintained for the life of the system. Also any
new additions, subdivisions or phased development needs to be incorporated as
well.
Observations: Records and a system map were available.
Compliance Status: Compliant

Comment: Due to a severe storm the night prior to this event the telementry on both P/S's failed to notify the
on call phone when tested. The system was checked 3 days prior to this inspection with no
problems.The operator contacted the Towns electrican to rectify this issue. He indicated he
would check the systems daily until! resolved. He will also notify this inspector via email.

interceptors; enforcement for violators and the legal means to

private satellite sewer systems.

compliance status with each of these rules is summarized below:

Observations: There have been no overflows in this system in the past several
years. This system appears to be well maintained and operated, although the
generator at the Main Pump Station wouldn't crank due to a dead battery.
Compliance Status: Compliant

system be developed and actively maintained.
Observations: A copy of the map was available at the time of inspection.
Compliance Status: Compliant
c. 15A NCAC 02T .0403(a)(3): Requires that an operation and maintenance (O&M)
plan be developed and implemented, which includes pump station inspection
frequency, preventative maintenance schedule, spare parts inventory and overflow
response.
Observations: The system appeared to be well maintained for the most part with
protocol set up to address any needs. There were no records in regard to pump
station inspection, preventive maintenance, spare parts inventory, or overflow
response.
Compliance Status: Non -Compliant
d. 15A NCAC 02T .0403(a)(4): Requires that the permittee or its representative
inspect pump stations that are not connected to a telemetry system (i.e.,remote
alarm system) every day (i.e., 365 days per year) and pump stations that are
connected to a telemetry system at least once per week.
Observations: Mr. Swink stated that both pump stations were inspected three
times a week, but no records were maintained to document this other than dates and
times for the past few weeks in a pocket size note book. Both pump stations did
appear to be well maintained.
Compliance Status: Non -Compliant
e. 15A NCAC 02T .0403(a)(5): Requires that the permittee or its representative
inspect high -priority sewers (HPS - as defined in 15A NCAC 02T .0402(2)) at least
once every six months and document the inspections.
Observations: There is an aerial over a deep drainage near the main pump station
which would be considered a high -priority line. This is within view of the pump.
station. Documentation of inspections every six months needs to be maintained.

Compliance Status: Non -Compliant
15A NCAC 02T .0403(a)(6): Requires that the permittee or its representative
conduct a general observation of the entire wastewater collection system at least
once per year.
Observations: Annual observations of the entire system should be conducted and
documented. Records need to be maintained of system inspections (pump stations,
manholes,- ARV's, right of ways, aerials, etc.) to show that the entire system is
observed at least once a year. This is not currently done.
Compliance Status: Non -Compliant.

Observations: This system has not had any SSO's: The NC regulations and
statutes; which cover the reporting requirements for SSOs, are found in NC
Administrative Code 15A NCAC 02B .0506(a) and NC General Statute 143

When reporting SSOs to DWQ, you must call the Mooresville Regional Office
(MRO) at 704-663-1699 during normal business hours. If outside normal business
hours, you must report the spill to the NC Division of Emergency Management at
1-800-858-0368. • Please note that all reportable SSOs must be reported within 24
hours of the occurrence, or first knowledge, of the SSO. Please also note that voice
mail or faxed messages are not considered as the initial verbal report. You must
talk to and report the spill to a live person.

h. 15A NCAC 02T.0403(a)(8): Requires that a grease control program be developed
and implemented as follows:
1. For privately owned collection systems, the Grease Control Program shall
include at least bi-annual distribution of grease education materials to users
of the collection system by the permittee or its representative.
2. Grease education materials shall be distributed more often than required
above if necessary to prevent grease -related sanitary sewer overflows.

Observations: Although it was stated that information is sent with bills twice a
year, no records of distribution of grease education materials was 'available during
the inspection.
Compliance Status: Non -Compliant.
i. 15A NCAC 02T .0403(a)(9): Requires that right-of-ways (ROW) and easements
be maintained in the full easement width for personnel and equipment accessibility.
Observations: Most of this system is in or along roads, in yards, and fields. It
appeared that all areas were accessible, although there were a couple of brushy
spots.
Compliance Status: Compliant.
15A NCAC 02T .0403(a)(10): Requires that documentation be kept for all
activities you undertake to comply with the requirements of 15A NCAC 02T .0403,
subparagraphs (a)(1) through (a)(9), for a minimum of three years, with the
exception of the map, which shall be maintained for the life of the system.
Observations: No -records were available other than the map and a couple of
invoices for electrical work.
Compliance Status: Non -Compliant .
4. In accordance with NC General Statute 143-215.6A, these violations are subject to civil
penalty assessments not to exceed $25,000 per day, per violation. Your written response
and the actions that you take to address these violations listed herein will be considered in
deciding whether or not such penalties are necessary to compel compliance.
5. Corrective actions that should be taken for the above violations are as follows:
a. Documentation of pump station inspections.
b. High Priority line inspection documentation.
c. General observation of the entire system & documentation.
d. Documentation of grease education materials.
e. Records should be kept for a minimum of 3 years

It is requested that a written response be submitted by no later than June 25, 2017 regarding
these violations. The inspection report should be self-explanatory; however, if you have

conducted at the subject facility on August 4, 2015 by Mr. Barry Love, Ms. Barbara Sifford and Mr.
Ori Tuvia of this Office. Your assistance was greatly appreciated. The inspection revealed that the
system is being properly operated and well maintained.
Please take special note of the comments in each section of the inspection report for areas
which may need to be improved upon. In particular, ensure that required records are being
maintained to document pump station inspections and compliance in all areas. Also, consider that a
grease education program is a permit requirement and needs to be implemented. In addition to this,
emergency notification signs are required at all pump stations. Enclosed is a document that further
explains record keeping requirements, which may be helpful to you. Please note that some of the

Comment: There is no educational program for grease. Lawndale doesn't currently have any commercial
grease contributors. 15A NCAC 02T .0403(a)(8) requires the permittee to provide educational
materials to its users twice a year, and also requires the legal means to require grease
interceptors for new construction. No 24 hour notification sign was posted at the pump stations.
A sign is required at all pump stations(per 2T .0305 - Design Criteria) with a pump station
identifier, 24 hour emergency number,
and instructions to call iri case of emergency.

The (15A NCAC 02T .0400) rules contain several requirements with which you must
