This assessment is based upon the following facts: A, review has been conducted of the Collection System Sanitary Sewer Overflow Report(s) (CS-SSO) for December .2012. This review has shown the subject collection system to be in violation of the requirements found in Collection System Permit No, WQCS00345. The violation(s) that occurred are summarized in Attachment A to this letter. Based upon the above facts, I conclude as a matter of law that the Town of Wingate violated the terms, conditions, or requirements of Collection System Permit No. WQCS00345 and North Carolina General Statute (G.S.) 143-215.1(a)(1) in the manner and extent shown in Attachment A. A civil penalty may be assessed against any person who violates the terms, conditions, or requirements of a pen -nit in accordance with the maxim-ums established by G.S. 143-215.6A(a)(2). Based upon the above findings of fact and conclusions of law„ and in accordance with authority provided by the Secretary of the Department of Environment and Natural Resources and the Director of the Division of Water Quality, 1,. The Town of Wingate does not dispute the facts of the violation but we ask consider the following evidence as proof that the town is working to correct the issue as quickly as possible. The area where the spill occurred is located along 1.5 mile section offorecennoin. From our best estimate this fnrennain is between 25-35years old,, This iswell within the useful life ofPVC, and these spills are not aresult of improper maintenance nrneglect, but rather poor installation techniques, We have had 4 spills over the last year, ail located along this ynrcemain, and all caused because the line was bed with large rocks imthe trench, During excavation for these repairs wecontinue tofind improper bedding material, Due to the length of the line and the unpredictability of determining where the next puncture will occur itisimpossible tocompletely fix the cause of these leaks without replacing this entire line. The Rural Center has said they believe they will allow us to use the $97'000to fix the portion of the horcemain that has had the most problems (see This will buy some time to come up with a plan for replacing the remaining section, All of the leaks have been in the same general area and we are hopeful that by replacing this section we will eliminate the problem. Rehabilitation Force Main Repair/Replacement Dear Mr. Niland: We have had several discussions about the sewer force main that services the Rays Branch Pump Station since beginning the Gravity Wastewater Collection System Rehabilitation Project. All of the discussions were precipitated by a rupture or failure of the sewer force main. Since the start of the gravity sewer rehabilitation project on July 23, 201.2 there have been four failures on the force main; four failures in 8 months, The scope of work outlined in the original project was to CCTV the sewer lines identified in Sanitary Sewer Evaluation Survey and recommend the necessary repairs, However, in light of the most recent force main rupture, we recommend the force main be replaced as a necessary repair based on the failure frequency. The force main is in the gravity sewer right of way (ROW) and the replacement force main will be laid parallel to the existing gravity sewer within the existing ROW. Items required for the construction of the replacement were not bid in the original contract and a price is forthcoming from the contractor. These items will need to be added to the schedule of values, which are as follows: + Line item for an Air Release Valve (ARV); currently there are no ARVs on the existing line. • Line item for fittings, i.e. 6" 11.25, 22.3 & 45 fittings for bends in the force main; based on failures the existing line was deflected in lieu of using bends in some instances. Line item for 6" C900 PVC; there is no C900 PVC on the current project, however we do have a price for 6" PVC, which is comparable in scope, however we will request the contractor provide us a cost adder for this itet, due to a change in material from SDR 26 PVC to C900 PVC. We have a price for the asphalt. repair and vegetative repair is incidental to construction. As for the ARV vaults, we can use the manhole price for these, since we will be using a 4' diameter m..anhole for the vault, The NC -DOT has been contacted and the -own will be able to use the encroachment which was originally applied for the Sewer Rehab Phase If. it is our intention to keep the replacement force main in the same easement as the original force main. NC-DENR Water Quality will not require permitting, due to this being a repair/maintenance which is deemed petitted due to the foliow,uing: 154 4VCAC O2T O3O3(-1,) (C) line relocations of the swne pipe size and it in the same right-oJ vay or a zrr rzt; (D) parallel line installations of the same size and within the right-off'-r,a ,, or easement where the existing line will be abandoned; I have been in contact with the contractor about what will be required for the ARV. I recommend we allow the contractor to submit unit costs for the items identified along with shop drawings to review and approve.
