This letter is in reference to the Piedmont Natural Gas (PNG) Line # 170 Project The
project entails construction of approximately 8 8 miles of natural gas transmission
pipeline in Cabarrus Iredell and Mecklenburg Counties North Carolina The proposed
pipeline originates approximately 850 linear feet west of the intersection of Mecklenburg
Highway (NC 115) and Presbyterian Road in Iredell County (3> > 1537D'N
80 842222 °W) and ultimately ties into an existing natural gas line located approximately
0 2 miles south of Davidson Concord Road (35 439426 °N 80 774642'Nk) The location
of the overall project corridor is depicted on the Site Vicinity Map (Figure 1)

A Pre construction Notification (PCN) for impacts to waters of the U S in accordance
with Nationwide Permit (NWP) No 12 and the corresponding North Carolina Water
Quality Certification (WQC) No 3819 was submitted to the U S Army Corps of
Engineers (USACE) and the North Carolina Division of Water Quality ( NCDWQ) on
January 25 2012 The project was granted authorization by NCDWQ on February 7
2012 (DWQ Project No 12 0072) but in a decision by the USACE was placed on hold
until the viability of potential alternate routes was explored
A request for revision of the permit was submitted to the USACE and NCDWQ on June
12 2012 The revision involved proposed re routes that were necessarN to accommodate
concerns expressed by area stakeholders and to avoid potential worker exposure to
buried materials within a former landfill that had been identified up gradient of the

original route Approval of that revision was granted by NCDWQ on June 20 2012 The
USACE agreed to continue holding the permit application until such time as this revision
was submitted and reviewed
Further review of the proposed project route by the Project Design Team and
construction contractor revealed the need for additional temporary workspace (TWS) at
one location along the proposed route The area where the additional TWS is required is
within an approximately 9501f segment of the right of way (ROW) located south of Grey
Road near the Town of Davidson Mecklenburg County N C The location is depicted
on a USGS Topographic Map (Figure 2) and a 2010 Aerial Photograph (Figure 3)
The width of the combined permanent ROW through this area is 110 feet PNG plans to
maintain only 30 feet of the ROW through the wetland area An additional 20 feet of
TWS was planned through WC I in order to facilitate construction of the pipeline
However because WC I is a narrow linear wetland that extends through the central
portion of the ROW the Design Team determined that there would be insufficient space
within which to adequately and safely install the pipe
The pipe that will be installed is 30 inches in diameter and will require excavation of a
wider trench and more adjacent space to accommodate placement of the excavated
material as well as larger equipment to safely handle the pipe Additionally a point of
inflection (PI) in the proposed alignment is located near the southern end of Wetland
WC 1 which would create significant constructability concerns were efforts to install the
pipe within the 50 foot wide work area undertaken as originally proposed Accordingly
PNG proposes to use the entire width of the ROW through this area The width of the
WC 1 through this area only exceeds 30 feet sporadically and PNG has not proposed to
maintain any more than the currently authorized 30 foot ROW above the pipe once it has
been installed The additional work space is only needed during construction activities
and will be restored upon completion of the work As such the amount of previously
authorized permanent impacts associated with WC 1 (0 14 acre) will not change
As a result of the proposed revision proposed temporary impacts to Wetland WC 1 will
increase from 0 310 acre of 0 500 acre No other additional temporary impacts to streams
or wetlands are proposed and the currently permitted amount of project wide permanent
impact (0 145 acre) will not change Revised Impact Tables that denote the proposed
additional temporary wetland impacts are included in Appendix II and are summarized
in Table 1 on the following page

As indicated previously the proposed revision will not result in changes to the
previously permitted temporary stream impacts or permanent wetland impacts
The proposed revision will not result in additional permanent wetland or stream impacts
or changes in pre construction elevation contours of such features The additional
temporarily cleared wetland area will be restored in accordance with the Restoration Plan
submitted with the original permit application Because the additional impacts specified
in this submittal are temporary compensatory mitigation beyond that already proposed in
connection with the original application (purchase 0 25 acre of mitigation credit from the
NCEEP see attached acceptance letter to Appendix III) should not be required

The purpose of this letter is to notify you that the North Carolina Ecosystem Enhancement Program ( NCEEP) is willing to accept
payment for compensatory mitigation for impacts associated with the above referenced project as indicated in the table below Please
note that this decision does not assure that participation in the NCEEP will be approved by the permit issuing agencies as mitigation
for project impacts It is the responsibility of the applicant to contact these agencies to determine if payment to the NCEEP will be
approved You must also comply with all other state federal or local government permits regulations or authorizations associated
with the proposed activity including SL 2009 337 An Act to Promote the Use of Compensatory Mitigation Banks as amended by
S L 2011 343
This acceptance is valid fcr six months from the date of this letter and is not transferable If we have not received a copy of the
issued 404 Perimt1401 CertiScation/CAMA permit within this time frame, this acceptance will expire It is the applicant s
responsibility to send copies of the permits to NCEEP Once NCEEP receives a copy of the permit(s) an invoice will be issued based
on the required mitigation in that permit and payment must be made prior to conducting the authorized work The amount of the In
Lieu Fee to be paid to NCEEP by an applicant is calculated based upon the Fee Schedule and policies listed at www nceep net
Based on the information supplied by you in your request to use the NCEEP the impacts that may require compensatory mitigation are
summarized in the following table The amount of mitigation required for this impact is determined by permitting agencies
