On May 15, 2007, the 401 Oversight/Express Permitting Unit of the Division of Water Quality received a request
from Mr. Todd Tugwell of Kimley-Horn and Associate, Inc., regarding a project known as "Green Oaks
Parkway" for acceptance into the Express Review Program. This letter advises you that your project will
unfortunately not be accepted into the Express Review Program. This project may require an Individual Permit
from the US Army Corps of Engineers as well as an analysis of the indirect and cumulative impacts. As a result,
this project is ineligible for the Express Review Program. You must apply through the regular 401 Certification
process with an application that includes complete background information on the project.
