On behalf of the owner, 24 East Development, LLC / Sylvester Farm Investments, LLC,
please find attached a complete application and supplemental information requesting
written concurrence from the U.S. Army Corps of Engineers (USACE) and the N.C.
Division of Water Resources (DWR) that the activities proposed below may proceed
under Nationwide Permit 39 and General Water Quality Certification 4139.
In addition to those minimization & avoidance measures taken and justified by the
USACE and DWR in 2020 for the existing development currently under construction, the
developer has made every attempt to avoid impacts to these sections of
channelized/ditched intermittent stream sections. However, as discovered during
construction of the permitted impacts and the DEQ/DEMLR review process, it was
determined that piping these sections of channel were necessary to accommodate the
piping, fill and grading required to eliminate the steep embankment slope adjacent to the
street; eliminate the steep side slopes of the ditch; and establish a stable, maintainable,
and aesthetically pleasing open space adjacent to the public street. Note this is simply an
addition of piping connecting to previously permitted sections. The flow paths previously
reviewed and verified by the USACE and DWR within the 2020 permit approvals will
not change.

4. Project Description and History
4a. Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of
this application: *
The site is immediately adjacent to the service road permitted under SAW-2019-02132 which is currently under
construction along with the rest of the associated commercial/retail development located between the service
road and Hwy24. The property west of this service road is currently active cropland (agricultural fields) with
ditches. There’s also stand of trees with wetlands within a portion of the stand just west of the project. A small
strip mall and post office exists to the north of the project across Sylvester Street. Richlands High School exists
to the east (across Hwy24), and a McDonald’s fast food restaurant to the south (across (Koonce Fork Rd.).

The purpose of the project is to construct a commercial/highway business development

The previously permitted project included the construction of a service road, entrance drives and twelve (12)
commercial lots suitable for highway businesses such as fast food restaurants, etc. A stormater management
pond is being constructed on Lot 11. The additional impacts requested in this application include piping additional
channelized/ditched sections of intermittent stream along the service road. It was the hopes of the developer and
engineer that they could avoid these sections of channel impacts, but was later determined after the road was
partially constructed that piping these sections is required to eliminate the steep embankment slope adjacent to
the street; eliminate the steep side slopes of the existing ditch; and establish a stable, maintainable, and
aesthetically pleasing open space adjacent to the public street. Heavy earth moving equipment typically used for
such civil works will be used to include but not limited to excavators, bulldozers, etc.

Comments:
S&EC has delineate all potential wetlands, streams and waters within the proposed project area. Note there are
wetlands adjacent to but not within the project area and no impacts to the wetlands are proposed associated with
this request. The channelized/ditched section of intermittent stream proposed to be impacted was originally
accounted for as a jurisdictional ditch in association with the NCDOT project along Hwy24 adjacent ot the
development, but later in April 2020 it was determined to be a channelized/ditched intermittent stream by the
NCDWR and the USACE concurred with their determination during the 2020 permit review process (see
attached email documentation).

With the inclusion of these additional impacts to the channelized/ditched sections of intermittent stream adjacent
to the service road, all anticipated phases to this project are depicted on the attached plans. The parcels are
stand alone properties independent of the agricultural land and properties to the west. Those agricultural
properties to the west will most likely be developed in the future, but no approved plans exist at this time. Future
anticipated development could potentially include multi and single family residential, possible additional
commercial along the service road, hotel, etc. This is addressed further in the cumulative impact section of this
application.

In addition to those minimization & avoidance measures taken and justified by the USACE and DWR in 2020 for
the existing development currently under construction, the developer has made every attempt to avoid impacts
to these sections of channelized/ditched intermittent stream sections. However, as discovered during the
construction and DEQ/DEMLR review process, it was determined that piping these sections of channel were
necessary to accommodate the piping, flll and grading required to eliminate the steep embankment slope
adjacent to the street; eliminate the steep side slopes of the ditch; and establish a stable, maintainable, and
aesthetically pleasing open space adjacent to the public street. Note this is simply an addition of piping
connecting to previously permitted sections. The flow paths previously reviewed and verified by the USACE and
DWR within the 2020 permit aprpovals will not change.
1b. Specifically describe measures taken to avoid or minimize proposed impacts through construction techniques: *
The project will obtain a modification to their existing land disturbance permit to include this additional area. A
post-construction stormwater management plan is already in review by DEQ/DEMLR. The BMPs included within

meet current needs along Hwy 24 for services such as fast food resaturants, etc. and is not anticipated to result
in additional development. The agricultural land to the west may of course be developed in the future for such
uses as multi or single family residential or possibly additional businesses along the servie road. The owners of
that land have been made aare of the potentially jurisdictonal wetlands that exist in the wooded area just west of
this project area, and are aware that any impacts to those wetlands or other potentially jurisdictional WOTUS
would require compliance with and most likely approval by the USACE and DWR regulations and may potentially
be cumulative to the jurisdictional impacts requested her and previously permitted in 2020.

Hey Bob,
I just talked with Robb and wanted to follow up. We ask that you revise the PCN to reflect the features as intermittent
streams. As the features are intermittent you can still utilize the NWP 39. The Corps utilizes all new information provided
from all sources including the State in making our determinations of stream calls. I sent my email prior to Robb and
Joanne's site visit. After their visit they submitted the stream documentation and the Corps agrees. The features
themselves seem to be of lower quality so mitigation will not be required, but if you could add an additional statement
about avoidance and minimization. The Corps does not consider this to be a new submittal and the turnaround time
should be quick as soon as we get the updated PCN. Please let me know if you have any additional questions. You can
submit the revised PCN directly to myself and Robb.

Ok, please provide me guidance on how to handle this one. The USACE considers the channels jurisdictional ditches (per
attached email and previous emails and DOT permit) and the DWR considers them jurisdictional intermittent streams
(per today's email below).
The roadside ditch (impact #1) was previously permitted as a linear wetland (I assume by both the USACE and DWR) per
Rachel's research that she provided me in an email back on November 1st last year, excerpt below.
"It appears as though a few year back our DOT Regulator went out and made a determination that those features were
jurisdictional. He looked mostly at the roadside feature and called it a linear wetland, but made comments about the
other features onsite as well that I can use to make my jurisdictional call along with your pictures. It appears as though
the Corps would consider the features to be considered jurisdictional and impacts would require a permit. ..."

As such and in good faith, we had been considering them to be jurisdictional ditches up until this point and had been
referring to them as such in several emails since last November.
I saw no need to bring DWR out to make a stream determination for the applicability of the buffer rules as this is not in a
State buffered basin (Neuse, Tar‐Pam, etc.). It's my understanding that the USACE makes the determination as to stream
vs. wetland or ditch in those cases.
Also, our PCN application was submitted on February 13th and I did not hear form DWR until April 7th (54 days into the
60 day review) and they didn't make their stream determination until April 8th (55 days into the 60 day review) and
notify me as such until today April 13th (60 days since the application was submitted).
Sorry, but this is all very frustrating that I'm now going to have to go back to my client and inform them that these
ditches are considered intermittent streams by DWR and that they need to provide further justification for the impacts.
I'll go back to the client and inform them as such, but will need guidance on how to revise the PCN to call these
jurisdictional ditches by the USACE and intermittent streams by DWR.
Rachel ‐ I'll also confirm the flow paths that you requested in your email, but believe your assumptions to be correct.

I hope you and your family had a nice holiday weekend. Joanne Steenhuis and I were on‐site last Wednesday (4/8/2020)
to take a look at these features within the project area, and determined that the feature depicted as #2 impact in the
PCN is an intermittent stream (see attached DWR Stream ID form). The feature depicted as impact #4 would also be
considered an intermittent stream. We walked the feature along HWY 24 towards the south up to Koonce Fork Road,
and this feature depicted as #1 impact appears to be an intermittent stream, based on the flora and fauna that were
observed. We concur that feature that is depicted as #3 impact would be a ditch. Based on information from the USGS
StreamStats GIS, it appears these streams are within an approximately 108 acre drainage area (see attached USGS
StreamStats image and LIDAR map). Further, based on the information you provided in the PCN application (Soil Survey
map, and NWI map), appear to be consistent with our determination.
At this time, we are placing this application on‐hold, and we are requesting that the PCN and site plans reflect this
determination, and we also request additional information in regards to demonstrating avoidance and minimization.

material into an intermittent stream for the construction of commercial outparcels. An additional 0.005 acres of open water
ditch will also be impacted for the construction of a road. The flow from the onsite wetland will be rerouted, but still
directed to downstream waters offsite and into the New River.

Dear Mr. Sylvester:
You have our approval, in accordance with the attached conditions and those listed below to allow for the
permanent impacts involving approximately 0.005 acres of open water area and approximately 894 total
linear feet of intermittent stream area, as described in your application received by the N.C. Division of
Water Resources (DWR) on February 13, 2020, sequential information received April 14, 2020, April 17,
2020, April 20, 2020, and April 21, 2020. After reviewing your application, we have decided that the
impacts are covered by General Water Quality Certification Numbers 4139 (GC4139).
This Certification allows you to use the Nationwide Permit 39 when issued by the U.S. Army Corps of
Engineers. In addition, you should obtain or otherwise comply with any other required federal, state or
local permits before you go ahead with your project including (but not limited to) Erosion and Sediment
Control, Non-discharge, and stormwater regulations. Also, this approval to proceed with your proposed
impacts or to conduct impacts to waters as depicted in your application shall expire upon expiration of the
404 Permit. This Certification can also be found on line at: https://edocs.deq.nc.gov/Forms/Certificate-of-

This approval is for the purpose and design that you described in your application. If you change your

4. Turbidity Standard
The turbidity standard of 25 NTUs (Nephelometric Turbidity Units) shall not be exceeded as described in
15 A NCAC 2B .0220. Appropriate sediment and erosion control practices must be used to meet this
standard. Turbidity curtains shall be used as appropriate. Please notify this Office if any turbidity

5. All wetlands, streams, surface waters, and riparian buffers located within 50 feet of the
construction area on the project site shall be clearly marked (example- orange fabric fencing) prior to any
land disturbing activities and must be maintained on the property until the project phase is completed.

6. Appropriate measures should be installed prior to any land clearing activities to protect waters
and wetlands from turbidity and/ or sedimentation. These measures should be routinely inspected and
properly maintained, and excavated materials should be contained outside the wetland boundary.
Excessive silt and sediment loads can have numerous detrimental effects on aquatic resources including
destruction of spawning habitat, suffocation of eggs, and clogging of gills of aquatic species. [15A
NCAC 02H .0506 (b)(3) and (c)(3)]
7. This General Certification shall expire on the same day as the expiration date of the
corresponding General Permit. The conditions in effect on the date of issuance of the Certification for a
specific project shall remain in effect for the life of the project, regardless of the expiration of this
Certification.
8. The permittee shall require its contractors and/or agents to comply with the terms of this permit in
the construction and maintenance of this project, and shall provide each of its contractors and/or agents
associated with the construction or maintenance of this project a copy of this certification. A copy of this
certification including all conditions shall be available at the project site during the construction and
maintenance of this project. [15A NCAC 02H .0507 (c) and 15A NCAC 02H .0506 (b)(2) and (c)(2)]
9. Continuing Compliance:
The applicant/permittee and their authorized agents shall conduct all activities in a manner consistent with
State water quality standards (including any requirements resulting from compliance with 303(d) of the
Clean Water Act), and any other appropriate requirements of State and Federal law. If the Division
determines that such standards or laws are not being met, including failure to sustain a designated or
achieved use, or that State or Federal law is being violated, or that further conditions are necessary to
assure compliance, than the Division may reevaluate and modify this General Water Quality Certification.

10. All mechanized equipment operated near surface waters or wetlands will be regularly inspected
and maintained to prevent contamination of waters and wetlands from fuels, lubricants, hydraulic fluids or
other potential toxic chemicals. In the event of a hydrocarbon or chemical spill, the permittee/contract or
shall immediately contact the Division of Water Quality, between the hours of 8 am to 5 pm at the
Wilmington Regional Office at 910.796.7215 and after hours and on weekends call (800) 858-0368.
Management of such spills shall comply with provisions of the North Carolina Oil Pollution and
Hazardous Substances Control Act. [15A NCAC 02H .0506 (b)(3) and (c)(3), 15A NCAC 02B .0200
(3)(f), and GS 143 Article 21A].
11. Fueling, lubrication and general equipment maintenance should not take place within 50 feet of a
waterbody or wetlands to prevent contamination by fuel and oils. [15A NCAC 02H .0506 (b)(3) and
(c)(3) and 15A NCAC 02B .0200 (3)(f)].
12. This certification grants permission to the director, an authorized representative of the Director,
or DEQ staff, upon the presentation of proper credentials, to enter the property during normal business
hours 15A NCAC 02H.0502(e).

Upon completion of all work approved within the 401 Water Quality Certification or applicable Buffer
Rules, and any subsequent modifications, the applicant and/or authorized agent is required to return a
completed certificate of completion form to the NCDEQ DWR 401 and Buffers Unit North Carolina
Division of Water Resources, 1617 Mail Service Center, Raleigh, NC, 27699 within ten days of project
completion. The certification of completion is available at: https://edocs.deq.nc.gov/Forms/Certificate-of-
Completion).
Violations of any condition herein set forth may result in revocation of this Certification and may
result in criminal and/or civil penalties. The authorization to proceed with your proposed impacts or to
conduct impacts to waters as depicted in your application and as authorized by this Certification shall
expire upon expiration of the 404 or CAMA Permit.
This approval and its conditions are final and binding unless contested.
This Certification can be contested as provided in Articles 3 and 4 of General Statute 150B by filing a
written petition for an administrative hearing to the Office of Administrative Hearings (hereby known as
OAH). A petition form may be obtained from the OAH at http://www.ncoah.com/ or by calling the OAH
Clerk’s Office at (919) 431-3000 for information.
Within sixty (60) calendar days of receipt of this notice, a petition must be filed with the OAH. A petition
is considered filed when the original and one (1) copy along with any applicable OAH filing fee is
