(CEI) is requesting a reissuance of the Serenity Subdivision Nationwide 29 permit dated May 8, 2020. Several areas have undergone further engineering design and constructability review, resulting in the minor changes described below and depicted in the attached impact tables and drawings. The results of the changes allow the initial phase of the project authorized under the current NWP 29 (Action ID SAW-2018-012450) and General Certification 4139 (NCDWR # 19-1445) to be constructed, while also allowing for the future phases, which would require an Individual Permit, to be pushed back until at least 2022. Revised Impact Sites The following changes are proposed to the May 2020 permit. A complete set of impact exhibits, including the three revised sheets below, are attached for your review. Impact Site W1 (Sheet CWI-1.1) The road crossing at this location has been refined during final design efforts to decrease impacts to wetland area W1. Slopes and grade were adjusted slightly to allow this decrease in impact while maintaining roadway function and stability. The result is an 0.09 acre decrease in permanent wetland impacts and an 0.003 acre increase in temporary wetland impacts. Impact Site O21 (Sheet CWI-1.14) Due to constructability review of the design by the selected contractor, it was determined that Retreat Drive, which runs adjacent to Pond PE, could not be constructed without impacting the pond. Roadway slopes have been steepened to the maximum extent practical, and a retaining wall has been added to minimize impacts. The result of these efforts is a 0.003 acre permanent open water impact and a 0.005 acre temporary open water impact for construction access. Impact Site W22 (Sheet CWI-1.15) Due to the decrease in impacts at Site W1, described above, an opportunity was recognized that would allow construction of Inspiration Way during the first phase of the project. This wetland Ms. Emily Greer January 20, 2020 Page 2 of 2 crossing (W22) would allow for the first phase of the development to be marketable throughout 2021 by delivering larger lots to market, and results in the need for an Individual Permit for the future phases to be pushed back to 2022. This would require 0.108 acre of permanent wetland impact and 0.009 acre of temporary wetland impact to construct the roadway. Impact Change Summary The construction of the first phase of this project would result in an increase of 0.021 acre of permanent loss of Waters of the US, and an increase of 0.017 acre of temporary impacts. Proposed total loss of Waters of the US for these revised impacts is 0.497 acre. Impacts to streams on the project have not changed. Table 1 (attached) displays the updated wetland impacts (yellow highlight indicates changed impact area). Table 2 (attached) displays the new open water impacts. The revised impacts would result in the need for an additional 0.04 acre of mitigation (for an increase of 0.036 acre of mitigation credits above the previously approved 1.33 acres of credits) for permanent loss of forested wetland. This is proposed to be supplied by the NC Division of Mitigation Services similar to the previously approved impacts. We request your review and reissuance of the associated Nationwide Permit 29 for this project. This request is also being provide to the NC Division of Water Resources for their review and reissuance of GC 4139.
