Alexander III 312 Homestead Drive Cary, NC 27513 Subject_ Property: Yeargan Road Tract Hwy 70, Garner, NC On -Site Determination for Applicability to the Neuse River Riparian Area Protection Rules (15A NCAC 0213 .0233) Dear Mr. Alexander: On August 18, 2010, at your consultant's request, Amy Chapman from the Division of Water Quality (DWQ) conducted an on -site determination to review a feature located on the subject property for applicability to the Neuse Buffer Rules (15A NCAC 02B .0233). On February 11, 2011, at your consultant's request, Periann Russell and Ian McMillan from DWQ performed an onsite appeal of the same feature for applicability to the Neuse Buffer Rules (15A NCAC 02B .0233). DWQ has determined that the feature labeled as "A" on the attached map initialed by Amy Chapman on July 17, 2012, is subject to the Neuse Buffer Rules starting at the confluence (coordinates: Lat 35.714460622 N, Long 78.628962328 W) of features "A" and "B ". DWQ has determined that the feature labeled as "A" on the attached map initialed by Amy Chapman on July 17, 2012, is not subject to the Neuse Buffer Rules between Yeargan Road and the confluence (coordinates: Lat 35.714460622 N, Long 78.628962328 W) of features "A" and "B ". DWQ has determined that the feature labeled as "B" on the attached map initialed by Amy Chapman on July 17, 2012, is not subject to the Neuse Buffer Rules. This determination shall replace all determinations previously performed by DWQ. You can contest this decision as provided in Articles 3 and 4 of G.S. 150B. To contest this decision, you must file a petition for an administrative hearing. You may obtain the petition form from the Office of Administrative Hearings. You must file the petition with the Office of Administrative Hearings within sixty (60) calendar days of receipt of this notice. The Office of Administrative Hearings accepts filings Monday through Friday between the hours of 8:00am and 5:00pm, except for official state holidays. The petition may be faxed - provided the original and one copy of the document is received by the Office of Administrative Hearings within five (5) business days follo:virg the faxed transmission.
