Subject B 4273 Response to NC Division of Water Quality ( NCDWQ) Letter
As you are aware the NC Department of Transportation (NCDOT) submitted a permit
application on May 31 2012 for TIP Project No B 4273 to NCDWQ This letter addresses each
item in NCDWQ s July 10 2012 letter regarding the proposed replacement of Bridge No 47 over
the Lumber River on US 401 in Scotland and Hoke Counties Each bullet from the original letter
is presented below in italics with NCDOT s response immediately following
A copy of NCDWQ s letter is also provided for your convenience
• Please provide a detailed restoration and monitoringplan for the proposed onsite detour
Once the temporary detour fill is removed and the preconstruction contours of the area have
been reestablished the impacted area will be revegetated in accordance with the
Reforestation Detail Sheet (attached) The area will be visually monitored for three years to
ensure successful revegetation of the area The Reforestation Detail Sheet is typically
included in the erosion control plans for a project
• Section D 1 a of the PCN you state that coir fiber matting will be placed under the temporary
fill for the detour this product is typically used as erosion control matting and geotextile
fabric is used under temporary fills Please clam
It was a typographic error in stating that coir fiber matting would be placed under the
temporary fill of the detour The material to be used will be soil stabilization geotextile This
material would provide a stable barrier that could be found again when the temporary
detour fill is removed

• Permit Drawing Sheet 11 of 14 notes excavation in wetlands but this is not identified in your
wetland impact summary Please clarify
The excavation of wetlands noted on Permit Drawing 11 of 14 is a relic of earlier versions of
the permit drawings It was determined later that no excavation of wetlands was needed The
symbolism showing the excavation was inadvertently left on the revised drawings A revised
sheet correcting this issue is included with this letter Please replace the corresponding sheet
in the permit package with the new revised sheet

• The Lumber River is classified as High Quality Waters In accordance with 15A NCAC
02H 1000 a stormwater permit is required for this project Please submit a stormwater
permit application to the Mike'Lawyer in our Fayetteville Regional Office
Per the NCDOT Hydraulics Unit this project was submitted to DWQ and determined
exempt by Mike Lawyer Attached is the exemption letter
• Permit Drawing Sheets 4 and 5 of 14 shows the same symbol for all proposed impacts
including mechanized clearing Please clam the location of proposed impacts on these
sheets
A revised copy of Permit Drawing 4 and 5 of 14 have been included with this letter to address
the impacts in these sections Please replace the sheets in the permit package with the new
revised sheets
We feel that the above responses adequately address NCDWQ s concerns and respectfully
request that the NCDWQ continue to process NCDOT s permit application If you have any

NCDOT Project Number 33614 1 1 (B- 4273), Bridge #47 over Lumber River on US 401 project in
Hoke /Scotland Counties Based on our review of the project details you do not appear to be proposing a
development activity at this site at this point in time that would be subject to the stormwater requirements as
provided for in Title 15A NCAC 02H 1000 Please be advised that other regulations will potentially apply to your
proposed activities
If your project disturbs one acre or more and has a point source discharge of stormwater runoff then it is subject
to the National Pollutant Discharge Elimination System (NPDES) stormwater discharge requirements You are
required to have an NPDES permit for stormwater discharge from projects meeting these criteria
This exemption applies only to the State Stormwater Management Permit for the currently proposed activity If at
any time in the future development of any part of this site is planned as defined in 15A NCAC 02H 1000 or if
the proposed activities differ in any manner from what is shown on the plans on file with the Division you must
submit the project for review of the applicability of the stormwater management rules If you have any question
