SECRETARY July 10, 2012 Ms. Liz Hair Asheville Regulatory Field Office U.S Army Corps of Engineers 151 Patton Ave, Room 208 Asheville, NC 28805 Mr. Davicl Wainwright NCDENR - Division of Water Quality Transportation Permitting Unit 1650 Mail Service Center , Raleigh, NC 27699-1650 Dear Ms. Hair and Mr. Wainwright: The NC Turnpike Authority submitted a permit application to you in March 2012 in order to obtain the Section 404 permit and Section 401 Water Quality Certification far the construction of the Gaston East-West Connector (also known as Garden Parkway) project, State Transportation Improvement Project U-3321 in Gaston and Mecklenburg Counties. It is our understanding that environmental groups intend to pursue litigation challenging the environmental study on the Project. We will vigorously defend any future litigation but believe it would be prudent to withdraw the permit applications at this time so that the permits are not in "limbo" during the probable litigation. Therefore, the NC Turnpike Authority has decided to withdraw the permit application and will resubmit it at a later date. In the interim, �ve intend to review the comments you received during the public comment period. When we resubmit the permit application, we will provide information related to the comments and revise the permit application if necessary.
