ASSESSMENT FACTORS
If The degree and extent of harm to the natural resources of the State, to the public health, or to
private property resulting from the violation;
No harm has been documented. Total suspended in excess of the effluent monthly average permit limit
would predict an impact on the receiving waters. Aquatic life may have been adversely effected by an
increase in suspended solids (turbidity) of the stream and also by a decrease ofavailabie dissolved
oxygen.
2) The duration and gravity of the violation;
The violations occurred during the month of April 2010. The monthly permit Breit liar total suspended
solids was exceeded by 32%. Thefficility also failed to monitor for ternperaturc on 17 ocassions during
the month of April 2010. Historically, the permittee has failed to monitor for temperature as required by
the permit since October 2010 although there has been repeated enforcement and communication from
the division. The perri-rittee has applied for a SOC to seek interim limits for BOD and ammonia nitrogen
until the facility can tie onto the Gastonia collection system, ceasing the discharge. TSS and
temperature monitoring frequency is not included in the SOG A $3,000 upfront settlement to cover all
outstanding civil penalty assessments until the issuance of the SOC has been negotiated. The penalty
will be held in abeyance until final compliance with the SOC is determined.
3) The effect on ground or surface water quantity, or quality or on air 411ality;
No effect is expected on ground water or air quality. Surface waters may have been impacted due to an
increase in turbidity of the receiving strearn and possible decrease of dissolved oxygen.
4) The cost of rectifying the damage;
The cost is unknown.
5) The amount of money saved by noncompliance;
Money may have been saved by the contract operator not monitoring the temperature on as daily (5X
week) basis as required by the permit. A monetary amount is unknown.
6) Whether the violation was committed willfully or intentionally;
The violation does not appear to be willful or intentional.
7) The prior record of the violator in complying or failing to comply with programs over which the
Environmental Management Commission has regulatory authority; and
The facility has a poor compliance record. A SOS' application has been submitted and the porn-rittee has
signed the C. The SOC issuance is pending review and public notice. Below are civil penalty assessments
during the previous 12-month period.
