Dear Mr. McCall:
This letter transmits a Notice of Violation and assessinent of civil penalty in the arnount of' S285.30
($200.00 civil penalty -� $85.30 enfiorceirient costs) against Pines Mobile Home Park (]'lines iktHP),
This assessment is based upon the following facts, A review has been conducted of the self -monitoring
data reported for Decen-ibar 2008. This review has shown the subJect facility to be in violation of the discharge
limitations found in PDES Permit No. NCO074799. The violations are sure triarized in Attachment A to this
letter.
Based upon the above facts, I conclude as a matter of law that Pines -%,IlIP violated the tern -is, conditions.,
or requirements of NPDES Pern-fit No. NCO074799 and North Carolina General Statute (G,S.) 143-215. l(a)(6)
in the manner and extent shown in Attachment A. A civil penalty may, be assessed in accordance with the
maximums established by G.S. 143-215.6A(a)(2).
Based upon the above findings of fact and conclusions of law, and in accordance with authority
provided by the Secretary of the Department of Environment and Natural Resources and the Director of the
Division 0Water Quality, 1, Robert B. Krebs, Surfiace Water protection Regional Supervisor for the
Mooresville Region, hereby make thefollowing civil penalty assessment against Pines MIIP:

BOD and arnmonia nitrogen in excess of pennit firruts would likely cause adverse
