This letter transmits a Notice of Violation and assessment of civil penalty in the amount of
$1,33506 (S1,250.00 civil penalty $85.06 enfoxcernent costs) against Delta Apparel,, Inc.
I -
This assessment is based upon, the following facts:. review has been conducted of the self -
monitoring data reported for Febraary 22011. This review has shown the subject facill'ity to be in
violation of the discharge limitations found in PDES Permit No,'NC0006190. The violations are
summarized in Attaclurient A to this letter,
Based upon the above facts, f conclude as as matter of law that Delta Apparel, Inc, violated the
terms, cc-riditions, or requirements of PDES Permit No. '-,'NCO006190 and North Carolina General
Statute (G.S,) 143-215. 1 (a)(6) in the manner and extent shown in Attaclunent A- A civil Penalty may
be assessed in accord ance v4-ith the maxtri-n-MIS established by G.S. 143-21 15,6A(a)(2).
Based upon the above findings offact and concluisions of law, and in accordance with authority

1) The degree and extent of harm to the natural resources of the State, to the public health, or to
private property resulting from the violation;
No harm to the environment has been documented.
2) The duration and gravity of the violation;
The total phenois concentration of 30.7 lbs/day on February 2, 2011, exceeded the daily maximum
permit limit of 8,0 Ilss/day by 284.3%, This elevated concentration resulted in a monthly average
phenol concentration of 7,69 lbs/day as reported by the permittee. However, the phenol sample
collected on February 23, 2011, was accidentally destroyed by the analytical laboratory before
analysis. A phenol analysis was performed on an unpreserved portion of another sample collected
during the monitoring event. Because the sample was not properly preserved for total phenol
analysis as per Standard Methods the validity of the phenol concentration reported for this sample is
questionable and it should not be used to calculate the monthly average The monthly average
concentration using the other three samples is 10.3 lbs/day is exceeds the monthly average permit
limit of .0 lbs/day by 156,2W

The effect on the receiving stream is unknown. Phenol, when combined with chlorine, forms
chlorinated phenolic compounds with the potential to taint fish tissue and drinking water, thus
degrading taste and odor (organoleptic concerns),

As you requested, on July 8, 2011, 1 conducted a paper trail data review for the 2/2/ 11 effluent grab phenol sample
from Delta Apparel analyzed by Pace Analytical - Asheville (lab ID-. 9286943002). The sample was analyzed per EPA
Method 420.4, semi automated colorimetric procedure, on a Konelab analyzer on 2/8/2011. The review included
looking at sample check in procedures in addition to the specific data set that included the sample in question.
Observations made include:
Nothing was documented that indicated a mix up or problem with the sample at sample check in at the laboratory —
reviewed Chain of Custody and Sample Condition Upon Receipt forms.
Phenol samples are collected in a unique sample bottle, an amber 250 ml bottle, that is not used for any other samples.
This greatly reduces the chances that bottles were inadvertently mixed up.
While the value obtained was unusually high, for both this particular facility and phenol samples in general, there was
nothing within the sample run that indicated a problem with the value obtained. The fact that the sample was a grab
sample indicates that a slug of something containing the unusually high concentration of phenols may have been
collected.
•
There were two matrix spike and duplicate analyses quality control failures with this run (both have ± 10 % acceptance
criteria) . None involved the sample in question. Matrix spike and duplicate quality control analyses are dependent upon
the particular matrix of the sample used for the spike and duplicate and therefore are not something that invalidates or
leads to questions about another sample in a particular analytical run. In this instance the spikes and duplicates had low
recovery, not adding any support to a false high value for any samples. The quality control measures that are more
reflective of the entire analytical run, the blank and the Continuing Calibration Verification standard (CCV), met
acceptance criteria, In fact they were very good, The value of the blank and CCV four samples prior to the sample in
question were -0.002 and 0.250 mg/1 (true value 0.250 mg/l, 100% recovery) respectively. The value of the blank and
CC V immediately after the sample in question were -0.003 and 0.247 mg/L (99% recovery).
In conclusion, there was nothing found in the data review to invalidate the value obtained for the sample In question,
