REQUEST FOR MORE INFORMATION
Dear Mr. Hicks:
On December 15, 2006, the Division of Water Quality (DWQ) received your application dated September 18,
2006 to dredge 18,768 cubic yards of sand from below the Normal Water Line of an existing marina and
bulkhead 3272 linear feet of shoreline for the purpose of redevelopment as described in your application. The
DWQ requested more information regarding your project on February 2, 2007 and that information was
received on March 28, 2007 although not in full. The DWQ has determined that your application was
incomplete and/or provided inaccurate information as discussed below. The DWQ will require additional
information in order to process your application to impact protected wetlands and/or streams on the subject
property. Therefore, unless we receive the additional information requested below, we will have to move
toward denial of your application as required by 15A NCAC 2H .0506 and 15A NCAC 2b .0233 and will place
this project on hold as incomplete until we receive this additional information. Please provide the following
information so that we may continue to review your project.
Additional Information Requested:
1. Impacts to the Neuse River Riparian Buffer
There is a six (6) foot wide walkway landward of the bulkhead proposed for the new basin and a haul out area for
vessel retrieval. Please provide the enumerated impacts to the riparian buffer associated with this portion of the
project.
2. Please provide a vegetation restoration plan for the new areas of the Neuse River Riparian Buffer around the
reconfigured marina basin. Please contact Kyle Barnes, of this office, to clarify issues of concern noticed during
the review of information submitted on March 28, 2007.
Please respond in writing within three weeks of the date of this letter by sending this information to Mr. Kyle Barnes of
the DWQ Washington Regional Office and Ian McMillan of the 401 Oversight/Express Unit in the Raleigh Central
Office. If we do not hear from you within three weeks, we will assume that you no longer want to pursue this project and
we will consider the project as withdrawn.

This letter only addresses the application review and does not authorize any impacts to wetlands, waters or protected
buffers. Please be aware that any impacts requested within your application are not authorized (at this time) by the DWQ.
