Box 8306 Greensboro, NC 27419 Dear Mr. Siegal: On April 9, 2007, the North Carolina Division of Water Quality (DWQ) received your application fora 401 General Water Quality Certification to cumulatively impact 140 linear feet of two unnamed tributaries to Muddy Creek in order to construct a road crossing and a sewer line crossing to serve the proposed Chamberlain Place Apartment Homes located on Kinnamon Road in Clemmons, Forsyth County. Based on the information provided in your application, additional information is required in order that we may determine your project's compliance with 15A NCAC 2H .0500. Unless otherwise specified, please provide five (5) copies of the following information: 1. A final, written stormwater management plan must be approved in writing by this Office before the impacts specified in this authorization occur, per condition No. 4 in General Certification 3631. Please provide a comprehensive stormwater management plan that includes plans and specifications for stormwater management facilities which are appropriate for surface waters that are classified as Class C and biologically impaired (303d listed). These facilities must be designed to remove, at a minimum, 85% Total Suspended Solids and to provide adequate nutrient removal according to the most recent version of the NC DENR Stormwater Best Management Practices Manual. These facilities must be designed to treat the runoff from the entire project unless otherwise explicitly approved by the Division of Water Quality. Until the information requested in this letter is provided, I will request (by copy of this letter) that the U.S. Army Corps of Engineers place this project on hold. Also, this project will be placed on hold for DWQ processing due to incomplete information (15A NCAC 2H .0507(h)). The processing of this application will begin when the requested information is received. Please be advised that if your proposed activity is subject to Section 404 of the Clean Water Act (33 U.S.C. 1344), you must also receive a Section 401 Water Quality Certification from the N. C. Division of Water Quality before you begin any work.
