Thank you for your review of the application. Each item requested is provided below with our
response.
Please provide detailed information for the proposed greenway including engineering plans.
Please explain if the proposed greenway meets the definition of “built-upon area” [15A NCAC
02B .0610(5)] as defined in G.S. 143-214.7(b2).
Attached is a detail of the proposed trail construction. The greenway surface will be
mulch and will receive only pedestrian and bicycle traffic. Therefore, it does not meet
the definition of built-upon area, is categorized as deemed allowable and does not
require an authorization.
Please provide detailed engineering plans, profile views, and cross-sections of all proposed
culverts for impact W1. These drawings must include details regarding pipe slope, pipe burial,
etc. as applicable [15A NCAC 02H .0502(a) and (c) ] .0502(a)(9).
Construction Drawing sheet C5.09 is attached showing the plan and profile of the
greenway, sanitary sewer and force main co-located crossing of Wetland 1. The pipe
slope of these culverts is between 1 and 2%.
Please provide cross section details showing the provisions for aquatic life passage at the
proposed culverts for impact W1 [15A NCAC 02H .0506(b)(1)].
Sheet C5.09 mentioned above shows that the culvert inverts are set at the wetland
surface to allow aquatic life passage and are not buried to avoid draining the wetland.
Please provide more details regarding avoidance and minimization of wetland impacts for this
project at impact W1. [15A NCAC 02H .0506(b)(1)]
1. This should include alternative designs and layouts of the greenway trail where it crosses
Wetland W1
a. Because the stream/riparian buffer/wetland bisects the property, the greenway
trail crossing is unavoidable. It is provided to connect the portion of the
community on the west side of the stream/riparian buffer/wetland to the east
side by linking the common areas of each side including the recreational
amenities. Moving the crossing downstream to avoid the wetland impact
would impact additional riparian buffer and constitute a second crossing since
the sanitary sewer easement is required in its location to provide service to all
areas of the development. This would also route the greenway trail between
houses instead of along common areas. The impact is minimized by co-locating
the trail along the sanitary sewer easement.
2. You have indicated the proposed sewer easement at impact W2 precludes the use of a
boardwalk for the greenway in this location. Please explain, in greater detail, why a
boardwalk over Wetland W1 is not feasible at this location.
a. The City of Durham Reference Guide for Development (2020-07-31) requires
that sanitary sewer easements are drivable with no structures, trees or
obstructions permitted within the easement. See Section 7: Sanitary Sewer
System and Section 11.1: Engineering Section Notes. This is a link to the

On December 1, 2020, the Division of Water Resources (Division) received your application
requesting a 401 Water Quality Certification and Buffer Authorization from the Division for the
subject project. The Division has determined that your application is incomplete and cannot be
processed. The application is on-hold until all of the following information is received:

.0714, the applicant shall furnish all of the above requested information for the proper consideration
of the application. Please respond in writing within 30 calendar days of receipt of this letter by
sending one (1) copy of all of the above requested information as a reply to this email or by
submitting all of the above requested information through this link:
https://edocs.deq.nc.gov/Forms/Supplemental-Information-Form (note the DWR# requested on the
link is referenced above).
If all of the requested information is not received within 30 calendar days of receipt of this letter, the
Division will be unable to approve the application and it will be denied as incomplete. The denial of
this project will necessitate reapplication to the Division for approval, including a complete
application package and the appropriate fee.
Please be aware that you have no authorization under the Section 401 of the Clean Water Act or the
Neuse Buffer Rules for this activity and any work done within waters of the state may be a violation
of North Carolina General Statutes and Administrative Code.
