This email is sent as the response to the Notice of Violation dated February 16, 2021. The NOV requested that Waste
Connections of Charlotte provide a response to: (1) begin monitoring immediately and (2) submit a written explanation
for why the violations occurred. The requested responses are as follows.
Waste Connections of Charlotte appreciates the time Ms. Hawley spent with our personnel onsite on January 5, 2021.
During this inspection the site was determined to be non -compliant for the required number of semiannual sampling
events for stormwater at this facility. Basically there were gaps in the historical sampling. The site was found to be
compliant for monthly visual inspections, annual comprehensive reporting, monthly SPCC inspections, required
stormwater committee meetings, annual stormwater personnel training, and spent oil/new oil usage documentation.
Personnel changes within both Waste Connections of Charlotte staff and the third party laboratory are the reason for
the missing semiannual sampling.
The lack of sampling was discovered by our manager, Dustin Janes, in mid-2020. He then began sampling as required as
shown by the November 2020 sampling data presented to Ms. Hawley during the inspection. Mr. Janes further self -
reported the mishap during the January 5, 2021 inspection. There are gaps in our historical sampling based upon the
changing of staff. The stormwater committee has been updated with this information and reminders have been
reinstated to rectify this occurrence.
