The existing parking areas are currently located approximately 170 landward of the first line of stable natural vegetation (FLSNV) and landward of the Town of Wrightsville Beach 1939 Building Line however the existing restaurant building is currently is located seaward of the applicant s property and the Town s 1939 Building Line The existing building is partially located within the 60 small structure setback (structures <5 000 sq ft ) and essentially entirely within the 120 setback (structures >5 000 sq ft ) The applicant recently received CAMA Minor Permit No 12 17 from the Town of Wrightsville Beach to allow for construction of an accessory platform for a new walk in cooler /freezer which is authorized to be located on the northwestern portion of the building adjacent to the entrance to the kitchen This platform is designed to be structurally independent of the primary building and to date has not been constructed There is an existing associated dilapidated fishing pier which has been commonly known as Crystal Pier for decades The pier extends from the restaurant building into the Atlantic Ocean a total distance of approximately 475 m length by 20 m width (See Sheet 1 of 4) The application states that the existing pier was originally built in 1939 to a distance of 1 000 in order to overlook the wreck of a Confederate blockade runner The application also states that the pier was destroyed due to Hurricane Hazel in 1954 and rebuilt along with a hotel and apartments The applicant purchased the property in 1989 and renovated the pier house in 1990 and The Oceanic Restaurant was then opened In 1996 Hurricane Fran destroyed approximately half the pier Located on the south side of the existing building and pier is an open pathway to the public ocean beach area Currently the existing pier is barricaded approximately 140 seaward of the restaurant building due to unsafe conditions of the pier It is noted based on the survey that was provided this barricaded area is approximately 55 landward of mean high water (MH W) which prevents accessibility for the fishing component to the public The application states that the restaurant is currently utilizing approximately 100 of the safe portion of the pier for outdoor seating The application also includes a structural investigation report of the entire pier that was done in September 2011 (See Project Narrative engineering investigation report, and Sheets 1 and 2 of 4) The Wrightsville Beach Land Use Plan classifies adjacent waters as Conservation and the adjacent high ground portion of the project area as Developed The waters of the Atlantic Ocean are classified SB# by the Division of Water Quality They are NOT designated as a Primary Nursery Area by the N C Division of Marine Fisheries and they are CLOSED to the harvest of shellfish This project IS NOT within the area of Wrightsville Beach that undergoes regular beach renounshment by the US Army Corps of Engineers The Long Term Average Annual Shoreline Change Rate is 2 per year as designated by the NC Division of Coastal Management in the 1998 update Crystal Pier, LLC c/o Monica Watson Page 3 PROPOSED PROJECT The applicant proposes to restore the old public fishing pier known as Crystal Pier which includes expanding the existing pier with additional decking to allow for an expanded outdoor seating area for existing associated restaurant building The applicant proposes to widen the existing pier which is currently barricaded approximately 140 seaward of the restaurant building and being utilized by the restaurant The pier would be widened with dimensions of approximately 148 m length by 6 in width on the northern side of the pier which would be designated for additional outdoor seating area Additionally the application states that anew partially covered deck measuring approximately 30 m length by 34 in width would be constructed on the eastern side of the existing building which would tie into the pier expansion aforementioned The roof overhang over this proposed deck would measure approximately 12 in this location and would be unenclosed but would utilize temporary windscreens The application also proposes a seasonal awning with structural framing on the existing pier which measures approximately 145 in length by 20 in length from the existing building This would provide a temporary wmdscreen in order to increase the number of usable days for outdoor dining The application states that the structure would be lighted and designed to protect adjacent properties and wildlife The applicant also proposes substantial improvements to the existing old fishing pier to its current dimensions of approximately 475 in length by 20 in width along with a 148 in length by 6 in width expansion of the southern side of the existing pier which would be designated for public access to the fishing pier As proposed, the substantial improvements would be based on the recommendations in the engineering investigation report The application states that the proposed project would restore the intended public access to its use as the pre existing fishing pier The application states that the hours of operation of the public fishing pier would be the following 6 a in to12 p in 7 days a week dung the winter, 6 a in to 12 p in Monday through Friday, and 6 a in to 2 a in Friday and Saturday, during peak season of April 1 to October 31(See Project Narrative Engineering Investigation Report and Sheets 1 through 4) The application states that the outdoor seating area expansion for private use would provide the revenue source with which to fund the entire project and without this revenue source the public access as well as the associated restaurant building is in jeopardy of being lost all together The application states that there are currently 82 existing parking spaces on the property which includes two (2) handicapped spaces The application also states the provided parking must meet local regulatory requirements for the pier and restaurant building 10 ANTICIPATED IMPACTS The proposed expansion of the existing pier and decking would mcorporate approximately an additional 3 276 sq ft of Public Ocean Beach Area however the proposed partially covered deck for outdoor seating would be constructed approximately 15 to 20 landward of the FLSNV Access along the beach should not be HISTORY After the devastating Wrightsville Beach fire of 1934 Floyd Cox built the Mira Mar Pier (now known as Crystal Pier) on the south end of Wrightsville Beach in 1939 The original pier constructed with cypress timbers extended 1000 feet in order to overlook the wreck of a Confederate blockade runner The pier was subsequently renamed the Luna Pier in hopes that the name may relate an association with the nearby Lumina dance hall In 1940 it was purchased from the Hutaff family by the restaurateur Mike Zezefellis The pier included a pier house with a summer dwelling above and restaurant below The pier was destroyed by Hurricane Hazel in 1954 and the structure was rebuilt and included a motel and apartments It continued in operation and was again sold to the Fokakis brothers who operated it until it was sold to Monica Wells in 1989 The pier house was renovated in 1990 and the Oceanic Restaurant was opened Hurricane Fran took out approximately half of the pier in 1996 Since that time the remaining pier has deteriorated and only approximately 100 feet of the remaining 475 foot pier is safe for use Only this remaining approximately 100 foot portion is currently allowed to be utilized by the restaurant as an outdoor dining area The remaining area has been closed by the local jurisdiction due to safety concerns PROPOSED PROJECT The intent of the proposed project is to save the existing Crystal Pier and associated public access from condemnation demolition or further destruction by natural forces The proposed reconstruction and repair of the condemned portion of Crystal Pier will restore the intended public access to its use as the pre -existing fishing pier The addition of the new deck adjacent to the pier -house and the portion of the expansion of the existing pier for private use will provide the revenue source with which to fund the project Without this revenue source the public access as well as the associated pier house is in jeopardy of being lost all together The existing pier -house is technically a non conforming private structure located on public property and is subject to the Wrightsville Beach zoning ordinance and operates under an existing conditional use permit The proposed repair and expansion project has been submitted to the Town of Wrightsville Beach and the approval process is underway for a zoning text amendment and modifications to the conditional use permit The proposed repairs and modifications of the pier depicted in the accompanying application and architectural drawings include Repair of the closed existing fishing pier Expansion of the pier for public access and private use The construction and installation of a seasonal awning on the existing pier Construction of a new deck adjacent to the existing pier house with extension of the roof overhang An accessory platform for a new cooler and freezer is also planned pursuant to the filing of a CAMA Minor Permit Application through the Town of Wrightsville Beach (permit #WB 12 -17) pending The existing fishing pier is approximately 475 ft long by 20 ft wide The closed portion of the pier to be repaired begins approximately 140 feet from the east wall of the existing pier -house and extends to the eastern (seaward) end The proposal expands the existing width of the pier by 6 feet to the north and south for a total of approximately 32 ft in width to a distance of approximately 148 ft from the eastern wall of the existing pier house The south side of this expansion will be utilized for improved public access to the fishing pier with the north side of the expansion utilized for outdoor dining A seasonal awning with a structural frame is proposed to be added to the existing pier in this area with a maximum distance of 145 ft to the east from the eastern pier -house wall This area will be used for outdoor dining and may accommodate a temporary windscreen in order increase the number of useable days for outdoor dining service purposes This structure will have lighting permitted by local regulations and designed according to Dark Sky standards for the protection of adjacent property owners as well as wildlife species A new deck approximately 30 ft by 34 ft will be constructed for outdoor dining service use adjacent to the east side of the pier house on the north side of the pier The roof overhang shall be extended in this location by approximately 12 ft The area underneath will not be enclosed however temporary windscreens may be utilized As soon as all applicable permits can be obtained and project bidding and SIR C - ll"L� j RIME & FORENSIC ENGINEERING AND PR03ECT MAMAGEMEIYT epy Ms Monica Watson 2561 Blue Banks Loop Road NE Leland NC 28451 -7459 Re Crystal Pier Structural Investigation Wrightsville Beach NC 28480 ACE Project No 11044 Dear Monica n The purpose of this letter is to provide our evaluation of the Crystal Pier structural condition During the conduct of our evaluation we spoke with the Wrightsville Beach building inspector to determine his specific concerns Wrightsville Beach s concerns include 1 j a determination of whether the pier could have components fall on pedestrians during normal loading conditions and 2) a determination of whether the pier could fail and damage surrounding structures during a storm event We also discovered during our review that this pier was repaired approximately ten years before we performed our observation Conduct,gffygluatmn We arrived on site on August 1 2011 We began our evaluation by performing a visual observation of the deck and handrails from the top of the pier structure We then performed a visual observation of the substructure including piles pile caps and stringers from the beach At the completion of our visual observation we had certified divers perform an underwater inspection of the piles and provide additional photographs of the pier from the ocean The diver probed each of the piles to determine the current degree of decay -see photo 1 Findings In general this timber pier is in need of extensive repairs The existing structure is likely to fail during a storm event.
