HomeMy WebLinkAbout20170088 Ver 2_DCM Permit_20210215Permit Class Permit Number MODIFICATION/MAJOR 34-17 STATE OF NORTH CAROLINA Department of Environmental Quality and Coastal Resources Commission for X Major Development in an Area of Environmental Concern pursuant to NCGS 113A-118 X Excavation and/or filling pursuant to NCGS 113-229 Issued to NC Division of Marine Fisheries, PO Box 769, Morehead City, NC 28557 Authorizing development in Carteret County within Bogue Sound, 0.41nm south of Spooners Creek , as requested in the permittee’s application dated 9/17/20, including attached workplan drawings (3), Figures 1-3 of 3 all dated 9/8/20. This permit, issued on February 15, 2021 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2024 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee Artificial Reef AR-380 1) Unless specifically altered herein, this permit authorizes placement of additional material at artificial reef AR-380, all as expressly and specifically set forth in the attached permit application, project narrative, and workplan drawings. No other structure, whether submerged, floating or stationary, shall become a permanent part of this artificial reef without permit modification. No non-water dependent uses of structures shall be conducted on, in or over public trust waters without permit modification. (See attached sheets for additional conditions) NC Division of Marine Fisheries Permit No. 34-17 Page 2 of 2 ADDITIONAL CONDITIONS 2) In accordance with commitments made by the permittee, reef construction within the site shall be accomplished using 250 bay ball reef units as depicted in the attached workplan drawings labeled Figures 2-3 of 3. All materials shall be free from loose dirt or pollutants except in trace quantities. General 3) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 4) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. 5) All debris associated with the removal or construction of the permitted development shall be contained within the authorized project area and removed to an appropriate upland location. 6) This Major Modification shall be attached to Permit No. 34-17, which was issued to the permittee on 3/9/17, and copies of both documents shall be readily available on site when a Division representative inspects the project for compliance. 7) All conditions and stipulations of the active permit remain in force, under this Major Modification, unless specifically altered herein. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers assigned the proposed project COE Action Id. No. SAW- 2016-01896. NOTE: The Division of Water Resources assigned the proposed project DWR Project No. 2017-0088 v2. NOTE: An application processing fee of $250 was received by DCM for this project.
