Description of proposed activity [Also, please attach a map of sufficient detail (such as a plat map or site plan in Adobe (pdf) format) to accurately delineate the boundaries of the land to be utilized in carrying out the activity, the location and dimension of any disturbance in the riparian buffers associated with the activity, and the extent of riparian buffers on the land. Include the area of buffer impact in ft2.: The proposed project is to construct a multi - family residential development and associated infrastructure including parking and stormwater management device Variance Request Form, page 2 Version 6 July 2009 (see attached plans). To accomplish this, the site development proposes lot r_ aiding within Zones 1 & 2 of the protected riparian buffer so that the appropriate site grades can be achieved in order to locate the proposed townhome structures on the site. The site plan also depicts the necessary parkin fg acility, which proposes two (2) parking spaces per dwelling unit as is required by the Town of Cary UDO (Chapter 7.8.2, Table 7.8 -1). It should be noted that the site is only 1.25 acres in size, and more than 50% of the site is made up of stream and protected riparian buffers, in addition to the required Town of Cary buffers and setback requirements. Total area of buffer proposed to be permanently impacted is 6,617 square feet. An additional 1,642 square feet of temporary buffer clearing impact is also proposed. A detailed breakdown of the individual buffer impacts is depicted on the attached site plan as well as expounded upon below. Please note: S &EC, PA staff have reviewed and delineated this site and do not believe that an) wetlands exist on the subject property. The only jurisdictional waters include the streams that exist in the buffer avoidance area. No impacts to these waters are proposed. 2. State reasons why this plan for the proposed activity cannot be practically accomplished, reduced or reconfigured to better minimize or eliminate disturbance to the riparian buffers: Based on the small nature of the lot_ in addition to the fact that more than half (50 %) of the site is comprised of stream and Neuse River Riparian area, the applicant needs to disturb the buffer in order to construct the proposed Townhomes, parking lot, sidewalks and necessary stormwater treatment area. The Town of Cary (TOC) has also placed constraints on the property, including a 30 -foot Streetscape Buffer along the Laura Duncan Road frontage, a 15 -foot Streetscape Buffer along the Centre Pointe Drive frontage and a 20 -foot setback from the property line. The 30 -foot buffer and 20 -foot setback requirements are the most detrimental to the site plan as they prohibit the applicant from adjusting the proposed location of the parking lot and townhome structures outside of the Neuse Riparian Buffer. The applicant had prior discussions with the Town of Carl Variance Request Form, page 3 Version 6 July 2009 to determine if a variance to these setbacks would be given and ultimately, the variance request was denied. The Town of Cary will not allow any encroachments into either buffer. An office meeting was held on June 11, 2012 with Ms. Amy Chapman and Ms. Lauren Witherspoon (NC DWO) to discuss the Centre Point Drive project. During the meeting, staff mentioned concerns they had related to "avoidance and minimization" of the site design. The applicant redesigned the project and reduced the overall, initially_ proposed impacts to the site. The stormwater management plan is not finalized, but the project engineer has identified an area they believe to be sufficiently sized in which to place a bio- retention device. The attached map shows the design calculations for the bio- retention area which is treating gpproximately a 0.3 acre drainage area. At DWG's request, the bio- retention area was completely removed from Zone 1 of the riparian buffer and a retaining wall is proposed (instead of an earthen berm) to further minimize potential impacts. The applicant has a potential buyer interested in this site who is hoping gain 7 or 8 townhome lots due to the fact that they were planning on building for an entire family. Per the DWO meeting the applicant has decided to reduce the number of units from the 7 originally _ _proposed down to 6. This reduction in the number of units, as well as relocating proposed retaining wall, has allowed the applicant to remove almost all Zone 1 impacts associated with the townhomes, with the exception of a small amount of Zone 1 impact associated with some minor lot r_ aiding and fill and the proposed retaining wall. Town of Cary requires two (2) parking spaces per unit which created the need to expand the parking into Zone 2 of the Buffer, however, as the number of proposed townhomes has been reduced, the number of required parking spaces has also been reduced (from 14 down to 12). This, therefore, reduces the overall amount of Zone 2 buffer impact associated with the parking lot. Related to the proposed parking lot, DWQ questioned whether or not parking pads or .ages could be located below the townhome units. The applicant determined that due to the existing site conditions, an extensive amount of excavation would be required in order to accomplish this. This would necessitate a large volume of soil to be disturbed and ultimately moved off site (as there are limited areas on- site where it could be disposed of). The applicant believes that the overall impact to the site would be too great. The dumpster location has also been pulled back out of Zone 1 of the riparian buffer. As the number of parking spaces was reduced, there was more room in which to relocate the proposed dumpster. It should be noted that the dumpster is shown as far from the townhomes as is possible as it would be unappealing to have the dumpster located immediately adjacent to the buildings /front doors of the future townhome owners. There is also the need to provide access to it, not only for the residents, but also for the trash trucks so that they have appropriate approach and turn- around clearance when it is emptied. Additionally, there is a swale proposed along. length of the retaining wall (which is also below the proposed dumpster) which captures any and all site drainage and directs it to the proposed bio- retention cel. Not only does this ensure that stormwater generated by this site is captured, but it also confirms that any liquids that have the potential to leak from the dumpster will also be captured and treated within the bio- retention cel. Related to specific construction techniques, the Project Engineer has noted that the construction sequencing will be handled in segments, such that land disturbance will be kept below '/2 acre. In this manner, the applicant will be able to utilize silt fence instead of a sediment basin(s) for sediment and erosion control and thereby minimize any additional riparian buffer impact. Additional details can be provided when the project receives permission(s) to proceed. The applicant has noted that temporary clearing will still be necessary within Zone 1 for construction access and silt fence installation. As mentioned above, this area will be disturbed in stages so as to minimize overall riparian buffer impacts. 4. Description of any best management practices to be used to control impacts associated with the proposed activity (i.e., control of runoff from impervious surfaces to provide diffuse flow, re- planting vegetation or enhancement of existing vegetation, etc.): The applicant is requesting a conditional approval such that the approved stormwater management plan (SNIP), which will be submitted to and reviewed by the Town of Cary, shall then be provided Variance Request Form, page 4 Version 6 July 2009 to DWO for their files prior to any impacts within the riparian buffer. The applicant is proposing a bio- retention area to treat any stormwater runoff generated by the proposed build -out of the site. Additionally, there is a swale proposed along the length of the retaining wall (which is also below the proposed dumpster) which captures any and all site drainage and directs it to the proposed bio- retention cel. Not only does this ensure that stormwater generated by this site is captured, but it also confirms that any liquids that have the potential to leak from the dumpster will also be captured and treated within the bio- retention cel. The applicant is also proposing a retaining wall which is primarily coincident with Zone 2 to minimize the need for rg ading into Zone 1 as well as to create a definable limit to the proposed development and the undisturbed riparian buffer which will thereby ensure protection of the riparian buffer and associated stream. Related to specific construction techniques, the Project Engineer has noted that the construction sequencing will be handled in segments, such that land disturbance will be kept below '/2 acre. In this manner, the applicant will be able to utilize silt fence instead of a sediment basin(s) for sediment and erosion control and thereby minimize any additional riparian buffer impact. Additional details can be provided when the project receives permission(s) to proceed. 5. Please provide an explanation of the following: (1) The practical difficulties or hardships that would result from the strict application of this Rule. The property is listed on the Wake County Register of Deeds as Lot 5 of the Parkway Pointe Office Park which was subdivided as a lot in 1989. This occurred prior to the creation of the Neuse River Buffer Rules. More than likely, the wetland regulations that were in place in 1989 would have allowed the fill of this stream system without written notification and /or approval from either the USACE or NC DWQ. As such, the entire lot could realistically have been available for development as per the designated zoning that remains in place today. As this lot is only 1.25 acres in size and since the Neuse River Buffer Rules effective date of July_ 1997, more than 50% of the lot is no longer available for development. The applicant believes he can receive an acceptable return on his investment if the proposed plan is approved. (2) How these difficulties or hardships result from conditions that are unique to the property involved. _As stated above, the property was subdivided and zoned for the proposed use twenty three (23) years ago and approximately eight (8) years before the effective date of the Neuse River Riparian Buffer rules. The buffer areas alone comprise more than half (50 %) of the property which is only 1.25 acres in size, making any development on this site virtually impossible. Also note, this property is bordered by Laura Duncan Road and Center Pointe Drive on 3 of the 4 sides. The adjacent property is an existing child care facility. The proposed residential townhomes are an appropriate development to be sited beside the daycare facility. It should also be noted that the buffered stream channel is piped onto and off this property and there is limited, if any, buffer area on the abutting p operties (i.e. it has been cleared, permanently maintained, and /or filled. (3) If economic hardship is the major consideration, then include a specific explanation of the economic hardships and the proportion of the hardship to the entire value of the project. Economic hardship is not the major consideration for the applicant. The applicant could potentially make a larger profit if the entire property were available for development (i.e. pursue a vested rights argument), however, the applicant believes the project as proposed will provide an acceptable return on his investment. Also, if a variance were not granted, the property would be for all practicable purposes "undevelopable." Part 3: Stormwater Variance Request Form, page 5 Version 6 July 2009 Provide a description of all best management practices (BMPs) that will be used to control nutrients and sedimentation impacts associated with the proposed activity. Please ensure to include all applicable operation & maintenance agreements and worksheets for the proposed BMPs. Also, include the BMPs on your plan sheets. As discussed above, the applicant requests a conditional approval from the NC DWQ such that the approved Stormwater Management Plan (SNIP), which will be reviewed and approved by the Town of Cary, will then be submitted to DWQ for their records prior to any pacts to the riparian area commencing. The applicant is proposing a bio- retention area to treat any stormwater runoff generated by the proposed build -out of the site as there is limited available area and unacceptable slopes on which to provide diffuse flow. The stormwater management plan is not finalized, but the project engineer has identified an area they believe to be sufficiently sized in which to place a bio- retention area. The attached map shows the design calculations for the bio- retention area which is treating approximately a 0.3 acre drainage area. The applicant recognizes that a significant amount of design work and approvals are yet required. The applicant's goal at this time is to determine if a major variance can be issued prior to a significant expenditure of design time and costs related to the site and the proposed SNIP. The preliminary site plan has been presented to the Town of Cary staff and appears to be acceptable to them, however, the Town will not recommend approval of the site plan and impacts to Zones 1 & 2 of the Neuse River Buffer or impacts to their UTB unless and until DWQ approves the major variance request. The site will comply with the Neuse Stormwater Rule as well as the NPDES Phase II ordinances for the Town. The Town approved SNIP will then be presented to DWQ for their files, meeting the DWQ requirements that the SNIP be approved by a certified local government (CLG) prior to the proposed impacts to the buffer occurring_ 2. Attach a description of how diffuse flow will be maintained through the protected riparian buffers. Please ensure to include all applicable operation & maintenance agreements and worksheets for the proposed diffuse flow measure(s). Also, include the diffuse flow measure(s) on your plan sheets. Diffuse flow will not be required given that the applicant is proposing to treat all stormwater runoff in a bio- retention area. Per the project engineer, based upon the very small drainage area (0.3 acres), and the minimal amount of flow (i.e. lcfs after 100 year storm), no bypass channel appears to be necessary and the resultant discharge can be handled via a rip rap pad dissipater. Additionally, the applicant and project engineer will also evaluate directing g the discharge to an existing cg onveyance in order to minimize additional buffer impacts incurred by either a rip rap pad or bypass channel. This will be finalized along with the Town approved SNIP that will be provided to DWQ. 3. What will be the annual nitrogen load contributed by this site after development in pounds per acre per year without structural BMPs (stormwater pond, wetland, infiltration basin, etc)? Attach a detailed plan for all proposed structural stormwater BMPs. Please see the calculations as provided by the engineer on the attached proposed site plan. If buffer restoration is the method you are requesting, be sure to include a detailed planting plan to include plant type, date of plantings, the date of the one -time fertilization in the protected riparian buffers and a plan sheet showing the proposed location of the plantings. The applicant proposes to either purchase buffer mitigation credit throu _gh an appropriate, private mitigation bank (should one be available) or to make an in -lieu payment to the NC EEP for the proposed buffer impacts. The applicant wishes to determine if this major variance request will be issued prior to reserving credits at a private mitigation bank as they, typically, require a significant deposit up front prior to set the credits aside. Part 5: Deed Restrictions By your signature in Part 6 of this application, you certify that all structural stormwater BMPs required by this variance shall be located in recorded stormwater easements, that the easements will run with the land, that the easements cannot be changed or deleted without concurrence from the State, and that the easements will be recorded prior to the sale of any lot.
