She finally had a chance to review the situation at the Yanceyville Wal -Mart and has determined the following: DWQ Stormwater Unit for now is allowing "infiltrating wet ponds" to remain without modification provided that the vegetation around the current permanent pool is stable. Based on the pix provided, the side slopes look to be stable. So, it can remain without modifications as long as: - The side slopes remain stable. - It is actually receiving the runoff from the drainage area. - The pond is not being drained by an underground piping system that has inadvertently been disturbed. That last bullet was based on a site where they disturbed some old pipes under the construction area and that was the cause of the wet pond infiltration. At this time if you have confirmed that the runoff is going to the pond then we will allow the pond to remain without modifications. I will probably try to go see the pond during /after a heavy rainstorm sometime this summer and confirm for myself that it is receiving runoff. I'm not sure when I'll have a chance to do that though, so in the meantime the Division is currently satisfied. Inspections and proper maintenance of the pond must continue for the life of the site. As you can see, the water level is still not up to the designed permanent pool elevation. We have until August 15th to monitor but I wanted to keep you in the loop. To date, I haven't witnessed much fluctuation. With that said, the pond is serving its purpose of removing TSS. I can argue that it is exceeding the design requirements since stormwater is percolating into the ground and is not discharging particulates into the stream. Is it possible to discuss a permit mod that allows the pond to remain as constructed which meets the design requirements? Thank you Austin L. Watts, P.E.
