This Office received Mr. Gwin Hedrick request for a Minor Variance to the Neuse Buffer Rules (15A
NCAC 02B .0233 (9) (a) on April 23, 2012. The Variance request is for the construction of 2 (two) 10
feet by 22 feet decks in Zone 2 of the riparian buffer. The decks are proposed to be handicap assessable.
The applicant did not meet the requirements outlined in 02B .0233 (9) (a) (i), (A), (B), (C), (E), (F) but
namely (E) in that the subject properCase number 3.erthe effective date of the Buffer Rules.
Please note that a Minor Variance was issues Lo Mr. rneurick on November 4, 2001 (DWQ# 04 -0780) to
impact 1,626 square feet in Zone 2 of the Neuse riparian buffer for the construction of a 7 unit
condominium. The condominium units currently have a recessed porch, on the ground floor, off the
back of each unit. Mr. Hedrick previously applied for a Minor Variance on June 3, 201 land his
application was returned as ineligible (DWQ# 11 -033 1) in that the applicant did not meet the hardships
outlined in 15A NCAC 02B .0233 (9) (a). Based on the previous mention facts the Washington
Regional Office recommends Denial of Mr. Hedrick's Minor Variance request. Attached to this Memo
is a Denial of Request letter and Certified Mail green card. If you should have any question on this
