PROJECT SUMMARY: John Rowland proposed to construct a bulkhead an average of 14'
waterward of normal water level, constnict a 6'x 180' pier with a 20'x 20' platform and two
pilings for a single mooring facility.

PROJECT SETTING
The project site is a 410,970 sf high ground lot with 210' fronting on Tulls Bay. The lot is
situated along Tulls Creek Road at the intersection of Tulls Creek Road and Poyners Road,
in Moyock Township, in Currituck County. No formal address has been assigned to the
property to date. With the exception of two small storage sheds located within the 75' Area
of Environmental Concern (AEC), the lot is vacant. Properties to the north and south have
bulkheads while the property in question remains unprotected with a narrow sandy beach.
An erosion escarpment along the property forms a bluff that is between 7' and 10' in
height. Along approximately 100' of the shoreline the bluff extends as much as 10' above
NWL; this is due in part to mounds of spoil dirt placed by a previous owner.
Located at the northeast corner, adjacent to the neighbors bulkhead, there is rock, brick
and metal debris that has been dumped in an attempt to slow erosion on the site. In
addition, there is a remnant return wall, from a previous bulkhead, that extends
approximately 25' waterward of the adjoining (Franklin) bulkhead. To the south of the
applicant's property, there is bulkhead along the Barnes property with a 16' wall that
extends into the project site.
Staff s onsite review of the request was undertaken during a nor'easter, which allowed a
thorough investigation of the water bottom and shoreline. No submerged aquatic vegetation
or rhizomes were found in or around the project site.
Vegetation consists primarily of domestic grasses, a variety of weeds with a mix of cypress
and pine trees in and along the water. Over 3/a of the property is currently being used for
agriculture and is planted in corn. There are no coastal or non-coastal wetlands on the
property. Adjacent land uses are a mix of residential and agricultural, and the property is
currently zoned agricultural by Currituck County.
A narrow strip of the property adjacent to the water is located in an AE Flood Zone and is
subject to additional authorization by Currituck County. Tulls Bay is classified as joint
waters by agreement between the Marine Fisheries Commission and Wildlife Resources
Commission. The Division of Environmental Management's water quality classification for
Tulls Bay is C (Aquatic Life, Secondary Recreational, Fresh Water) Sw (Swamp Water).
Tulls Bay is also classified as an inland Primary Nursery Area (PNA) with in-water
restrictions between February 15`h and September 30`h of each year. Review indicates that
numerous archeological sites have been found along the Currituck mainland.
In 1986, the owner of the property in question received a CAMA Major Permit No. 14-86, in
conjunction with two adjoining properties to the south, to construct a bulkhead. There were
no bulkheads to the south at that time and a remnant bulkhead to the north. The maximum
waterward alignment allowed at the time was 10', with an average of ~'.

PROJECT DESCRIPTION
Proposed Bulkhead
The applicant is proposing to construct a 210' bulkhead that will tie into the corners of
existing bulkheads to the north and south of the property. If approved the bulkhead will be
constructed a maximum of 18', and an average of 14', waterward of NWL. An erosion
escarpment approximately 22' landward of NWL will be graded to lower the profile of the
property along the water. Mounded dirt spoil piles placed by a previous property owner
will be used to back fill the bulkhead along with sand and clay trucked in from a high
ground source. High ground disturbance will extend approximately 34' landward of the
erosion escarpment.

Proposed Pier and Platform
The applicant proposes to construct a 180' pier six feet wide with a 20'x 20' platform, for
a total length of 200' . Depths along the waterward end of the pier and platform are
approximately two feet below NWL. The pier will be aligned with an adjacent pier to the
south. Two mooring pilings will be placed on the north side of the platform to create one
mooring facility.

To Whom It May Concern:
I am purchasing Lot #1, Harrell Farms from Linda Old, formally Mrs. Joseph Kudyba.
The property has 210 feet on Tulls Bay which has no bulk head. Back in 1986 a permit
was obtained, #I4-86, to bulk head the Barnes/Olds/Kudyba properties which I have
included a copy. For what ever reason the Kudyba property was never bulk headed.
Over the years some erosion has taken place. I am applying for a major development
permit so I can a line my bulk head with Mr. Barnes on the right and Mr. Franklins bulk
head on the left. In the application I have included a number of drawings showing how
this is to take place. All of the fill will be coming from upland. Over the years some
debris has been dumped on the waters edge such as bricks and concrete. With the
alignment I as asking this will be on the inland side of the bulk head. Lynn Mathis with
CAMA has made a sight visit and advised me I needed the major development permit.
