John Leger Page 2 9. PROJECT DESCRIPTION: The project site is located at 106 Inlet Court, adjacent to the AIWW, in Hampstead, Pender County. To get to the site from Wilmington take US Hwy 17 N to Country Club Road (approximately 13.5 miles from the Wilmington Regional Office). Turn right onto Country Club Road and continue approximately 2, 18 miles before turning right onto S. Kings Landing Road. Continue along Kings Landing Road for approximately 1.0 mile and turn left onto Hideaway Shores. Follow Hideaway Shores until it ends and turn right onto Scotch Bonnett Way. Follow Scotch Bonnet Way until it ends and then turn left onto Inlet Court. The property will be located along the right at house number 106. The property consists of a 0.67-acre parcel that is situated on land that is approximately 0-32 feet above mean high water (MHW) and is vegetated primarily with lawn grasses. The property contains a residential dwelling and retaining wall. The shoreline (approximately 105' as measured along the Mean High Water line) is stabilized by natural vegetation (lower relief area) and a retaining wall (located along the upper elevation). Coastal wetland and 404-type wetlands transition exist along the water's edge. Smooth Cordgrass (Spartina alterniflora), along with Glasswort (Salicornia spp.) and Sea Lavender (Limonium carolinianum), span along the intertidal flat a distance of approximately 250' before reaching the open water area of the AIWW. The width of the waterbody in the vicinity of the project site, measures approximately 615'-620' from marsh to marsh. The waters of the AIWW are classified SA by the Division of Water Quality. The project area IS NOT designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries and is OPEN to the harvest of shellfish. PROPOSED PROJECT: The applicant proposes to construct a new private, three (3) slip docking facility along the AIWW, at 106 Inlet Court, Hampstead, Pender Co. Development activities would include the installation of a new 6' x 428' access pier, 20' x 20' "L-head" shaped fixed platform (covered), two-4' x 32' finger piers, a 15' x 15' boatlift and a new 8' x 20' floating dock. As designed, the access pier would originate along the uplands at the location of the existing retaining wall. From here, the pier would extend in an easterly direction, spanning a 250' wide swath of intertidal coastal wetlands, as well as a small navigable slough that runs parallel with the shoreline. The existing slough is located approximately 75' waterward of the existing retaining wall and measures approximately 12' in width. The slough is predominantly dry during periods of low water, but is accessible by kayak and other small craft during mid-level/full high tide. At this location, the applicant proposes to span the proposed pier so that the bottom of the walkway is approximately 6' above the normal high water line. The remainder of the pier would be located a minimum of 36" above the marsh substrate, as no other open water cuts, channels or sloughs are located between the high ground and outer edge of the marsh. John Leger Page 3 As proposed, the access pier would extend approximately 145' beyond the near shore edge of marsh grass, and would terminate into a 20' x 20' covered platform. Two, 4' x 32' fixed finger piers would originate from the terminal end of the access pier, and extend in a northerly direction. The two finger piers would be divided by a new 15' x 15' boatlift. Along the southern side of the proposed pier and platform, the applicant intends to install a small 4' x 4' landing that would provide access to a new 8' x 20' section of floating dock. The floating dock would be oriented perpendicular to the shoreline, and positioned so as to accommodate two (2) vessels. As designed, each component of the docking facility would be located at least 100' from the near shore edge of the marsh grass, in waters where the depths range from -3.0' to -3.8', at normal low water. According to the application package, the proposed pier, platform, boatlift, finger piers and floating dock would terminate inshore of the existing pier -head alignment, federal channel setback, and well within the limits based on the '/4 width limitation. It should be noted that Submerged Aquatic Vegetation (SAV) are prominent along this section of shoreline, and the site plan drawings have depicted several beds of SAV along the near shore edge of marsh. The described location of these SAV beds appears to coincide with 2020 satellite imagery (taken from Google Earth and Ponder Co. GIS). The 2020 imagery appears to show SAV extending from the shoreline a distance of approximately 50'-60'. As expected (due to being in the dormancy period and lack of growth), the Feb. 9, 2021, site visit did not reveal the presence of any SAV in the footprint of the proposed docking facility. Based on the work plan drawings, the applicant's proposal is located outside of the 15' riparian corridor setback of both adjoining property owners. As a result, the applicant did not require a waiver from neither neighbor for the proposed development. 10. ANTICIPATED IMPACTS The proposed three (3) slip docking facility would result in the incorporation of approximately 816 sq. ft. of estuarine and public trust area. Although no Submerged Aquatic Vegetation (SAV) was observed within the project area during the 2/9/21 site visit, conditions are favorable for existence and the NC Division of Marine Fisheries has designated a portion of this shoreline as SAV "habitat". Furthermore, the applicant has provided a site plan that shows areas of SAV inland of the proposed docking facility. Based on this information, it is staffs opinion that the proposed project area is void of any established beds of SAV. The proposed development would be located outside of the 15' riparian corridor setbacks on both sides, would be constructed within'/4 of the width of the waterbody and outside of the federal channel setback. Submitted by: Jason Dail Date: 2/22/21 Office: Wilmington Narrative As acting agent for John Leger, who owns 106 Inlet Ct., Hampstead, in Pender County, N.C, I am submitting the enclosed CA.MA Major Permit Application for a proposed private docking facility adjacent to the AIWW. Mr. Leger would like to construct a pier (6' x 428'), two elevated fixed finger piers (each @ 4' x 32') which will provide access to a boatlift (15' x 15'), an elevated fixed platform (20' x 20') which will be located at the terminus of the access pier and a floating dock (8' x 20). The access pier will have an elevated portion (min. 6' wide and 6' above normal high water) over the existing slough to allow kayak access. These structures are proposed to be located in existing water depths of approx. -3.5' @ NLW and would extend will not encroach into either of the adjacent 15' riparian corridor setbacks nor exceed the established pier head alignment. The DWR pre -filing meeting request has been filled out on the website and a copy of the return email resulting from that submittal is included in this CAMA Major Permit application. + The project proponent hereby certifies that all information contained herein is true, accurate, and complete to the best of my knowledge and belief. • The project proponent hereby requests that the certiing authority review and take action on this CWA 401 certification request within the applicable reasonable period of time. Dail, Jason From: Dail, Jason Sent: Monday, February 8, 2021 11:40 AM To: debbiew75 Subject: John Leger CAMA Major permit application, 106 Inlet Court, Hampstead - ADDITIONAL INFORMATION REQUESTED Good morning Debbie, Please see the below list of deficiencies regarding the subject application. RE: INCOMPLETE APPLICATION —John Leger —ADDITIONAL INFORMATION REQUIRED APPLICATION NUMBER —TBD PROJECT ADDRESS — 106 Inlet Court, Hampstead, NC The Division of Coastal Management's Wilmington Regional office received a CAMA Major Permit application from you on February 4, 2021, requesting approval for development activities at the subject address. In reviewing your application, we have discovered that additional information is needed to complete the review process. Accordingly, I am requesting that you submit the following additional information to this office: The submitted site plan drawing shows a riparian corridor (and corresponding 15' setback) for the property, which appears to have been determined, or referenced, using a pier -head alignment along the outer edge of the proposed pier/dock. Please revise the subject drawing to accurately depict the riparian corridor using the Federal Channel/Fed Channel Setback. As you are aware, the riparian line in this location should be determined by extending a line perpendicular to the edge of channel, back to where the property intersection the normal/mean high water line. Once a revised plan has been resubmitted, and a copy of the riparian property owner notification provided, processing of your application will resume. In accordance with the Department of Environment and Natural Resources regulations, we note the application, as submitted on February4, 2021, is incomplete for processing. Upon submission of the requested information, a local decision will be made within 150 days, provided this period is not extended as provided by law. Please contact me at 910-796-7221 if you have any questions. Due to the amount of deficiencies, your application package is being returned in its entirety.
