131 ❑ P ❑ T NA NA ❑ Yes s NA NA B2 ❑ P ❑ T ❑ Yes ❑ No 6h Total buffer impacts 61 Comments Page 6 of 11 PCN Form — Version 1 3 December 10 2008 Version D Impact Justification and Mitigation 1 Avoidance and Minimization 1a Specifically describe measures taken to avoid or minimize the proposed impacts in designing project BLC evaluated surface waters and wetlands present on the property early in the planning stage of the project to assist the applicant in avoiding impacts to surface waters wetlands and riparian buffers to the maximum extent practicable As a medium - density residential project streams and 50 to 100 foot wide riparian buffers have been avoided except for a road and aerial sanitary sewer crossing Two greenway boardwalks and the aerial sanitary sewer crossing were also use to avoid approximately 44 linear feet of jurisdictional stream impacts Three road /grading areas impact jurisdictional wetlands that extend linearly into upland areas These impacts are generally necessary to provide a uniform development edge appropriate for compact medium density construction and individually discussed below In addition to the 50 foot wide Jordan Riparian Buffer the project includes an additional 50 foot TOC buffer on streams located north of Morrisville Parkway for protection of the jurisdictional streams and their adjacent wetlands The project also proposes upland open space and perimeter buffers to adjacent properties Overall the project anticipates preservation of 27 acres of open space area (approximately 30% of the overall project site) approximately 5 326 linear feet of stream channel/ forested riparian buffer and approximately 0 25 acre of jurisdictional wetland Impact #1 is an unavoidable road crossing of an intermittent stream and its adjacent wetland that also impacts the head of a smaller intermittent stream channel The site layout is constrained by several natural and manmade features that limit the flexibility of the street network layout From the south there is an existing street stub for the Highcroft Drive alignment that dictates the perpendicular tie in of the proposed Highcroft Drive alignment headed north from the southern property line There is an existing Morrisville Parkway horizontal and vertical alignment that has been dictated by the Town s Engineering Department Highcroft Drive is a Major Collector Street subject to the TOC s strict policy on street alignment geometry and perpendicular intersections which forces creating a horizontal curve beginning after the queue length of automobiles headed south This pushes the roadway toward the confluence point of the two aforementioned channels The project engineer used as small of a curve as possible as well as retaining walls on either side to avoid the confluence and minimize the amount of stream channel impacted Impact #2 and #3 are combined road crossing and grading areas that impact jurisdictional wetlands Because of the severe topography on this site and maximum street grades required by the TOC it is necessary to grade heavily in these areas There is no practical alternative that will allow us to keep these two linear features and design a functional layout that would be practical from a utility service (gravity sewer) as well as a zoning (setbacks and driveway locations) perspective The areas containing Impacts #2 and #3 must be graded higher to serve the adjacent single family units with gravity sewer and to keep the street grades within the Town s required vertical constraints To keep these two features intact would render the surrounding upland area undevelopable Impact #4 is a grading area that impacts a jurisdictional wetland which is the result of a man made impoundment It is necessary to tie the site grading into the vertical grade established by Morrisville Parkway 1 b Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques To ensure hydrologic connection and maintain aquatic life passage the proposed culvert for Impact #1 has been sized to handle the anticipated storm flows and will be installed at natural grade A channel the same width as the natural channel will be created within the riprap dissipator below the proposed culvert to avoid the loss of 25 LF of stream channel The applicant will also follow Sedimentation & Erosion Control Plans approved by the Town of Cary s Engineering Department as part of the Plan Review process to help protect downstream water quality 2 Compensatory Mitigation for Impacts to Waters of the U S or Waters of the State 2a Does the project require Compensatory Mitigation for ® Yes ❑ No impacts to Waters of the U S or Waters of the State?
