Dear Mr. Sampson: The Non -Discharge Permitting Unit is returning the enclosed application for Permit Name/Ownership Change due to the following required items that were omitted from this submittal: 1. Legal documentation of the transfer of ownership (such as a contract, deed, article of incorporation, etc.) for ownership changes. The documentation must state what is being transferred (a legal description), and the name of the (purchasing). party on the document must either be the same as the new owner's name on the Permit Name/Ownership Change Form, or documented (legal) evidence of a corporate relationship between the purchasing party and the new owner must be submitted. 2. The Division of Water Quality cannot issue a permit to an entity that is not registered with the North Carolina Secretary of State's Office. The only exception to this policy is in situations where legal documentation of a corporate relationship is received which establishes a relationship between the new permittee and the registered entity. Director Division of Water Quality April 18, 2005 Mr. Dean Sampson Cn Greenleaf Products Company 1566 High Point Church Road Pageland, SC 29728 Subject: Ownership Change Non -Discharge Permit WQ0019567 j = ` P & L Bark, Inc. � 'l rl Dear Mr. Sampson: The Aquifer Protection Section is in receipt of your Permit Name/Ownership Change Form of March 1, 2005 informing us of the sale of the permitted system by P & L Bark to the Greenleaf Products Company. In order for us to change the name on the Non -Discharge Permit for this facility, we must receive legal documentation of the transfer of ownership (such as a contract, deed, article of incorporation, etc.) for ownership changes. The documentation must state what is being transferred (a legal description), and the name of the (purchasing) party on the document must either be the same as the new owner's name on the Permit Name/Ownership Change Form, or documented (legal) evidence of a corporate relationship between the purchasing party and the new owner must be submitted. We have been unable to find registration of Greenleaf Products with the North Carolina Secretary of State's Office, and cannot issue a permit to an entity that is not registered. The only exception to this policy is situations where legal documentation of a corporate relationship is received which establishes a relationship between the new permittee (in this case Greenleaf Products) and a registered entity (Old Castle Retail, Inc., which is, in fact registered with the Secretary of State's Office). We are returning your application form (enclosed herewith) and will issue a new permit upon receipt of the form accompanied by these required items.
