They have added the new pump station and the line length. I sent them an ORC change/add form. Mr. Ketner is not listed in BIMS as the back-up ORC, although I have been told before that he is. Maybe they will submit the forms to TACU. They should not need any special schedules in the permit. I have some questions for Salisbury, since I did the first application some of the numbers have changed. This permit shall be effective from the date of issuance until rescinded, and shall be subject to the conditions and limitations as specified therein. This cover letter shall be considered a part of this permit and is therefore incorporated therein by reference. Please pay particular attention to Permit Condition 3 which requires that the wastewater collection facilities be properly operated and maintained in accordance with 15A NCAC 2T .0403 or any individual system -wide collection system permit issued to the Permittee. Mayor Don Bringle told aldermen Tuesday night that he had learned that China Grove has been cut out of the project. Matt Bernhardt, assistant city manager for utilities of Salisbury -Rowan Utilities, said Thursday the China Grove section was never part of the plan agreed on by the Rowan County Board of Commissioners and the city of Salisbury. "We're doing exactly what the project called for — 33,000 linear feet of gravity sewer line," said Bernhardt. The project will provide sewer service to four I-85 interchanges including Julian Road, Peeler Road, Peach Orchard and Webb. Bernhardt said the connection to the China Grove system was envisioned when Salisbury -Rowan Utilities and China Grove were looking at merging the utility systems. The overall project ran into multiple complications due to federal and state regulations dealing with wetlands, causing a delay of a year or more. Current plans call for putting the project to bid in the spring, with construction starting in early summer. Bernhardt said he plans to meet with China Grove officials and hopes to come up with a plan to achieve a connection to their system. After two years of discussions, county commissioners approved agreements in March 2006 to share the cost of the project, estimated to be $6 million. The county insisted that major changes or cost overruns would come back to the board for approval. County officials contacted Wednesday said they had recently learned of the changes in the project. Arnold Chamberlain, chairman of the Board of Commissioners, said the county wasn't consulted about the change. The latest price tag on the cut -back project is $6.5 million. Bringle told the Board of Aldermen Tuesday night that Bernhardt had been asked to attend the meeting and discuss the status of the sewer line. Wednesday, Sep 08, 2004 - 11:49.45 am 1=DT China Grove will study merging water -sewer with Salisbury By Jessie Burchette, Salisbury Post CHINA GROVE -- Aldermen have unanimously approved a feasibility study about merging the town's water and sewer system with Salisbury. The study is expected to take about three months, and if China Grove and Salisbury boards agree, China Grove's water and sewer systems could be transferred to the Salisbury -Rowan Utilities Department by July 1, 2005. Town officials said they are not proposing to give the system to Salisbury. During a presentation of the study and the current operations, officials repeatedly referred to "transferring" the system to Salisbury if a deal can be struck. Town Manager Eric Davis said the town can not continue on the current path. He said China Grove serves as a middle man, paying Salisbury almost $1 million in the coming year for water and sewer treatment. Combined with the debt payments on the $5 million in loans to upgrade water and sewer lines and operation costs, Davis said sewer and water currently makes up 75 percent of the town's $4 million budget. Davis emphasized that the transfer of the utility system to Salisbury is not a done deal. ti??,qT-D-00,_- -- -' "China Grove can not continue business as usual," said Davis, saying the town owes it "K to its customers to explore the opportunity. (9) Any trucked or hauled pollutants, except at discharge points designated by the Town's Director or POTW Director in accordance with Section 2.9 of this ordinance. (10) Any noxious or malodorous liquids, gases, or solids or other wastewater which, either singly or by interaction with other wastes, are sufficient to create a public nuisance or hazard to life or are sufficient to prevent entry into the sewers for maintenance and repair. (11) Any substance which may cause the POTW's effluent or any other product of the POTW such as residues, sludges, or scums, to be unsuitable for reclamation and reuse or to interfere with the reclamation process. In no case, shall a substance discharged to the POTW cause the POTW to be in noncompliance with sludge use or disposal regulations or permits issued under Section 405 of the Act; the Solid Waste Disposal Act, the Clean Air Act, the Toxic Substances Control Act, or State criteria applicable to the sludge management method being used. (12) Any wastewater containing any radioactive wastes or isotopes except as specifically approved by the POTW Director in compliance with applicable State or Federal regulations. Town of China Grove Sewer Use Ordinance Page 14 Dated: May 14, 2003 When requested by the person furnishing a report, the portions of a report which might disclose trade secrets or secret processes shall not be made available for inspection by the public, but shall be made available upon written request to governmental agencies for uses related to this ordinance, the National Pollutant Discharge Elimination System (NPDES) Permit, Non - discharge permit and/or the pretreatment programs; provided, however, that such portions of a report shall be available for use by the State or any state agency in judicial review or enforcement proceedings involving the person furnishing the report. Wastewater constituents and characteristics will not be recognized as confidential information. All records relating to compliance with Pretreatment Standards shall be made available to officials of the approval authority and EPA upon request. SECTION 8 -ENFORCEMENT 8.1 Administrative Remedies (a) Notification Of Violation Whenever the Director finds that any industrial user has violated or is violating this Ordinance, wastewater permit, or any prohibition, limitation or requirements contained therein or any other pretreatment requirement the Director may serve upon such a person a written notice stating the nature of the violation. Within 30 days from the date of this notice, an explanation for the violation and a plan for the satisfactory correction thereof shall be submitted to the Town by the user. Submission of this plan does not relieve the discharger of liability for any violations occurring before or after receipt of the notice of violation. (b) Consent Orders The Director is hereby empowered to enter into consent orders, assurances of voluntary compliance, or other similar documents establishing an agreement with the person responsible for the noncompliance. Such orders will include specific action to be taken by the discharger to correct the noncompliance within a time period also specified by the order. Consent orders shall have the same force and effect as an administrative order issued pursuant to Section 8.1(d), below. Town of China Grove Sewer Use Ordinance Page 41 Dated: May 14, 2003 (c) Show Cause Hearing The Director may order any industrial user who causes or is responsible for an unauthorized discharge, has violated this ordinance or is in noncompliance with a wastewater discharge permit to show cause why a proposed enforcement action should not be taken. In the event the Director determines that a show cause order should be issued, a notice shall be served on the user specifying the time and place for the hearing, the proposed enforcement action, the reasons for such action, and a request that the user show cause why this proposed enforcement action should not be taken. The notice of the hearing shall be served personally or by registered or certified mail (return receipt requested) at least ten (10) days before the hearing. Service may be made on any agent or officer of a corporation. The Director shall review the evidence presented at the hearing and determine whether the proposed enforcement action is appropriate. A show cause hearing under this section is not a prerequisite to the assessment of a civil penalty under Section 8.2 nor is any action or inaction taken by the Director under this section subject to an administrative appeal under Section 4.2(h). (d) Administrative Orders When the Director finds that an industrial user has violated or continues to violate this ordinance, permits or orders issued hereunder, or any other pretreatment requirement the Director may issue an order to cease and desist all such violations and direct those persons in noncompliance to do any of the following: (1) Immediately comply with all requirements; (2) Comply in accordance with a compliance time schedule set forth in the order; (3) Take appropriate remedial or preventive action in the event of a continuing or threatened violation; (4) Disconnect unless adequate treatment facilities, devices or other related appurtenances are installed and properly operated within a specified time period. Town of China Grove Sewer Use Ordinance Page 42 Dated: May 14, 2003 (e) Emergency Suspensions The Director may suspend the wastewater treatment service and/or wastewater permit when such suspension is necessary in order to stop an actual or threatened discharge which presents or may present an imminent or substantial endangerment to the health or welfare of persons or the environment, interferes with the or causes the Town to violate any condition of its NPDES or Non -discharge permit. Any user notified of a suspension of the wastewater treatment service and/or the wastewater permit shall immediately stop or eliminate the contribution. A hearing will be held within 15 days of the notice of suspension to determine whether the suspension may be lifted or the user's waste discharge permit terminated. In the event of a failure to comply voluntarily with the suspension order, the Director shall take such steps as deemed necessary including immediate severance of the sewer connection, to prevent or minimize damage to the wastewater system or endangerment to any individuals. The Director shall reinstate the wastewater permit and the wastewater treatment service upon proof of the elimination of the noncompliant discharge. The industrial user shall submit a detailed written statement describing the causes of the harmful contribution and the measures taken to prevent any future occurrence to the Director prior to the date of the above - described hearing. (f) Termination Of Permit Any user who violates the following conditions of this ordinance, or applicable State and Federal regulations, is subject to having its permit terminated: (1) Failure to accurately report the wastewater constituents and characteristics of his discharge; (2) Failure to report significant changes in operations, or wastewater constituents and characteristics; (3) Refusal of reasonable access to the user's premises for the purpose of inspection or monitoring; or, (4) Violation of conditions of the permit. Noncompliant industrial users will be notified of the proposed termination of their wastewater permit and will be offered an opportunity to show cause under Section 8.1 of this ordinance why the proposed action should not be taken. 8.2 Civil Penalties Town of China Grove Sewer Use Ordinance Page 43 Dated: May 14, 2003 (a) Any user who is found to have failed to comply with any provision of this ordinance, or the orders, rules, regulations and permits issued hereunder, may be fined up to ten thousand dollars ($10,000) per day per violation. (b) Any user who is found to have conducted malicious damage to the public sewer system, treatment works, and/or all appurtenances shall be subject to punitive acton and penalties. (c) In determining the amount of the civil penalty, the Director shall consider the following: (i) The degree and extent of the harm to the natural resources, to the public health, or to public or private property resulting from the violation; (ii) The duration and gravity of the violation; (iii) The effect on ground or surface water quantity or quality or on air quality; (iv) The cost of rectifying the damage; (v) The amount of money saved by noncompliance; (vi) Whether the violation was committed willfully or intentionally; (vii) The prior record of the violator in complying or failing to comply with the pretreatment program; (viii) The costs of enforcement to the Town. (d) Actions for any unpaid civil penalties shall be referred to the Town Attorney for collection. (e) Appeals of civil penalties assessed in accordance with this section shall be as provided in Section 4.2(h). 8.3 Other Available Remedies Remedies, in addition to those previously mentioned in this ordinance, are available to the Director who may use any single one or combination against a noncompliant user. Additional available remedies include, but are not limited to: (a) Criminal Violations. The District Attorney for the 278 Judicial District may, at the request of the Town prosecute noncompliant users who violate the provisions of N.C.G.S. 143-215.613. Town of China Grove Sewer Use Ordinance Page 44 Dated: May 14, 2003 (b) Injunctive Relief Whenever a user is in violation of the provisions of this ordinance or an order or permit issued hereunder, the Director, through the Town Attorney, may petition the Superior Court of Justice for the issuance of a restraining order or a preliminary and permanent injunction which restrains or compels the activities in question. (c) Water Supply Severance Whenever an industrial user is in violation of the provisions of this ordinance or an order or permit issued hereunder, water service to the industrial user may be severed and service will only recommence, at the user's expense, after it has satisfactorily demonstrated ability to comply. (d) Public Nuisances Any violation of the prohibitions or effluent limitations of this ordinance or of a permit or order issued hereunder, is hereby declared a public nuisance and shall be corrected or abated as directed by the Director. Any person(s) creating a public nuisance shall be subject to the provisions of the Town Code governing such nuisances, including reimbursing the Town for any costs incurred in removing, abating or remedying said nuisance. 8.4 Remedies Nonexclusive The remedies provided for in this ordinance are not exclusive. The Director may take any, all, or any combination of these actions against a noncompliant user. Enforcement of pretreatment violations will generally be in accordance with the Town's enforcement response plan. However, the Director may take other action against any user when the circumstances warrant. Further, the Director is empowered to take more than one enforcement action against any noncompliant user. SECTION 9 - ANNUAL PUBLICATION OF SIGNIFICANT NONCOMPLIANCE At least annually, the Director shall publish in the largest daily newspaper circulated in the service area, a list of those industrial users who were found to be in significant noncompliance, also referred to as reportable noncompliance in 15A NCAC 2H .0903(b)(10), with applicable pretreatment standards and requirements , during the previous 12 months. The board also started the process to voluntarily annex the 177 acres owned by China Grove Properties LLC. The subdivision is believed to be the largest such project in the town's history. The Board of Aldermen conducted a rezoning and conditional use hearing Tuesday night. The property is currently within the town zoning jurisdiction, but outside the town limits. Town officials and the public struggled with the unfamiliar rules of the quasi- judicial hearing, the first the town has conducted in years. Several speakers had questions about different aspects of the project, including traffic flow and access roads. But there was no opposition. Charles E. Canrobert of Colson Park Construction in Hickory outlined plans for the project. He emphasized that the developers will work with the town and the N.C. Department of Transportation to ease the flow of traffic. "We can't sell houses if people can't get to work and get home," said Canrobert. Information contained in the application identifies China Grove Properties as being located at the same Hickory address as Colson Park Construction. Erin Burris, a planner with Benchmark, said developers will be limited to building 100 homes per year. The lot sizes range from 8,500 square feet to 20,000 square feet. Homes will be sold in three price ranges going from $110,000 to $350,000. Developers are offering to give the town several acres in a flood plain for possible recreational use. Much of the area was zoned industrial, requiring it to be rezoned to residential. Benchmark sent out letters to all neighboring property owners. That resulted in some confusion. Some property owners thought their property was being rezoned. Others were surprised to find out their homes are in an industrial zone. And a scheduled presentation by the consulting firm doing the feasibility study on the transfer of the system was taken off the agenda. Treme proposed a 25 percent surcharge on water and sewer rates that would decline 5 percent each year over a five-year period. At that point, all customers in the merged system would pay the same rate. Even with the surcharge, Treme wrote, the town's customers would still save more than $3.4 million over the five years. In his letter, Treme cited changes in data for sewer and water use from 2004 to 2005. Treme wrote that based on preliminary information from Raftelis Consulting, Salisbury could have merged the system without any additional charge. The data for early 2005, when sewer and water use declined, altered the analysis. Misenheimer said Wednesday that with property bought earlier and some other land under contract, the final parcel will be 110 to 115 acres. It will have entrances on N.C. 152 and Lentz Road. The George Stirewalt family sold two of the latest tracts, each at just over 41 acres, for the project. George Stirewalt, who just turned 65, said they had farmed the land since 1949 and bought it for themselves in 1981. "I didn't want to sell it," he said. "I cried when I sold it. . I was there in 1950 or 1951 when they built the lake." And he said even though Lyerly has been involved in construction his entire life, bigger builders may be the ones who actually put up the single-family homes. He said that while individual contractors may do two or three houses a year, bigger outfits could build 10 to 15 houses a year and fill a development like this one faster. He's been dealing with a design company in Charlotte to work out a final plan. They've even discussed options like patio homes for a portion of the property, but he said those may not be in the final plans. Tuesday night, the China Grove Board of Aldermen unanimously approved rezoning the property owned by Gary Propst and China Grove Properties from light industrial to highway business. Richard Flowe, a planner -designer with In Focus Design Group, presented a design named "Cold Water Crossing" — named for the stream on the eastern edge of the county. "This project is bigger than China Grove," Flowe said. "It's a landmark project for southern Rowan. This is the first southbound interchange for the Research Campus." To overcome the lack of access to I-85, the project designates land to be given to the N.C. Department of Transportation to add a southbound exit ramp. Flowe told aldermen that by giving the land to the state and recruiting retail that will bring jobs, the state may be persuaded to go ahead and build the ramp before I-85 is widened to eight lanes. "Sometimes you have to give to get," Flowe said, noting that China Grove Properties also owns land on the east side of I-85, which at this point remains zoned light industrial. Propst and China Grove Properties apparently are marketing the project to various developers. "If we can land the right buyer ... we can benefit the town, the whole southern area," Flowe said. At another point, Flowe indicated they are in discussions with potential buyers. The current design has 11 lots ranging from 1.1 acre to 8.5 acres. The design allows for an anchor tenant, restaurants and a hotel as well as other businesses. In addition to providing an area for the I-85 ramp, the design sets aside a buffer along Cold Water Creek. Traffic figures show that nearly 100,000 cars pass by the site daily on I-85, U.S. 29 and N.C. 152. The site has high visibility from I-85, but also has water issues including the creek, a pond and possibly other water sources. Flowe said the project is designed to deal with the wetlands issues. Alderman questioned whether the development would have direct access from U.S. 29. The north and south bound U.S. 29 access road to I-85 forms the western border of the tract. Flowe said there is no plan to have an access from that road because of potential traffic issues. Propst, who was in the audience, did not speak during a public hearing. Officials praised the project with Alderman Harold Simpson saying it offers great improvement for the town. Flowe said they will submit detailed plans to the town in the coming months. Town Manager Eric Davis presented projections to the China Grove Board of Aldermen during its retreat Thursday night. Davis called the potential growth scary, while saying the town must plan now and prepare to handle the growth. The number of houses in the town limits would grow from 1,600 to more than 2,600, a nearly two-thirds increase. On the plus side, the increase in property value, sales tax and collection of subdivision lot fees should greatly improve the town's financial picture. Davis told the aldermen that while the town has spent years digging out of a hole, it is now in a position to take on some major projects. If the projections for the five planned residential subdivisions come close to forecasts, the town's revenues could increase by almost $2 million. While the population growth will bring greater demand for services, the town could still be in a very healthy fmancial situation. Davis said the projections are a bit like looking in a crystal ball or reading smoke signals. The projections involve five subdivisions, which developers have purchased land for and are in the process of moving the projects forward. Thanks to action by the Rowan County Board of Commissioners Monday night, Jesse Carson High School will be connected to a new sewer line by'November. Commissioners approved spending an additional $524,000 to cover the project shortfall, but made clear they want the Rowan -Salisbury Board of Education to pick up its part of the cost overrun. Under an agreement reached in 2004, the county, the school board and the town of China Grove were set to share equally in the cost. The initial cost estimate was $1.4 million, with each paying $454,000. The cost is now $2.4 million. Town Manager Eric Davis explained how the process has evolved, including a major change in the design. Initially the sewer line, which will serve a large area of the Interstate 85 corridor, involved pumping the sewage across town into the existing Grants Creek connector, then to Salisbury. With Salisbury's Grants Creek station nearing capacity, and a plan to put a new sewer line down Town Creek, the project was redesigned to eventually pump to the Town Creek treatment plant. In three years, the project cost increased almost $1.2 million. Davis said much of that was related to the dramatic increase in oil prices affecting PVC and ductile iron costs. The total budget project now stands at $2.4 million. Commissioner Steve Blount noted that recent school projects have increased by 40 to 50 percent. "This is almost a 100 percent increase in three years. It's a little confusing that its doubled," Blount said. Blount offered a motion that the county will pledge the entire $524,000, but will negotiate with the school board to get them to make up their share of the overrun, $192,000. The motion passed 3-to-1 with Sides against. Sides said he was not aware that the board planned to vote on the matter Monday. Davis assured commissioners that sewer service will be available for the school when it opens, using temporary tanks that will be pumped and hauled. Observing the increase in the project costs, Chamberlain urged the board to go forward immediately with the Town Creek sewer line, a joint project between the county and the city of Salisbury. At the outset of the discussions on the China Grove sewer project, the board voted to excuse Commissioner Frank Tadlock from discussions or voting.
