Subject: APPROVAL OF STORMWATER MANAGEMENT PLAN
Hilburn Drive Duplex Lots
Dear Mr. Moye:
The Division of Water Resources (Division) recently reviewed the proposed stormwater management plan
(SMP) for the subject project as required by Individual 401 Water Quality Certification issued by the
Division on March 31, 2020. Submittal of the SMP satisfies the stormwater condition no. 4 of the 401
certification since the City of Raleigh does not require this SMP to be approved under their local program.
The Division approves the SMP for Hilburn Drive Duplex Lots consisting of a Bioretention Cell including
all associated inlet and outlet structures depicted on plan sheets dated February 9, 2021, which are
incorporated by reference and are enforceable by the Division. The following conditions also apply [15A
NCAC 02H .0506(b)(5)]:
a) Piping and grading plan that routes stormwater from the proposed impervious surfaces on
Lot #2 to the Bio cell must be submitted and approved by the Division prior to construction.
b) The maximum allowable drainage area for the approved Bio cell shall be 32,224 square feet and
the maximum allowable built -upon area within that drainage area shall be 3,264 square feet
(specifically from Lot 92). Any changes to these allowable maximum areas shall require the
applicant to submit and receive approval from the Division prior to any construction or
modification of the current site.
c) Plats for residential lots that contain SCMs shall include: the specific location of the SCM on the
lot; a typical detail for SCM to be used; and a note that the SCM on the property has been required
to meet stormwater regulations and that the property owner may be subject to enforcement
procedures as set forth in G.S. 143, Article 21 if the SCM is removed, relocated, or altered without
prior approval.

d) The approved SMP shall be constructed and operational before any permanent building or other
structure is occupied at the site.
e) The SMP may not be modified without prior written authorization from the Division.
f) Maintenance activities for stormwater management device(s) shall be performed in accordance
with the notarized O&M agreements signed by you (Howard Moye of Marlowe and Moye, LLC)
on December 30, 2020. The O&M agreement shall transfer with the sale of the land or transfer of
ownership/responsibility for the approved SMP. The Division shall be notified promptly of every
transfer.
g) The O&M Agreement shall be referenced on the final plat and shall be recorded with the county
Register of Deeds upon final plat approval. If no subdivision plat is recorded for the site, then the
O&M Agreement shall be recorded with the county Register of Deeds so as to appear in the chain
of title of all subsequent purchasers.
h) Upon completion of construction and prior to operation of the approved stormwater control
device(s), a certification from an appropriate designer for the device certifying that it has been
installed in accordance with the approved plans, specifications, and other supporting
documentation (including construction photos, if available), shall be submitted to the Division (C/O
