That item on the form is poorly worded.

Basically, .1003(4)(c-d) refers to BUA that is allowed, by exemption, to be located streamside of a vegetated setback and
this item refers to BUA that does not meet the exemption listed within .1003(4)(c-d) being located streamside (“out”) of
the vegetated setback.

If the project is placing non-exempt BUA streamside of a vegetated setback, this item should be “Yes”, otherwise, it
should be “No”.

We received your stormwater comments for NCNG Morganton Phase II. I did have one question about comment 4.a.iii.
All of the BUA on this project is outside of the vegetated stream buffer, so would it be “yes” for this project? We are
