SUBJECT: Modification — CAMA Major Permit #47 -09, NC Div. Parks and Recreation -Jones Island
Please find attached a request from Lexia Weaver, with NCCF, to modify State Permit #47 -09. The original
permit was issued to NC Division of Parks and Recreation for the construction of wetland protection sills and a
pier on Jones Island, adjacent the Town of Swansboro and located on the White Oak River. The permittee
wishes to modify the permit by adding a 150' long oyster —bag sill on the south tip of the island, a maximum of
30' waterward of NHW for the purpose of promoting coastal wetland growth as well as planting coastal
wetlands landward of the proposed sill. The sill would be 6' in width and approximately 18" in height. The sill
would also have a 6' break in the center of the structure to allow for increased water flow and fish passage.
This portion of the Jones Island Oyster Sill Project would be located adjacent property owned by Mr. Joe Singh
Rodriguez. State Permit #47 -09 would need to be modified to reflect Mr. Rodriguez as a permittee
(authorization document attached). The bottom habitat is fine sand and no SAVs or shellfish resources were
present at the times of numerous site visits. A check in the amount of $100.00 was submitted for processing.
The proposal appears to be consistent with the use standards found in 15A NCAC 07H .0208, contingent upon
all general and specific conditions placed on the original permit. The following condition shall apply:
1) On shorelines where no fill is proposed, the landward edge of the sill shall be positioned no more than 5 feet
waterward of the waterward depth contour of locally growing wetlands or to mid -tide depth contour, whichever
is greater. Where no wetlands exist, in no case shall the landward edge on of the sill be positioned greater than
30 feet waterward of the mean high water or normal high water line.
2) The height of sills shall not exceed six inches above mean high water, normal water level, or the height of the
adjacent wetland substrate, whichever is greater.
3) The sills shall have at least one five -foot drop -down or opening every 100 feet and may be staggered or
overlapped or left open as long as the five -foot drop -down or separation between sections is maintained.
Overlapping sections shall not overlap more than 10 feet. Deviation from these drop -down requirements shall

be allowable following coordination with the N.C. Division of Marine Fisheries and the National Marine
Fisheries Service.
4) The riprap structure shall not exceed a slope of a one foot rise over a two foot horizontal distance and a
minimum slope of a one and a half foot rise over a one foot horizontal distance. The width of the structure on
the bottom shall be no wider than 15 feet.
5) The permittee shall not claim title to any lands raised above the mean high or normal water levels as a result
of filling or accretion.
6) All structures shall have a minimum setback distance of 15 feet between any parts of the structure and the
adjacent property owner's riparian access corridor, unless either a signed waiver statement is obtained from the
adjacent property owner or the portion of the structure within 15 feet of the adjacent riparian access corridor is
located no more than 25 feet from the mean high or normal water level. The riparian access corridor line is
determined by drawing a line parallel to the channel, then drawing a line perpendicular to the channel line that
intersects with the shore at the point where the upland property line meets the water's edge.
7) Sills shall be marked at 50 -foot intervals with yellow reflectors extending at least three feet above mean high
water level.
8) Backfilling of sill structures may be utilized only for the purpose of creating a suitable substrate for the
establishment or reestablishment of wetlands. Only clean sand fill material may be utilized.

General Permit for a 150 linear ft. oyster shell bag sill at Jones Island
Construction scheduled to begin June 2012
The 150 linear ft. oyster shell bag sill will run parallel to the southern shoreline of Jones Island,
no more than 30 ft. from NHW (Figure 1). A 6 ft. gap will be created in the middle of the sill to
allow fish passage and water circulation. The sill will consist of three layers high of oyster shell
bags. Each oyster shell bag is approximately 2 ft. long, 6 in. wide and 6 in. high. Oyster shell
bags will be placed perpendicular to the shoreline, three bags end to end (Figures 2 -3).

Mr. Joe Singh Rodriguez hereby authorizes the North Carolina Coastal Federation, 3609
Highway 24 (Ocean), Newport, NC 28570 to act as his authorized agent for the following limited
purposes:
1. Applying for the required CAMA permits for the construction of oyster shell bag sills,
marsh grass plantings and marine deb�:s removal on or directly offshore of property
owned by Mr. Rodriguez, located at Jones Island in the White Oak River, NC and
identified by heed Book 2464, page 53 in t11C 011s10 w C oua by Register of Leeds.
2. The aforementioned organization has my permission for the limited purpose of
applying for and signing all CAMA Major Development Permit application forms
necessary to accomplish the actions described in Paragraph 1 above..
3. The North Carolina Coastal Federation shall not act as my agent for any purpose other
than as set forth above.
4. This au#iprization shall expire on completion of the above described actions, or
344 9 days after the below date, whichever occurs first.
