Dear Mr. Turner:
On January 4, 2021, staff of the NC Division of Water Resources (DWR), Water Quality
Regional Operations Section (WQROS), were notified of high freeboard levels at your facility.
As a result of this incident, you are hereby notified that, having been permitted to have a non -
discharge permit for the subject animal waste disposal system pursuant to 15A NCAC 2T
Section .1300, you have been found to have insufficient freeboard in accordance with your
Certified Animal Waste Management Plan and the Swine Waste System General Permit No.
AWG100000 that you are covered to operate under.
Violation 1:
Failure to maintain waste level in your lagoon/storage pond in accordance with the facility's
Certified Animal Waste Management Plan in accordance with Condition V. 2. of Swine Waste
System General Permit No. AWG100000.
On January 4, 2021, a lagoon/storage pond level was documented at 25 inches in lagoon 2. A
level of 27 inches is the maximum level allowed by your permit and Certified Animal Waste
Management Plan.

On June 2, 2020, staff of the NC Division of Water Resources (DWR), Water Quality Regional

level of 19.5 and 27 inches in the lagoons is the maximum level allowed by your permit and
Certified Animal Waste Management Plan.

Subject Issue, Out of Compliance
In the month of March 2020, we had 2.95 inches of rain. Levels were good.
In the month of April 2020, rainfall was 4.3 inches and it rained often. Harder to
Pump.
in the month of May 2020, rainfall was 14.9 inches. Land was saturated, couldn't
Pump.
The first half of June we have already had 5.6 Inches of rain. From January 2020,
To the middle of June 2020, we have received 38.55 inches of rain. See attachment.
We are steadily pumping as conditions allow. If there are no major events, we will be
back in compliance as soon as possible.
