As stated in our letter dated May 24 2012 we have revised the Preconstruction
Notification Form for the subject project On behalf of the City of Conover and Catawba
County, we are submitting that revised document as an enclosure with this letter Also included
in that enclosure are the associated plan sheets for each individual crossing an overall project
map with indices of each stream crossing and detail sheets for use in stream restoration
The revisions to the proposed stream crossings modifies their impacts so that only four
(4) of the crossings will have a permanent impact and the overall length of permanent impact
will be a maximum of 130 linear feet These revisions to the stream crossings will also be
reflected in the record drawings submitted to the Division of Water Quality

On May 9, 2012, staff from the Mooresville Regional Office (MRO) conducted an investigation at the
subject site This letter is being issued as a Notice of Violation for the impacts observed at the site and for the
failure to comply with your State General Construction Stormwater Permit that was issued along with the
approval for the sediment and erosion control plan
401 Water Quality Certification, General Certification #3699
• Violation Failure to properly delineate the streams and obtain a Nationwide Permit #12 for four (4)
stream crossings within the construction corridor
• Violation Failure to comply with the construction stormwater permit (condition #4)
• Violation Failure to bury the nprap so that the natural stream elevation and dimension is maintained
(condition #9)
• Violation Failure to maintain a 10 ft buffer along top of stream bank and the construction corridor
(condition #12)
• Corrective Action Submit a PCN showing all stream crossings and the sewer alignment relative to
the stream
As discussed at the site, if nprap is not required to protect the sewer line, then soft stream
stabilization methods should be used (sloping banks coin fiber mattmg, and seedmg) If nprap is to
be used it should be shown as a permanent impact in the PCN The nprap that was in place at the
time of the site visit shall remain, with the exception of the di r pad located at the second
culvert which shall be shortened as discussed

• Violation Failure to keep a record of the inspection of the sediment and erosion control measures
• Corrective Action Install a ram gauge at the site If necessary install as many as required to
properly document ram events along the construction corridor Begin maintaining a record of ram
events and the inspection of the sediment and erosion control measures These must be recorded and
maintained and available for review by the state upon request
Tins Office requires that the violations as stated above, be abated immediately It is requested that a
written response be submitted by May 30, 2012 indicating the actions taking to resolve the violations and a
tnmehne for submitting the PCN Please note, these violations and any future violations may be subject to civil
