Queen Street Kinston, NC 28501 Subject Property: Cutter Creek Subdivision Neuse River Basin PROJECT REVIEW IN TEMPORARY ABEYANCE Dear Mr. Keefe: On March 22, 2012, the Division of Water Quality (DWQ) received your application dated March 14th to impact an additional 0.35 acres of Zone 1 on the subject property. DWQ has concerns regarding the available buffer mitigation on the Mussel Run restoration site. Recent site visits to the restoration site have raised concerns regarding the success of the stream restoration and therefore the riparian buffer credits available. The DWQ will require additional information in order to process your application. Therefore, unless we receive the additional information requested below, we will have to move toward return of your application as required by 15A NCAC 2H .0506 and 15A NCAC 2B.0233. This project will be placed "on hold" as incomplete until we receive this additional information. Please provide the following information so that we may continue to review your project. It is necessary to coordinate with the USACE and DWQ regarding evaluation of the mitigation site proposed to be utilized for additional buffer impacts. Until the success of the stream restoration is determined, DWQ cannot process any application to increase impacts utilizing this site as mitigation. Please respond within 30 days of the date of this letter by contacting me in writing at the DWQ Washington Regional Office. This may be accomplished by email. This letter only addresses the application review and does not authorize any impacts to wetlands, waters or protected buffers. Please be aware that any impacts requested within your application are not authorized (at this time) by the DWQ.
