Please review this draft carefully to ensure thorough understanding of the requirements and conditions it contains. There are several changes from the existing permit, including the following: • Per the results of instream waste concentration(IWC)-based calculations for ammonia- nitrogen,ammonia nitrogen limits have been revised[See A.(1.)]. • Based on the reasonable potential analysis (RPA) showing no reasonable potential to violate state water quality standards, the monitoring requirements for copper and zinc have been removed from the permit [See A.(1)]. • The Division is implementing dissolved metals standards in all permits,per the 2016 revisions to State water quality standards. As such,the NPDES Permitting Unit will need site-specific effluent hardness data and instream hardness data,upstream of the discharge,for each facility monitoring these metals in order to calculate permit limitations. Effluent hardness and instream hardness sampling,upstream of the discharge,have been added to the permit at a monitoring frequency of quarterly[See A.(1.)]. • As instream sampling requirements have been moved to Section A.(1.), Special Condition A.(2.)Instream Monitoring Requirements has been removed from the permit. • Some of the wording has changed in Special Condition A. (5.), Acute Toxicity Permit Limit,please review each paragraph carefully. • Special Condition A. (6.) has been modified to include the specific three years in which the Effluent Pollutant Scan shall be performed(2022, 2023, and 2024). In addition, at the end of the Special Condition, 2nd species Toxicity Testing Requirements for municipal permit renewals per Federal Regulations [40 CFR 122.21(j)(5)] have been added. • A notation was made concerning the Electronic Reporting Rule — NPDES Electronic 11 Reporting Rule — Phase 2 Extension. EPA extended the Phase 2 deadline to December 21, 2025. Sample Location:E-Effluent,I-Influent,U-Upstream at Grimesland Bridge,D-Downstream at NC Highway 17.Stream samples shall be collected three times per week during the months of June,July,August,and September and weekly during the remainder of the year.Instream monitoring requirements are waived as long as the Permittee maintains membership in the Tar-Pamlico Basin Association.If the Permittee ceases membership,then all instream monitoring requirements specified in this permit are immediately reinstated. 3. The monthly average effluent BOD5 and TSS concentrations shall not exceed 15%of the respective influent value (85%removal). 4. 2/Week sampling must occur on any two non-consecutive days during the calendar week. 5. TN or TP Load is the mass quantity of Total Nitrogen or Total Phosphorus discharged in a given period of time.See Special Condition A.(2.)Calculation of Total Nitrogen and Total Phosphorous Loads. 7. Compliance with mass limits shall be determined in accordance with Special Condition A.(3.)Annual Limits for Total Nitrogen or Total Phosphorus. 8. Effluent hardness sampling should be performed in conjunction with testing for hardness dependent metals (cadmium,copper,lead,nickel,silver,and zinc). 9. Acute Toxicity(Pimephales promelas)P/F @ 90%,February,May,August,November;See Special Condition A.(5.). 10. The Permittee shall perform three Effluent Pollutant Scans during the term of this permit[see A.(6.)]. 11. The Permittee shall sample instream hardness upstream of the facility's discharge.The sample shall be representative of the hardness in the receiving stream.If the Permittee is a member of a monitoring coalition program,sampling for instream hardness may be waived as long as the monitoring coalition agrees to sample hardness at the nearest upstream location,at a minimum frequency of quarterly,and the Permittee has obtained approval from DWR-NPDES Permitting Unit that the upstream station being monitored by the Coalition is representative of the receiving stream for this discharge.The Permittee is responsible for submitting instream hardness test results with its permit renewal application package.If Coalition membership is cancelled or the li . nsa mpling Coalition terminates instream hardness sa plmg at the approved station,the Permittee will immediately notify the Division and resume sampling for instream hardness upstream of its discharge. (b.) There shall be no discharge of floating solids or visible foam in other than trace amounts. A.(2.) CALCULATION OF TOTAL NITROGEN AND TOTAL PHOSPHORUS LOADS [G.S. 143-215.1(b)] (a.)The Permittee shall calculate monthly and annual TN Loads as follows: (i.) Monthly TN(or TP)Load (lb/mo) =TN(or TP) x TMF x 8.34 where: TN or TP = the average Total Nitrogen or Total Phosphorus concentration (mg/L)of the composite samples collected during the month TMF = the Total Monthly Flow of wastewater discharged during the month(MG/mo) 8.34 = conversion factor,from(mg/L x MG)to pounds (ii.) Annual TN(or TP)Load(lb/yr)=Sum of the 12 Monthly TN(or TP)Loads for the calendar year (b.)The Permittee shall report monthly Total Nitrogen and Total Phosphorus results(mg/L and lb/mo) in the appropriate discharge monitoring report for each month and shall report each calendar year's results(Ib/yr)with the December report for that year. Page 4 of 13 Permit NC0020648 A.(3.) ANNUAL LIMITS FOR TOTAL NITROGEN OR TOTAL PHOSPHORUS [G.S.143-215.1(b)] (a.) Total Nitrogen(TN)and Total Phosphorus (TP)allocations and load limits for NPDES g P dischargers in the Tar-Pamlico River basin are annual limits and apply on a calendar year basis. (b.) For any given calendar year,the Permittee shall be in compliance with the annual TN(or TP) Load limit in this Permit if: i. the Permittee's annual TN(or TP)Load is less than or equal to the effective limit,or ii. the Permittee is a Co-Permittee Member of a compliance association. (c.) If the Permittee is not a co-permittee member of a compliance association and the Permittee's cumulative annual TN(or TP)discharge exceeds the effective TN(or TP)Load limit in this permit at any point during the calendar year,the Permittee is in violation of its TN(or TP)Load limit for the remainder of the calendar year,and each day of continuing violation shall constitute a separate violation.Compliance with annual limits shall be determined separately for each calendar year,and an exceedance in one year does not carry forward to subsequent years. (d.) The TN(or TP)Load limit in this Permit(if any)may be modified as the result of allowable changes in the Permittee's allocations. i. Allowable changes include those resulting from purchase of TN(or TP)allocation from an authorized mitigation banker,the Ecosystem Enhancement Program,or other source allowed under applicable regulations;purchase,sale,trade,or lease of allocation between the Permittee and other dischargers;and other transactions approved by the Division and consistent with the Tar-Pamlico River Basin Association Agreement,as revised. ii. The Permittee may request a modification of the TN(or TP)Load limit in this Permit to reflect allowable changes in its allocation(s).Upon receipt of timely and proper application,the Division will modify the permit as appropriate and in accordance with state and federal program requirements. W. Changes in TN (or TP) limits become effective on January 1 of the year following permit modification.The Division must receive application no later than August 31 for changes proposed for the following calendar year. iv. If the Permittee is a member and co-permittee of an approved compliance association on January 1 of a given year,its TN and TP discharges during that year are governed by that association's group NPDES permit and the limits therein. i. The Permittee shall be considered a Co-Permittee Member for any given calendar year in which it is identified as such in Appendix A of the association's group NPDES permit. ii. Association roster(s)and members'TN and TP allocations will be updated annually and in accordance with state and federal program requirements. iii. If the Permittee intends to join or leave a compliance association,the Division must be notified of the proposed action in accordance with the procedures defined in the association's NPDES permit. (A) Upon receipt of timely and proper notification,the Division will modify the permit as appropriate and in accordance with state and federal program requirements. (B) Membership changes in a compliance association become effective on January 1 of the year following modification of the association's permit. Page5of13 Permit NC0020648 (f.) The TN and TP monitoring and reporting requirements in this Permit remain in effect throughout the term of the Permit and are not affected by the Permittee's membership in a compliance association. A.(4.) NUTRIENT ALLOCATIONS [G.S.143-215.1(b)] (a.) Total Nitrogen(TN)and Total Phosphorus (TP) allocations represent the maximum TN and TP loads that a discharger or group of dischargers is potentially allowed under the Tar-Pamlico nutrient management strategy.Allocations are not enforceable limits but are the basis for TN and TP limits established in individual or group NPDES permits. (b.) The allocations originally assigned to the Tar-Pamlico Basin Association members total 889,274 lb/yr(404,274 kg/yr)TN and 160,372 lb/yr(73,060 kg/yr)TP.These group allocations have been divided among the members in proportion to the maximum permitted flow in each member's permit;that is, Individual Permitted Flow Individual Allocation(TP or (MGD) x Group Allocation,TPBA (TN TN)= Total Permitted Flow,TPBA or TP) (MGD) For the purposes of this distribution,individual permitted flows for the Association members are those in effect as of July 2014 and result in a Total Permitted Flow of 62.495 MGD. (c.) Any addition,deletion,or modification of the listed allocation(s) (other than to correct typographical errors)or any change from Reserve to Active status of any of the listed allocations shall be considered a major modification of this permit and shall be subject to the public review process afforded such modifications under state and federal rules. Page 6 of 13 Permit NC0020648 A.(5.) ACUTE TOXICITY PASS/FAIL PERMIT LIMIT(QUARTERLY) [15A NCAC 02B.0200 et seq.] The permittee shall conduct acute toxicity tests on a quarterly basis using protocols defined in the North Carolina Procedure Document entitled"Pass/Fail Methodology For Determining Acute Toxicity In A Single Effluent Concentration" (Revised December 2010,or subsequent versions).The monitoring shall be performed as a Fathead Minnow(Pimephales promelas)24-hour static test.The effluent concentration at which there may be at no time significant acute mortality is 90%(defined as treatment two in the procedure document). The tests will be performed during the months of February,May, August and November.These months signify the first month of each three-month toxicity testing quarter assigned to the facility.Effluent sampling for this testing must be obtained during representative effluent discharge and shall be performed at the NPDES permitted final effluent discharge below all treatment processes. Should any single quarterly monitoring indicate a failure to meet specified limits,then monthly monitoring will begin immediately until such time that a single test is passed.Upon passing,this monthly test requirement will revert to quarterly in the months specified above. All toxicity testing results required as part of this permit condition will be entered electronically using the Division's eDMR system for the month in which it was performed,using the parameter code TGE6C.Additionally,DWR Form AT-2(original) is to be sent to the following address: North Carolina Division of Water Resources Water Sciences Section/Aquatic Toxicology Branch 1621 Mail Service Center Raleigh,NC 27699-1621 Or,results can be sent to the email, ATForms.ATB@ncdenr.gov. Completed Aquatic Toxicity Test Forms shall be filed with the Water Sciences Section no later than 30 days after the end of the reporting period for which the report is made. Test data shall be complete,accurate,include all supporting chemical/physical measurements and all concentration/response data,and be certified by laboratory supervisor and ORC or approved designate signature. Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream. Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required,the permittee will complete the information located at the top of the aquatic toxicity(AT)test form indicating the facility name,permit number,pipe number,county,and the month/year of the report with the notation of"No Flow"in the comment area of the form.The report shall be submitted to the Water Sciences Section at the address cited above. Should the permittee fail to monitor during a month in which toxicity monitoring is required,then monthly monitoring will begin immediately until such time that a single test is passed.Upon passing, this monthly test requirement will revert to quarterly in the months specified above.Assessment of toxicity compliance is based on the toxicity testing quarter,which is the three-month time interval that begins on the first day of the month in which toxicity testing is required by this permit and continues until the final day of the third month. Page 7 of 13 Permit NC0 2 64a Should any test da ta from either these monitoring requiremen ts or tests performed by the North Carolina Division of Water Resources indicate potential impacts to the receiving stream,this permit may be re-opene d and modified to include alernatemonitoring requirements o limits. Page 8 of 13 Permit NC0020648 A. (6.) EFFLUENT POLLUTANT SCAN [G.S.143-215.1(b)] (a.) The Permittee shall perform a total of three(3)Effluent Pollutant Scans for all parameters listed below. One scan must be performed in each of the following years:2022,2023,and 2024. Analytical methods shall be in accordance with 40 CFR Part 136 and shall be sufficiently sensitive to determine whether parameters are present in concentrations greater than applicable standards and criteria. Samples should be collected with one quarterly toxicity test each year,and must represent seasonal variation[i.e.,do not sample in the same quarter every year]. Unless otherwise indicated,metals shall be analyzed as"total recoverable." ELECTRONIC REPORTING OF DISCHARGE MONITORING REPORTS [G.S.143-215.1(b)] Federal regulations require electronic submittal of all discharge monitoring reports(DMRs)and program reports.The final NPDES Electronic Reporting Rule was adopted and became effective on December 21,2015. (all The permittee shall report discharge monitoring data electronically using the NC DWR's Electronic Discharge Monitoring Report(eDMR) internet application. Monitoring results obtained during the previous month(s)shall be summarized for each month and submitted electronically using eDMR. If a permittee is unable to use the eDMR system due to a demonstrated hardship or due to the facility being physically located in an area where less than 10 percent of the households have broadband access,then a temporary waiver from the NPDES electronic reporting requirements may be granted and discharge monitoring data may be submitted on paper DMR forms (MR 1,1.1, 2,3)or alternative forms approved by the Director. Starting on December 21,2025,the permittee must electronically report the following compliance monitoring data and reports,when applicable: • Sewer Overflow/Bypass Event Reports; • Pretreatment Program Annual Reports;and • Clean Water Act(CWA)Section 316(b) Annual Reports. Electronic Submissions In accordance with 40 CFR 122.41(1)(9),the permittee must identify the initial recipient at the time of each electronic submission. The permittee should use the EPA's website resources to identify the initial recipient for the electronic submission. Initial recipient of electronic NPDES information from NPDES-regulated facilities means the entity (EPA or the state authorized by EPA to implement the NPDES program) that is the designated entity for receiving electronic NPDES data [see 40 CFR 127.2(b)]. EPA plans to establish a website that will also link to the appropriate electronic reporting tool for each type of electronic submission and for each state. Instructions on how to access and use the appropriate electronic reporting tool will be available as well. To obtain an electronic reporting waiver,a permittee must first submit an electronic reporting waiver request to the Division. Requests for temporary electronic reporting waivers must be submitted in writing to the Division for written approval at least sixty (60)days prior to the date the facility would be required under this permit to begin submitting monitoring data and reports. The duration of a temporary waiver shall not exceed 5 years and shall thereupon expire. At such time,monitoring data and reports shall be submitted electronically to the Division unless the permittee re-applies for and is granted a new temporary electronic reporting waiver by the Division. Approved electronic reporting waivers are not transferrable. Only permittees with an approved reporting waiver request may submit monitoring data and reports on paper to the Division for the period that the approved reporting waiver request is effective.
