9 PROJECT DESCRIPTION
The project site is located at 194 Yacht Watch Drive adjacent to the Atlantic Intracoastal Waterway in
the Town of Holden Beach Brunswick County To get to the site from Wilmington take US Hwy 17 S to
Mt Pisgah Road Turn left onto Mt Pisgah Road Mt Pisgah Road merges with NC Hwy 130 and
continue on NC Hwy 130 Travel over the high rise bridge to Ocean Boulevard Turn right onto Ocean
Boulevard West and make your first right onto Rothschild Street Turn left onto Brunswick Ave West
and make the first right onto Yacht Watch Drive SW The project site will be located approximately 0 25
miles on the right hand side of the street
The project site is adjacent to the AIWW and measures approximately 63 feet in width by
approximately 185 feet in depth The elevation of the high ground area of the lot averages
approximately 6 feet above normal high water (NHW) High ground vegetation consists primarily of
lawn grasses and landscape vegetation The shoreline of the property is stabilized vegetation and
transitions from the high ground to an area of coastal wetlands measuring approximately 40 feet in
width A swath of high marsh transitions from the high ground measuring approximately 20 feet in
width and is vegetated primarily with Salt Meadow Hay (Spartrna patens) and is intermixed with wild
blackberries, cat briar and sea ox eye The area of high marsh transitions to low marsh beyond the
NHW boundary and this area is vegetated primarily with Smooth Cord Grass (Spartina alternaflora)
Sea lavender (limonium spp ) and Glasswort (Solicornia spp ) and measures approximately 20 feet in
width Extending beyond the edge of marsh and originating from the high ground is an existing 2 slip
docking faculty authorized by CAMA general permit #49136D and consists of an access pier measuring
approximately 4 feet in width by 123 feet in length A finger pier measuring approximately 5 feet in
width by 12 feet in length extends to the north and is connected via ramp to a floating dock measuring
approximately 7 feet in width by 15 feet in length From the finger pier the access pier widens to 6 feet
and extends water ward for an additional 16 feet An existing boatlift measuring approximately 12 feet
in width by 12 feet in length is located on the south side of the 6 feet wide access pier An existing 10
feet wide by 10 feet long seating platform is located adjacent to the access pier The existing docking
facility provides dockage for two (2) vessels and meets the 15 foot adjacent riparian corridor setback
from the properties to the east and west The existing pier is in alignment with the adjacent docking
facilities located along the AIWW and meets the 80 foot setback from the federally maintained
channel The adjacent properties are stabilized with vegetation and are home to single family
residences
The Holden Beach Land Use Plan classifies the adjacent waters as Conservation and the adjacent high
ground portion of the project area as Residential The waters of the AIWW are classified SA by the
Division of Water Quality and are NOT designated as a Primary Nursery Area (PNA) by the N C Division
of Marine Fisheries They are CLOSED to the harvest of shellfish

PROPOSED PROJECT
The applicant proposes to reconfigure and expand the existing docking facility by constructing an
additional finger pier and platform and the installation of a boatlift to provide mooring for a total of
three (3) vessels The applicant is proposing to expand the existing seating platform located adjacent
to the access pier by 5 feet in width as proposed the platform would measure approximately 15 feet in
width by 14 feet in length Connected to the proposed expanded seating platform and extending to
the east would be a finger pier measuring approximately 6 5 feet in length by 4 feet in width The
finger pier would be connected via ramp to a proposed floating dock measuring approximately 8 feet in
width by 16 feet in length The proposed floating dock would be oriented perpendicular to the
channel The existing access pier would be expanded to 6 feet in width from the seating platform
outboard approximately 26 feet in length The existing access pier measuring approximately 5 feet in
width and 10 feet in length that provides access to the floating dock in its current location would be
removed as part of this application request The existing 12 feet wide by 12 feet long boatlift on the
west side of the access pier would remain and a second boatlift is proposed on the east side of the
access pier As proposed the boatlift would measure approximately 12 feet in length by 12 feet in
width The proposed floating dock would be located on the east side of the proposed boatlift As
proposed the docking facility would provide mooring for three (3) vessels and would not extend
beyond the established pier head line or encroach into the 80 foot setback from the federally
maintained channel As proposed the proposed floating dock and finger pier would encroach into the
adjacent riparian corridor setback of the property to the east by approximately 7 feet therefore
leaving 8 feet between the proposed docking facility and the riparian corridor line The adjacent
riparian property owner to the east is also owned by the applicant Larry Cauthen therefore no signed
waiver is required
10 ANTICIPATED IMPACTS
The proposal to reconfigure and expand the existing docking facility by constructing an additional
finger pier platform and the installation of a boatlift to provide mooring for a total of three (3) vessels
would incorporate an additional 290 square feet of Estuarine Waters and Public Trust Area The
proposed fixed pier modifications including the removal of a platform and the construction of a finger
pier and platform addition would result in approximately 96 sq ft of additional shading impacts to
Estuarine Waters and Pubic Trust Area Minor increases in turbidity should be expected during
construction No outboard expansion is proposed the docking facility would remain in alignment with
existing docking facilities and would continue to maintain the 80 foot setback from the federally
maintained channel As proposed the docking facility would encroach into the adjacent 15 riparian
corridor setback of the neighbor to the east however the applicant is also the adjacent riparian
property owner As proposed the docking facility would provide mooring for a total of three (3)
vessels

The project area involves the remodeling of an existing pier the relocating of an existing 8 X 16
floating dock and ramp the extension of an existing 10 X 10 stationary platform to a total
dimension of 15 X 10 the addition of a 4 stationary walk constructed and connected to the
stationary platform extension and the installation of a second 12 X 12 boat hft The completed
project will include 2 boat lifts and a floating dock These structures are for private use only
Proposed construction will not extend into the 80 setback line but will extend into the 15 riparian
setback of the adjacent lot that is also owned by the Larry Cauthen
Existing Environment
The subject is located at 194 Yacht Watch Drive on the mainland of the Town of Holden Beach in
southern Brunswick County on the Atlantic Intracoatal Waterway (AIWW) The project is located
approximately 200 east of Rogers Street and is bordered to the west by CE Investments LLC on
the east by Larry Cauthen and to south by Yacht Watch Drive
Coastal salt marsh is present along the AIWW within the project boundary

In accordance with your written request of November 28 1994 and the
ensuing administrative record enclosed are two copies of a Department of the
Army (DA) Letter of Permit to construct a pier with a stationary dock and
floating dock extending from your property located at Lot 4 on Yacht Watch
Drive in the Yacht Watch subdivision on the Atlantic Intracoastal Waterway in
Holden Beach Brunswick County North Carolina
You should acknowledge that you accept the terms and conditions of the
enclosed permit by signing and dating each copy in the spaces provided
( Permittee on page 3) Your signature as permittee indicates that as
consideration for the issuance of this permit you voluntarily accept and
agree to comply with all of the terms and conditions of this permit All
pages of both copies of the signed permit with drawings should then be
returned to this office for final authorization A self addressed envelope is
enclosed for your convenience
Title 33 Part 325 1(f) of the Code of Federal Regulations reads in
part that A $10 fee will be charged for permit applications when the work
is noncommercial in nature and provides personal benefits that have no
connection with a commercial enterprise and A fee of $100 will be
charged for permit applications when the planned or ultimate purpose of the
project is commercial or industrial in nature and is in support of operations
that charge for the production distribution or sale of goods or services

owned by Waterway Development Company located at Lot 4 on yacht Watch Drive In the Yacht Watch
subdivision near Holden Beach Brunswick County North Carolina The pier will extend 98 9 feet from
high ground to a platform (10 feet by 16 feel over the open water The floating dock 18 feet by 16 feet)
will be on the east and of the pier platform The structure will not extend beyond the 2 0 feet mean low
water contour

General Conditions
1 The time limit for completing the work authorized ends on December 31. 1998 If you find that you need
more time to complete the authorized activity submit your request for a time extension to this office for consideration at least
one month before the above date is reached
2 You must maintain the activity authorized by this permit in good condition and in conformance with the terms and condi
tions of this permit. You are not relieved of this requirement if you abandon the permitted activity although you may make
a good faith transfer to a thud party in comphance with General Condition 4 below Should you wish to cease to maintain
the authorised activity or should you demre to abandon It without a good faith transfer you must obtain a modification of
this permit from this office which may require restoration of the area.
8 If you dlscover any previously unknown historic or archeological remains While accomplishing the activity authorized by
this permit, you roust immediately notify this office of what you have found. We will initiate the Federal and state coordina
tion required to determine if the remains warrant a recovery effort or if the alte is eligible for listing In the National Register

6 Reevaluation of Permit Decision This office may reevaluate its decision on this permit at any time the circumstances
warrant Circumstances that could require a reevaluation include but are not limited to the following
a You fail to comply with the terms and conditions of this permit
b The information provided by you in support of your permit application proves to have been false incomplete or
inaccurate (See 4 above)
c Significant new information surfaces which this office did not consider in reaching the original public interest decision
Such a reevaluation may result in a determination that it is appropriate to use the suspension modification and revocation
procedures contained in 33 CFR 326 7 or enforcement procedures such as those contained in 33 CFR 326 4 and 326 6 The
referenced enforcement procedures provide for the issuance of an administrative order requiring you to comply with the terms
and conditions of your permit and for the initiation of legal action where appropriate You will be required to pay for any
corrective measures ordered by this office and if you fail to comply with such directive this office may in certain situations
(such as those specified in 33 CFR 209 170) accomplish the corrective measures by contract or otherwise and bill you for the
cost
6 Extensions General condition 1 establishes a time limit for the completion of the activity authorized by this permit Unless
there are circumstances requiring either a prompt completion of the authorized activity or a reevaluation of the public interest

a All work authorized by this permit must be performed in strict
compliance with the attached plans which are a part of this permit
b This permit does not authorize the interference with any existing or
proposed Federal project, and the permittee will not be entitled to
compensation for damage or injury to the authorized structure or work which
may be caused from existing or future operations undertaken by the United
States in the public interest
c No attempt will be made by the permittee to prevent the full and free
use by the public of all navigable waters at or adjacent to the authorized
work Use of the permitted activity must not interfere with the public s
right to free navigation on all navigable waters of the United States
d If the display of lights and signals on the authorized structure is not
otherwise provided for by law such lights and signals as may be prescribed by
the U S Coast Guard will be installed and maintained by and at the expense of
the permittee
e The permittee upon receipt of a notice of revocation of this permit or
upon its expiration before completion of the work will without expense to
the United States and in such time and manner as the Secretary of the Army or
his authorized representative may direct restore the waterway to its former
conditions If the permittee fails to comply with this direction the
Secretary or his representative may restore the waterway by contract or
otherwise and recover the cost from the permittee
f It is possible that the authorized structure may be damaged by wavewash
from passing vessels The issuance of this permit does not relieve the
permittee from taking all proper steps to ensure the integrity of the
permitted structure and the safety of moored boats The permittee will not
hold the United States liable for any such damage
g The permittee will maintain the authorized work in good condition and in
conformance with the terms and conditions of this permit The permittee is
not relieved of this requirement if he abandons the permitted activity without
having it transferred to a third party
h The authorized structure and associated activity will not cause an
unacceptable interference with navigation
1 If the permittee discovers any previously unknown historic or
archeological remains while accomplishing the authorized work, he will
immediately notify the Wilmington District Engineer who will initiate the
required State /Federal coordination
