The proposed Project is situated on two parcels totaling approximately 214.2 acres of land (Site) located west of Red Hill Church Road in Dunn, North Carolina, within Harnett County.
The Site is primarily comprised of agricultural fields with a few areas of mixed -hardwood forest.

4h. Explain the purpose of the proposed project:*
The primary purpose of the Project is to develop a 10 MW AC renewable energy generation facility that is needed to achieve greater energy generation diversity and to achieve
targeted goals of renewable energy generation within Harnett County. The Applicant has identified this Site as an ideal location for a solar facility due to its location along an existing
transmission line. This Project has been evaluated and meets the necessary requirements to economically produce electrical power through the use of photovoltaic panel arrays.
41. Describe the overall project in detail, including indirect impacts and the type of equipment to be used:*
The proposed solar development will be achieved through construction of an access point off Red Hill Church Road. This access point ties to a gravel access road that traverses the
Project Area.
The photovoltaic panels are proposed to be constructed in a grid pattern. The system will utilize the arrays to achieve the generation of 10 MW AC of electrical power. The panels will be
mounted on a single -axis tracking system that is able to alter direction for optimal sun exposure. The Project may also utilize panels affixed to a fixed -tilt tracking system. The generated
power will be supplied to the regional Duke Energy Progress electric grid.
A security fence with warning signage will be constructed around the facility with access by way of gates at strategic points along the access roads. This will protect the Site and public
from unregulated access to the Site.
All work will be conducted in accordance with local, state, and federal regulations. Traditional equipment will be used consisting of front-end loaders, bulldozers, paving equipment,
graders, and earth movers. Sediment control measures will be utilized.

Impact 1 consists of 1,731-sq. ft. of permanent wetland impacts in order to install a road crossing, necessary to connect the northern and southern
portions of the project area. The road crossing will include the installation of two 30" Reinforced Concrete Pipe (RCP) culverts. The RCPs will be
countersunk underneath the road crossing to maintain the hydrologic connection between the up gradient and down gradient portion of the wetland
and stream.

Impact 1 consists of 58-ft of permanent stream impact associated with the installation of two 30" Reinforced Concrete Pipe (RCP) culverts in order to
install a road crossing, necessary to connect the northern and southern portions of the project area. The proposed culvert will be countersunk
beneath the road to maintain the upstream and downstream hydrologic connection. Culverts were sized based on calculations of flow requirements for
the area.
E. Impact Justification and Mitigation
1. Avoidance and Minimization
1a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project:
Impacts to jurisdictional features have been avoided and minimized to the maximum extent practicable by incorporating resourceful site planning,
including utilization of the wetland/stream delineation to adjust the layout of the Site design to avoid and minimize impacts. The remaining impacts
proposed are necessary in order for the project's goals to be realized.
Road crossings were designed to minimize the amount of grading required and strategically placed at a location with narrow wetlands and no stream
bends. A culvert will be installed beneath the crossing to maintain the hydrologic connection of the wetland and stream up and down -slope.
1b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques:
Proper sedimentation and erosion control methods will be utilized during all phases of construction and installation as described in accordance with
the requirements of the North Carolina Department of Environment and Natural Resources: Erosion Control Planning and Design Manual (May 2013)
and local codes. All work will take place during dry conditions and can be facilitated from high, non -jurisdictional, stable ground. The contractor shall
install silt fence, inlet protection, sediment traps, division ditches, temporary coffer dams, tree protection, and clearing only as necessary to install
devices. All erosion and sediment control measure will be checked for stability and operation following every runoff producing rainfall, but in no case
less than once every week. Any needed repairs will be made immediately to maintain all measures designed. An erosion control inspections report is
required and will be kept by the owner's representative.
Temporary seeding and permanent seeding plans are included to restore impacted areas. The project will meet all relative requirements of Best
Management Practices and Engineered Stormwater Control Structures as outlined through State and Local Stormwater Rules. Measures will be taken
to prevent oil, tar, trash, debris and other pollutants from entering adjacent jurisdictional features. Any excess excavated materials not utilized as back
fill will be placed and contained within upland areas and permanently stabilized to prevent erosion into adjacent jurisdictional features. Therefore,
stockpiling of excavated material within jurisdictional waters of the U.S. will be strictly prohibited as part of the construction of this project. all project
construction activities initiated within jurisdictional waters of the U.S. will be carried to completion in an expeditious manner to minimize the period of
disturbance within jurisdictional waters.

A USFWS IPaC Report and NCNHP Natural Heritage Database Report were utilized for reviewof potential protected species in the vicinity of the
project Site. Species identified by IPaC as potentially occurring in the vicinity of the Site include the red -cockaded woodpecker, American alligator,
Cape Fear shiner, Atlantic pigtoe, and rough -leaved loosestrife. No critical habitats were identified within the Site.
The NCNHP report indicates no known occurrences of endangered or threatened species within a one -mile radius of the project area. One managed
area, North Carolina Rails -to -Trails Preserve, was identified adjacent to the Site.
USFWS consultation was completed by Pilot. The USFWS provided a response on 02/02/21 (attached) stating the project is not likely to adversely
affect federally listed endangered or threatened species. The USFWS also provided recommendations for site best practices to further avoid impacts.

The State Historic Preservation Office Historic Properties Map was reviewed to determine if the site has the potential to impact historic resources. No
sites listed on or eligible for listing on the National Register of Historic Places were identified on the Site. One study listed site, a mid 19th century
Frame Greek Revival I -House identified as House 2004 (HT0371), was identified as being located appro>mately 0.1-miles east of the Site. In addition,
one destroyed study listed site, a surveyed site, and a surveyed but now destroyed site were identified. The surveyed site (HT0361) is located
appro>mately 0.85-miles northwest of the Site.
Development on the eastern portion of the proposed site will be limited to an access road. Other improvements, including solar panel installation, will
occur approximately 0.45-miles west of HT0371, separated by a stand of trees limiting visibility. Therefore due to distance from the site and the
absence of impacts to the visual setting, the proposed site should have no effect on HT0371.
SHPO was provided an opportunity to comment on the proposed project through a North Carolina State Clearinghouse Department of Administration
Intergovernmental Review. SHPO responded on December 9, 2013 stating "No Comment'. This document is attached.

endangered, proposed and candidate species, as well as proposed and final designated critical
habitat, that may occur within the boundary of your proposed project and/or may be affected by
your proposed project. The species list fulfills the requirements of the U.S. Fish and Wildlife
Service (Service) under section 7(c) of the Endangered Species Act (Act) of 1973, as amended
(16 U.S.C. 1531 et seq.).
New information based on updated surveys, changes in the abundance and distribution of
species, changed habitat conditions, or other factors could change this list. Please feel free to
contact us if you need more current information or assistance regarding the potential impacts to
federally proposed, listed, and candidate species and federally designated and proposed critical
habitat. Please note that under 50 CFR 402.12(e) of the regulations implementing section 7 of the
Act, the accuracy of this species list should be verified after 90 days. This verification can be
completed formally or informally as desired. The Service recommends that verification be
completed by visiting the ECOS-IPaC website at regular intervals during project planning and
implementation for updates to species lists and information. An updated list may be requested
through the ECOS-IPaC system by completing the same process used to receive the enclosed list.
Section 7 of the Act requires that all federal agencies (or their designated non-federal
representative), in consultation with the Service, insure that any action federally authorized,
funded, or carried out by such agencies is not likely to jeopardize the continued existence of any
federally-listed endangered or threatened species. A biological assessment or evaluation may be
prepared to fulfill that requirement and in determining whether additional consultation with the
Service is necessary. In addition to the federally-protected species list, information on the
species' life histories and habitats and information on completing a biological assessment or

If your project contains suitable habitat for any of the federally-listed species known to be
present within the county where your project occurs, the proposed action has the potential to
adversely affect those species. As such, we recommend that surveys be conducted to determine

Dear Mrs. Carston:
This letter is in response to your request for information on your proposed solar project, listed
above. Our comments are submitted pursuant to, and in accordance with, provisions of the
Endangered Species Act (the Act).
Based on the information provided and other information available, it appears that the proposed
action is not likely to adversely affect any federally-listed endangered or threatened species, their
formally designated critical habitat, or species currently proposed for listing under the Act at
these sites. We believe that the requirements of section 7(a)(2) of the Act have been satisfied for
your project. Please remember that obligations under section 7 consultation must be
reconsidered if: (1) new information reveals impacts of this identified action that may affect
listed species or critical habitat in a manner not previously considered; (2) this action is
subsequently modified in a manner that was not considered in this review; or, (3) a new species
is listed or critical habitat determined that may be affected by the identified action.
However, the Service is concerned about the potential impacts the proposed action might have
on aquatic species. Aquatic resources are highly susceptible to sedimentation. Therefore, we
recommend that all practicable measures be taken to avoid adverse impacts to aquatic species,
including implementing directional boring methods and stringent sediment and erosion control
measures. An erosion and sedimentation control plan should be submitted to and approved by
the North Carolina Division of Land Resources, Land Quality Section prior to construction.
Erosion and sedimentation controls should be installed and maintained between the construction
site and any nearby down-gradient surface waters. We recommend maintaining natural,
vegetated buffers on all streams and creeks adjacent to the project site.
The Service recommends that solar facilities be sited in areas that are previously disturbed, or
sites that do not impact mature forest, wetlands, or streams. The North Carolina Wildlife
Resources Commission has developed a Guidance Memorandum (a copy can be found on our
website at (http://www.fws.gov/raleigh) to address and mitigate secondary and cumulative
impacts to aquatic and terrestrial wildlife resources and water quality. We recommend that you
consider this document in the development of your projects and in completing an initiation
package for consultation (if necessary).
In addition, we encourage the use of natural vegetation management practices (such as sheep
grazing) and the planting or seeding of native pollinator plant species where possible on the site,
and other efforts to improve habitat for various species (such as bird houses and bat boxes). The
Service has co-authored the North Carolina Technical Guidance for Native Plantings on Solar
Sites, which can be found on the North Carolina Pollinator Alliance website:

2018.pdf.
To offset the overall impacts of solar facilities and/or to increase the habitat and species diversity
within the solar facility area, we further recommend the following measures be implemented into
project design:
• Create openings in fencing to allow passage for small mammals and turtles.
• Mitigate for the loss of forested habitat. Though the loss of forested habitat cannot be
fully mitigated when cleared for solar facilities, we believe measures should be
implemented into the design plans to offset the impacts of the project to the greatest
extent practicable. We recommend the construction and placement of bat and bird boxes
throughout the site along with perch poles that are large enough to be used by raptors.
• We recommend that solar companies sow native seed mixes with plant species that are
beneficial to pollinators throughout the site. Please refer to the North Carolina Solar
Technical Guidance at the North Carolina Pollinator Alliance website, listed above.
• The Service is concerned with the introduction and spread of invasive exotic species in
association with the proposed project. Exotic species are a major contributor to species
depletion and extinction, second only to habitat loss. Despite their short-term erosion
control benefits, many exotic species used in soil stabilization seed mixes are persistent
once they are established, thereby preventing the reestablishment of native vegetation.
Many of these exotics plants3 are also aggressive invaders of nearby natural areas, where
they are capable of displacing already established native species. Therefore, we strongly
recommend that only native plant species be used in association with all aspects of this
project.
The Service has established an on-line project planning and consultation process which assists
developers and consultants in determining whether a federally-listed species or designated
critical habitat may be affected by a proposed project. For future projects, please visit the
Raleigh Field Office’s project planning website at https://www.fws.gov/raleigh/pp.html. If you
are only searching for a list of species that may be present in the project’s Action Area, then you
may use the Service’s Information, Planning, and Consultation System (IPaC) website to
determine if any listed, proposed, or candidate species may be present in the Action Area and
generate a species list. The IPaC website may be viewed at https://ecos.fws.gov/ipac/. The
IPaC web site contains a complete and frequently updated list of all endangered and threatened
species protected by the provisions of the Endangered Species Act of 1973, as amended (16
U.S.C. 1531 et seq.)(Act), a list of federal species of concern i that are known to occur in each
county in North Carolina, and other resources.
