Dear Mr. Koopman:
On January 13, 2021, Michael Meilinger and Tony Parker of the North Carolina Division of Water Resources (DWR),
Water Quality Regional Operations Section (WQROS), conducted a Complaint investigation of fungus growing in
Beaver Creek. After walking the area of the Beaver Creek, we found a storm water pipe that flowed from the effluent
of the fresh water ponds on site of facility AWC490008 to the condiment mixing shed where a surface drain is located
and collects the surface run off water before it goes into a drop box by Seed House Road. In the mixing area one
days' worth of silage is stored in bins and added to the feed mixtures as the cows are fed. This bin and mixing area is
releasing leachate that is going into the surface drain. When the leachate collection system was designed this area
was not incorporated into the plans.
Violation I: I. Performance Standards
1. Any discharge of waste that reaches surface waters or wetlands is prohibited except as otherwise provided
in this General Permit and associated statutory and regulatory provisions. Waste shall not reach surface
waters or wetlands by runoff, drift, manmade conveyance, direct application, direct discharge or through
ditches, terraces, or grassed waterways not otherwise classified as state waters.

Mr. Koopman had employees of the farm berm around the grate to prevent any more leachate from discharging,
and called Iredell County Soil and Water for Technical Assistance. The county has developed a plan for re-routing the
fresh water effluent and sealing off the existing pipe so that no more leachate can enter the system through the
surface drain. Samples were taken on 1-13-2021 and field parameters were taken on the following day 1-14-2021.
DWR requests that you submit a written response within 30 days of receipt of this letter about your progress with
the plan that Iredell County Soil and Water provided. If you have any questions, please do not hesitate to contact
