SUBJECT: Emergency pipe repair (End Section Replacement) on SR 1268 (River Road),
Lincoln County
Dear Mr. Lund:
The North Carolina Department of Transportation proposes to replace a 12-foot failing pipe end
section on a 70-foot, 52" pipe on SR 1268 (River Road) in Lincoln County. The road shoulder
above the pipe is beginning to collapse and there is concern for public safety; therefore, this
project is considered an emergency project and construction will commence immediately. The
existing pipe will set the grade of the pipe end replacement; therefore, the repaired pipe may be
on normal streambed grade rather than the required one-foot below streambed elevation. Due to
the existing site conditions, NCDOT requests a waiver from the Regional Condition 2(b)(e)
permit depth specification, for the construction of this project.
Temporary cofferdams and bypass pumping will be used for stream management during
construction. Upon project completion, the area impacted by the temporary cofferdams will be
returned to pre-project conditions and seeded and stabilized. The total scope of the work will
result in 5 feet of permanent riprap impacts to the embankments of an unnamed tributary to South
Fork Catawba River, which is classified as a WS-1V watershed by the Division of Water Quality.
The project is not located within Yz mile of any critical watershed area nor is SR 1268 a rural or
urban arterial; therefore, hazardous spill basins are not required. Enclosed is the hazardous spill
basin checklist.
This office has conducted a GIS and field survey for the project for historical sites and
threatened/endangered species sites. No sites listed on the National Register of Historic Places
are located in the vicinity of the project nor did there appear to be any eligible structures. The
federally listed species for Lincoln County (USFWS listed dated March 8, 2006) include
Michaux's sumac (Rhus michauxii) and the dwarf-flowered heartleaf (Hexastylis nan~ora).

Natural Heritage Program records document the nearest Michaux's sumac location approximately
22 miles southeast (in Mecklenburg County) of the proposed project area. There are no known
sites of Michaux's sumac in Lincoln County. The sumac is typically found in sandy or rocky,
open woods and appears to survive best in areas with some disturbance, such as artificially or
naturally maintained clearings. There did there appear to be suitable habitat located in the project
area. Natural Heritage Program records document the nearest dwarf-flowered heartleaf location
approximately 3.6 miles south of the proposed project area. The heartleaf is usually found on dry
to moist ravine slopes (usually north facing and of the oak-hickory-pine forest type) and in boggy
areas near springheads. There is no habitat within the proposed project area and no species were
observed. NCDOT is recommending a finding of "no effect" for T&E species and historical
structures.

location maps relative to the project.

III. Project Information
Attach a vicinity map clearly showing the location of the property with respect to local
landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property
boundaries and development plans in relation to surrounding properties. Both the vicinity map
and site plan must include a scale and north arrow. The specific footprints of all buildings,
impervious surfaces, or other facilities must be included. If possible, the maps and plans should
include the appropriate USGS Topographic Quad Map and NRCS Soil Survey with the property
boundaries outlined. Plan drawings, or other maps may be included at the applicant's discretion,

10. Describe the overall project in detail, including the type of equipment to be used. Repair of a
52" 70-foot ,ape. A 12-ft end section at the pipe outlet has failed and is causing the road
shoulder to collapse. The 12-ft end section will be replaced and Class II riprap will be placed
at the outlet for structure stabilization. The slope of the existing_pipe will set the grade of the
replacement section• therefore it is possible that the Qpe outlet will be on streambed rg ade
rather than one-foot below the normal streambed elevation, after construction is complete.
Typical heave equipment (trackhoe backhoe etc) will be used for the construction of this
project
11. Explain the purpose of the proposed work: The purpose of the proposed work is to repair a
broken ape section and repair the road shoulder for the safety of the travelling_public.
IV. Prior Project History
If jurisdictional determinations and/or permits have been requested and/or obtained for this
project (including all prior phases of the same subdivision) in the past, please explain. Include
the USACE Action ID Number, DWQ Project Number, application date, and date permits and

VI. Proposed Impacts to Waters of the United States/Waters of the State

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts
were minimized once the desired site plan was developed. If applicable, discuss construction
techniques to be followed during construction to reduce impacts. The broken end section and
road shoulder must be repaired for the safety of the travelling_public. Minimal riprap utilized at
repaired outlet for structure stabilization.
VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.
USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on January 15, 2002, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors

including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCEEP concurrence shall be placed on hold as incomplete.
An applicant may also choose to review the current guidelines for stream restoration in DWQ's
Draft Technical Guide for Stream Work in North Carolina, available at
http://h2o.enr.state.nc.us/ncwetlands/strm ~ide.html.
