Per an application request made by February 7, 2007, the Division of Water Quality is rescinding the
subject recycle system permit. In accordance Nvith NC State Administrative Code 15A NCAC 02T,
effective September 1. 2006, the recycle system at Pineville -Ready-Mix Plant meets the requirements of
Section .1003(a) for systems to be deemed permitted. The recycle system at Pineville Ready -Mix Plant
is not required to apply for future permit renewals or modifications provided that the facility continues to
comply with the requirements of 15A NCAC 02T .1000.
In accordance with Regulation 15A. NCAC 021 ,1003(a)(2), the recycle system at Pineville 'Ready -Mix
Plant shall operate with sufficient storage capacity to contain the runoff from a 24-hour, 25-year storm
event plus one foot freeboard. As per the rescission request dated February 7, 2007, the recycle system at
Pineville Ready -Mix Plant shall operate with a freeboard of no less than 35.2-inches (23.2 inches to
accommodate a 25-year storm in addition to the required 12-inehes).
Please be advised that NC State Administrative Code 15A NCAC 02T .1003(a) requires that a Spill
Control Plan be maintained for r the Facility. The Spill Control Plan shall at a minimum addresses the
following items:
a. Contact phone numbers for 24-hour response, including weekends and holidays;
b. Contact phone number for the Division of Water Quality Regional Office;
c. Contact information for construction crews, contractors and/or engineers;
d. Expected response times;
e. Essential equipment list and spare parts inventory;
f. Location of clean up materials;

h. Post -response assessment and reporting,

In light of the recent amendments to North Carolina Administrative Code, Title I 5A,
Subchapter 2T, effective September 1, 2006, Cemex is requesting the rescission of Permit
WQ0008919. For this purpose enclosed you will find form RRPWRS 10-06, an entire
site drawing, and a scaled drawing of the existing recycle water basin system along with
calculations used to determine the storage capacity required to contain a 25-year storm
event. In addition, information submitted along with the original permit application has
been included for ease of review.
Water inputs into the recycling system include rain water form contributing areas and
water used during normal operations, such as to rinse a truck after it is loaded. Water
from the recycling basin system is returned for use into additional concrete batching at a
50 % rate.
Currently, the recycling basin is not used to rinse out our drums at the end of each work
day. The end -of -day rinse out is done at the adjacent drying slab using mostly rock (rock
out) and small amounts or recycled water. Rinsing of the mixer drums returns a small
amount of water and concrete fines into the basin. The recycle basin is cleaned out
routinely with the onsite front-end loader and the slurry is transferred to an adjacent
onsite drying area. This rn.aterial is disposed of offsite after it dries.
The recycle water system at this facility is designed to manage a 25-year storm event
with approximately 1.61 feet of free board (see attached drawing/calculations). Since all
other additions of water to the system are manually controlled, this facility can operate to
meet the requirements of Rule 15A NCAC 02T.1003 (a) (2).
CEMEX also maintains a spill response plan at the facility per NC Stormwater
regulations which includes annual training and phone contacts of 24 hour emergency spill

response contractors ifneeded. Additionally, this facility is regulated by NCDENR
Stonnwater Permit NCG140000 which does not allow routine discharges of water from
the recycle basin. A release or spill from the recycle basin will migrate to the drying slab
area, which it is able to hold the 10-yr flood by itself.
It should be noted that in the event of a -year storm in a 4-hour period would mean
that the plant will not normally be operating therefore the additional volume of wafer
produced by normal operations will not be produced, in turn producing an additional
safety margin to the design of the basin.

15A NCAC 02T .1003 PERMITTING BY REGULATION
(a) The following systems are deemed permitted pursuant to Rule .0113 of this Subchapter provided the system.
meets the criteria in Rule .0113 of this Subchapter and all criteria required for the specific system in this Rule:
(1) Return of wastewater contained and under roof within an industrial or commercial process where there is no
anticipated release of wastewater provided the facility develops and maintains a spill .control plan in the
event of a release and no earthen basins are used.
(2) Recycling of rinse water at concrete mixing facilities for concrete mix removal from equipment provided
the wastewater is contained within concrete structures, there is sufficient storage capacity to contain the
runoff from a 24-hour, 25-year storm event plus one foot freeboard and the facility develops and maintains
a spill control plan in the event of a wastewater release. The facility must notify the appropriate Division
regional office in writing noting the owner, location., and .that the design complies with the above criteria.
Recycling of wash and rinse water at vehicle wash facilities provided the wastewater is contained within
concrete, steel or sy-nthetic structures (i..e. not including earthen basins), all vehicle washing is conducted
under roof and there are no precipitation inputs (direct or indirect), and the facility develops and maintains a
spill control plan in the event of a wastewater release.
(4) The reuse or return of wastewater within the treatment works of a permitted wastewater treatment system.
(b) The Director rnay determine that a system should not be deemed permitted in accordance with this Rule and Rule
.0113 of this Subchapter. This determination shall be made in. accordance with Rule .0113(e) of this Subchapter.

Enclosed are one original and four copies of Wastewater Recycle System permit applications for two of
RMC Mid -Atlantic, LLC's (formerly Metromont Materials) facilities. The facilities are RMC Mid -
Atlantic — Reames Road and RINK Mid -Atlantic — Pineville. Neither of the systems have been modified
in any way, so only Sections I and II were completed as well as the Applicant's Certification. Also
enclosed are copies of the previous permits for both systems.
Both systems are designed to capture process water generated from the ready -mix concrete production
operations, which includes rinsing of mixer truck exteriors, rinsing out the inside of the mixer -drums,,
washing down the facility grounds, and miscellaneous discharges generated in the batching of concrete.
The water enters a series of collection basins where solids settle out. The clarified water is then pumped
to be used again for batching concrete and rinsing out the inside of mixer drums.
It has been my understanding that since the current general stormwater permit for ready -mix concrete
facilities addresses process water discharges, we did not need to have and maintain non -discharge pernits
for wastewater recycle systems. That is why renewals were not previously submitted at the time of the
permits' expiration. If we are required to have these permits, then all other companies should be as well.
Please check the files to see how many other recycle systems for ready -mix plants have non -discharge
permits.

RECYCLE SYSTEM DESCRIPTION
CHARLOTTE SOUTH PLANT
PURPOSE:
The purpose of the recycle system is to provide an area to dry
returned concrete, collect and store process and storm water and to
provide for utilization of collected water to manufacture ready mix
concrete.
WASTE WATER COLLECTION
Areas that generate process water and areas where the storm water
is contaminated with cement are drained into the recycle basin. The
recycle basin is designed to accommodate all process water generated,
storm water runoff from normal. rainfall, storm water runoff from the
100 year flood and 1100 cubic feet of settled solids. The elevation
of the drying slab in relation to the elevation`of the recycle basin
is set to allow the drying slab to store storm water runoff from the
100 year flood.
The areas that water is collected from are as follows:
1. Drying slab 3750 SF
2. Recycle Basin 1100 SF
3. Driveway Under Plant 600 SF
4. Rinse Station 1280 SF
The water generated from these areas is collected by an opened
top concrete "U" ditch to facilitate inspection and cleaning of the
drainage system. Areas that water is collected from are separated
from adjacent areas by curbs and grade changes. This prevents storm
water from noncollected areas from entering the recycle basin and
causing it to over flow.
WATER UTILIZATION SYSTEM
A 7.5 horsepower self priming centrifugal pump (catalog cut
enclosed) with a floating intake and associated piping distribute
water to points of use. The recycled water is connected to dedicated
plant water piping and is used to mix ready mix concrete. The waste
rater is recirculated through the system to rinse out mixers, to rinse
off the driveway under the batch plant and to rinse off the inclined
slab in the recycle basin.
DRYING SLAB
When concrete i,s returned to the plant it, is spread out in a thin
layer on the drying slab. When the concrete is hydrated/dryed it is
stockpiled on the drying slab, screened and incorporated into new
concrete. The settled solids from the recycle basin are mixed with
the reclaimed material prior to introduction to new concrete.

continued operation of a 5,514 GPD wastewater recycle system consisting of several surface drainage collection, areas
with a combined area of 6,730 tf, a 22 ft x 50 ft x 4.5 ft settling basin, and a 7.5 HP self priming centrifugal pump with a
floating intake and associated piping, to serve Pineville Plant with no discharge of wastes to the surface waters, pursuant
to the application received February 13, 2006, and subsequent additional information received by the Division, and in
conformity with the project plan, specifications, and other supporting data subsequently filed and approved by the
Department of Environment and Natural Resources and considered a part of this permit.
This perrnit shall be effective from the date of issuance until February 28, 2010, shall void Permit No.
WQ0008919 issued May 5, 2005, and shall be subject to the following specified conditions and limitations:
1. This permit, is effective only with respect to the nature and volume of wastes described in the application and other
supporting data.
7. The facilities shall be properly maintained and operated at all times.
3 The following buffers shall be maintained:
a) 1.00 feet between treatment/storage units and any -wells,
-b.) 50 feet between treatment/storage units and surface waters, and
c) 50 feet between treatment/storage units and property lines.
Some of the buffers specified above may not have been included in previous permits for this waste treatment
and disposal system. These buffers are not ntended to prohibit or prevent modifications, which are required.
by the Division, to improve performance of the existing treatment facility. These buffers do, however, apply
to modifications of the treatment and disposal facilities that are for the purpose of increasing the flow that is
tributary to the facility. These buffers do apply to any expansion or modification of the irrigation areas and
apply in instances in which the sale of property would cause any of the buffers now complied with, for the
treatment and disposal facilities, to be violated. The applicant is advised that any modifications to the
existing facilities will require a permit modification.

4, This permit is not transferable, In the event there is a desire for the facilities to change ownership, or there is a
name change of the Permittee, a formal permit request must be submitted to the Division of Water Quality
(Division) accompanied by an application fee, documentation from the parties involved, and other supporting
materials as may be appropriate. The approval of the request will be considered on its merits and may or may not
be approved,
5. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the
Permittee shall take immediate corrective action. including those actions that may be required 'by this Division, such
as the construction of additional or replacement treatment or disposal facilities.
6. The residuals generated from these treatment facilities must be disposed in accordance with General Statute 143-
215.1 and in a manner approved by the Division.
7, The issuance of this permit shall not relieve the Pcrrnittee of the responsibility for damages to surface or
groundwaters resulting from the operation of this facility.
The facilities shall be effectively maintained and operated as a non -discharge system to prevent the discharge of any
wastewater resulting from the operation of this facility,
9. Diversion or bypassing of untreated wastewater from the treatment facilities is prohibited.
10. Freeboard in the settling basin shall not be less than two feet at any lime.
11. A waste -level gauge, to monitor waste levels in the settling basin, shall have readily visible permanent markings
indicating the maximum liquid level at the top of the temporary liquid storage volume, minimum liquid level at the
bottom of the temporary liquid storage volume, and top of the basin elevations.
12. Any monitoring deemed necessary by the Division to insure surface and ground water protection will be established
and an acceptable sampling reporting schedule shall be followed.
13. Adequate inspection, maintenance, and cleaning shall be provided by the Perrnittee to insure proper operation of the
subject facilities.
14. The Permittee or his designee shall inspect the wastewater recycle facilities to prevent malfunctions and
deterioration, operator errors and discharges which may cause or lead to the release of wastes to the environment, a
threat to human health, or a nuisance. The Permittee shall maintain an inspection log or summary including at least
the date and time of inspection, observations made, and any maintenance, repairs, or corrective actions taken by the
Permittee. This log of inspections shall be maintained by the Permittee for a period, of three years from the date of
the inspection and shall be made available to the Division or other permitting authority, upon request.
1,5. Any duly authorized officer, employee, or representative of the Division may, upon presentation of credentials,
enter arid inspect any property, premises or place on or related to the recycle system at any reasonable time for the
purpose of determining compliance with this permit, may inspect or copy any records that must be maintained under
the terms and conditions of this permit, and may obtain samples of grotmdwater, surface water, or leachate.
1.6, The annual ad.ministering and compliance fee must be paid by the Permittee within thirty (30) days after being
billed by the Division. Failure to pay the fee accordingly may cause the Division to initiate action to revoke this
permit as specified by 15A NCAC 214 .0205 (c)(4),
17. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to an
enforcement action by the Division in accordance with North Carolina General Statute 143-215.6A to 143-215.6C.

18. The issuance of this permit does not exempt the Permittee from complying with any and all statutes, rules,
regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which
have jurisdiction, including but not limited to applicable river buffer rules in 15A NCAC 2B.0200, erosion and
sedimentation control requirements in 15A NCAC Chapter 4 and under the Division's General Permit NCG010000,
and any requirements pertaining to wetlands under 15A NCAC 2B .0200 and 2H .0500.20.
19. A set of approved plans and specifications for the subject project must be retained by the Permittee for the life of
this project,
20. Noncompliance Notification:
The Permit -tee shall report by telephone to the Mooresville Regional Office, telephone number [phone], as
soon as possible, but in no case more than 24 hours or on the next working day following the occurrence or first
knowledge of the occurrence of any of the following:
a. Any occurrence at the wastewater treatment facility which results in the treatment of significant amounts of
wastes which are abnormal in quantity or characteristic, such as the dumping of the contents of a basin or tank,
the known passage of a slug of hazardous substance through the facility, or any other unusual circumstances;
b. Any process unit failure, due to known or unknown reasons, that renders the facility incapable of adequate
wastewater treatment, such as mechanical or electrical failures of pumps, aerators, compressors, etc.;
c. Any failure of a pumping station, sewer line, or treatment facility resulting in a by-pass directly to receiving
waters without treatment of all or any portion of the influent to such station or facility; or
d.. Any time that self -monitoring information indicates that the facility is not in compliance with its 'permit
limitations.
Occurrences outside normal business hours may also be reported to the Division's Emergency Management
personnel at telephone number [phone], or [phone]. Persons reporting such occurrences by
telephone shall also file a written report in letter form within five (5) days following first knowledge of the
occurrence. This report must outline the actions taken or proposed to be taken to ensure that the problem does not
recur.
1 Upon classification of the wastewater treatment and spray irrigation facilities by the Water Pollution Control
System Operators Certification Commission (WPCSOCC), the Permittee shall designate and employ a certified
operator to be in responsible charge (ORC) and one or more certified operator(s) to be back-up ORC(s) of the
facilities in accordance with 15A NCAC 8G .0201. The ORC shall visit the facilities in accordance with 15A
NCAC 8G .0204 or as specified in this permit and shall comply with all other conditions specified in these rules.
The Permittee, at least six (6) months prior to the expiration of this permit, shall request its extension. Upon receipt
of the request, the Commission will review the adequacy of the facilities described therein, and if warranted, will
extend the permit for such period of time and under such conditions and limitations as it may deem appropriate.

facilities in accordance with 15A NCAC 8G ,0201, The ORC shall visit the facilities in accordance with 15A
NCAC 8G ,0204 or as specified in this permit and shall comply with all other conditions specified in these rules,
22. The Permittee, at least six (6) months prior to the expiration of this permit, shall request its extension. Upon receipt
of the request, the Commission will review the adequacy of the facilities described therein, and if .warranted,

Dear Non -Discharge Permitting Unit,
Enclosed are one original and four copies of Wastewater Recycle System permit applications for two of
RMC Mid -Atlantic, LLC's (formerly Metromont Materials) facilities. The facilities are RMC Mid -
Atlantic Runes Road and RMC Mid -Atlantic — Pineville. Neither of the systems have been modified
in any way, so only Sections. I and II were completed as well as the Applicant's Certification, Also
enclosed are copies of the previous permits for both systems.
Both systems are designed to capture process water generated from the ready -mix concrete production
operations, which includes rinsing of mixer truck exteriors, rinsing out the inside of the mixer drums,
washing down the facility grounds, and miscellaneou°s discharges generated in the batching of concrete.
The water enters a series of collection basins where solids settle out, The clarified water is then pumped
to be used again for hatching concrete and rinsing out the inside of mixer drums.
It has been my understanding that since the current general stormwater permit for ready -mix concrete
facilities addresses process water discharges, we did not need to pave and maintain non -discharge permits
for wastewater recycle systems. That is why renewals were not previously submitted at the time of the
permits' expiration. If we are required to have these permits, then all other companies should be as well.
Please check the files to see how many other recycle systems for ready -mix plants have non -discharge
permitss.

not be a.pproved.
4. In the event that the facilities .fail to perform satisfactorily, including the creation of nuisance conditions, the
Permittee shall take immediate corrective action, including those actions that may be required by this
Division, such as the construction of additional or replacement treatment or disposal facilities.
The residuals generated from these treatment facilities must be disposed in accordance with General Statute
143-215,1 and in a manner approved by the Division.
6. The issuance of this permit shall not relieve the Permittee of the responsibility for damages to surfaceor
groundwaters resulting from the operation of this fa.cility.

environment, a threat to human health, or a nuisance, 'fhe Permittee shall maintain an inspection log, or
summary including at least the date and time of inspection, observations made, and any maintenance, repairs,
or corrective actions taken by the Permitte,e. This log of inspections shall be maintained by the Permittee for
a period of three years from the date of the ins,pection and shall be made available to the Division or other
permitting authority, upon request,
13. Any duly authorized officer, employee, or representative of the Division may, upon presentation of
credentials, enter and inspect any property, premises or place on or related to the recycle system at any
reasonable time for the purpose of determining compliance with this permit, may inspect or copy any records
that must be maintained under the terms and conditions of this permit, and may obtain samples, of
groundwater, surface water, or leachate,
14. The Permittee must pay the annual administering and compliance fee within thirty (30)days after being billed
by the Division. Failure to pay the fee accordingly may cause the Division to initiate action to revoke this
permit as specified by I 5A NCAC 2H .0205 (c)(4),
15. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to an
enforcement action by the Division in accordance \vith North Carolina General Statute 143-215,6A to 143-
215.6C.

or tank, the known passage of a slug of hazardous substance through the facilit),„ or any other unusual
circumstances:

b. Any process unit failure. due to known or unknown reasons, that renders the facility incapable of
adequate wastewater treatment, such as mechanical or elecirical failures of pumps, aerators, compressors.
etc,:
c, Any failure of a pumping station, sewer line, or treaunent facilityresulting in a by-pass directly to
receiving Waters without treatment of all or any portion of the influent to such station or facility or
d, Any time that self -monitoring information indicates that the facili is not in compliance with its permit
limitations.

the type and grade at least equivalent to or greater than the classification assigned to the wastewater treatment
facilities by the WPCSOCC, The Permittee must ako employ a certified back-up operator of the appropriate
type and grade to comply with the conditions of ISA NCAC 8A .0202. The ORC of the facility. must visit
each Class 1 facility at least weekly and each Class 11, 111, and IV facility,. at least daily, excluding weekends
and holidays, and must properly manage and document daily operation and maintenance of the facility and
must comply with all other conditions of I5.A NCAC 8A .0202,
20. The Perminee, at least six (6) months prior to the expiration of this permit, shall request. its extension. Upon
receipt of the request, the Commission will review the adequacy of the facilities described therein, and if

Enclosed are one original and four copies of Wastewater Recycle System permit applications for two of
RMC Mid -Atlantic, LLC's (formerly Metromont 'Materials) facilities. The facilities are RMC Mid -
Atlantic — Reames Road and RMC Mid -Atlantic — Pineville. Neither of the systems have been modified
in any way, so only Sections I and II were completed as well as the Applicant's Certification. Also
enclosed are copies of the previous permits for both. systems.
Both systems are designed to capture process water generated from the ready -mix concrete production
operations, which includes rinsing of mixer truck exteriors, rinsing, out the inside of the mixer drums,
washing down the facility grounds, and miscellaneous discharges generated in the hatching of concrete.,
The water enters a series of collection basins where solids settle out. The clarified water is then pumped
to be used again for batching concrete and rinsing out the inside of mixer drums.
It has been my understanding that since the current general stormwater permit for ready -mix concrete
facilities addresses process water discharges, we did not need to 'have and maintain non -discharge permits
for wastewater recycle systems. That is why renewals were not previously submitted at the .time of the
permits' expiration. If we are required to have these permits, then all other companies should be as welt

RECYCLE SYSTEM DESCRIPTION.
CHARLOTTE SOUTH PLANT
PURPOSE:
The purpose of the recycle system is to provide an area to dry
returned concrete, collect and store process and storm water and to
provide for utilization of collected water to manufacture ready mix
concrete.
WASTE WATER COLLECTION
Areas that generate process water and as where the storm water
is contaminated with cement are drained into the recycle basin. The
recycle basin is designed to accommodate all process water generated,
storm water runoff from normal rainfall, storm water runoff from the
100 year flood and 1100 cubic feet of settled solids. The elevation
of the drying slab in relation to the elevation of the recycle basin
is set to allow the drying slab to store storm water runoff from the
100 year flood.
The areas that water is collected from are as follows:
1. Drying slab 3750 SF
2. Recycle Basin 1100 SF
3. Driveway Under Plant 600 SF
4. Rinse Station 1280 SF
The water generated from these areas is collected by an opened
top concrete "U" ditch to facilitate inspection and cleaning of the
drainage system. Areas that water is collected from are separated
from adjacent areas by curbs and grade changes. This prevents storm
water from noncollected areas from entering the recycle basin and
causing it to over flow.
WATER UTILIZATION SYSTEM.
A 7.5 horsepower self priming centrifugal pump (catalog cut
enclosed) with a floating intake and associated piping distribute
eater to points of use. The recycled water is connected to dedicated
plant water piping and is used to mix ready mix concrete. The waste
water is recirculated through the system to rinse out mixers, to rinse
off the driveway under the batch plant and to rinse off the inclined
slab in the recycle basin.
DRYING SLAB
When concrete is returned to the plant it is spread out in a thin
layer on the drying slab. When the concrete is hydrated/dryed it is
stockpiled on the drying slab, screened and incorporated into new
concrete. The settled solids from the recycle basin are mixed with
the reclaimed material prior to introduction to new concrete.

Water Recycle System Permit
The Groundwater Section is in receipt of the subject application to renew Permit Number
WQ0008919, issued on March 15, 1994, allowing continued operation of an existing recycle
system at the Metromont Materials Corporation (see Figure 1). The existing permit allows the
recycling of approximately 5,514 gallons of storm water and process water to be collected in a
37,000 gallon settling basin and re -introduced as mix water. The existing permit does not contain
any conditions requiring groundwater monitoring or the establishment of a Review Boundary or
a Compliance Boundary. It would appear, based on the information furnished in the Permit
Renewal Application, that the only portion of the operation which might impact the quality of
ground water beneath the facility would be potential seepage from the storage of storm water
and process water in the settling basin. The settling basin is approximately 4.5 feet deep and is
reportedly lined with concrete,
The Groundwater Section has reviewed the subject permit renewal application and recommends
reissuance of the permit with the following condition:
1. Any groundwater quality monitoring, as deemed necessary by the Division, shall be provided.

drainage collection areas with a combined area of 6,730 ft2, a 22 ft x 50 ft x 4.5 ft settling basin, and a 7.5
HP self priming centrifugal pump with a floating intake and associated piping, to serve the Metromont
Materials Corporation Charlotte South Plant, with no discharge of wastes to the surface waters, pursuant
to the application received January 21, 1994, and in conformity with the project plan, specifications, and
other supporting data subsequently filed and approved by the Department of Environment, Health and
Natural Resources and considered a part of this permit.
This permit shall be effective from the date of issuance until February 28, 1999, and shall be
subject to the following specified conditions and limitations:
1. This permit shall become voidable unless the facilities are constructed in accordance with
the conditions of this permit, the approved plans and specifications, and other supporting
data.
2. This permit is effective only with respect to the nature and volume of wastes described in
the application and other supporting data_
3. The facilities shall be properly maintained and operated at all times.
4. This permit is not transferable. In the event there is a desire for the facilities to change
ownership, or there is a name change of the Permittee, a foimal permit request must be
submitted to the Division of Environmental Management accompanied by an application
fee, documentation from the parties involved, and other supporting materials as may be
appropriate. The approval of the request will be considered on its merits and may or may
not be approved.
5 Upon completion of construction and prior to operation of this permitted facility, a
certification must be received from a professional engineer certifying that the permitted
facility has been installed in accordance with this permit, the approved plans and

6. In the event that the facilities fail to perform satisfactorily, including the creation of
nuisance conditions, the Permittee shall take immediate corrective action, including those
actions that may be required by this Division, such as the construction of additional or
replacement treatment or disposal facilities.
7. The Mooresville Regional Office, telephone number 704/663-1699, shall be notified at least
forty-eight (48) hours in advance of operation of the installed facilities so that an in -place
inspection can be made. Such notification to the regional supervisor shall be made during
the normal office hours from 8:00 a.m. until 5:00 p.m. on Monday through Friday,
excluding State Holidays.
8. The residuals generated from these treatment facilities must be disposed in accordance with
General Statute 143-215.1 and in a manner approved by the North Carolina Division of
Environmental Management.
9. The issuance of this permit shall not relieve the Permittee of the responsibility for damages
to surface or groundwaters resulting from the operation of this facility.
10. The facilities shall be effectively maintained and operated as a non -discharge system to
prevent the discharge of any wastewater resulting from the operation of this facility.
11. Diversion or bypassing of untreated wastewater from the treatment facilities is prohibited.
12. Freeboard in the settling basin shall not be less than two feet at any time.
13. Any monitoring deemed necessary by the Division of Environmental Management to insure
surface and ground water protection will be established and an acceptable sampling
reporting schedule shall be followed.
14. Adequate inspection, maintenance, and cleaning shall be provided by the Permittee to
insure proper operation of the subject facilities.
15. The Permittee or his designee shall inspect the wastewater recycle facilities to prevent
malfunctions and deterioration, operator errors and discharges which may cause or lead to
the release of wastes to the environment, a threat to human health, or a nuisance. The
Permittee shall maintain an inspection log or summary including at least the date and time of
inspection, observations made, and any maintenance, repairs, or corrective actions taken by
the Perrnittee. This log of inspections shall be maintained by the Pemiittee for a period of
three years from the date of the inspection and shall be made available to the Division of
Environmental Management or other permitting authority, upon request.
16. Any duly authorized officer, employee, or representative of the Division of Environmental
Management may, upon presentation of credentials, enter and inspect any property,
premises or place on or related to the recycle system at any reasonable time for the purpose
of determining compliance with this permit, may inspect or copy any records that must be
maintained under the terms and conditions of this permit, and may obtain samples of
groundwater, surface water, or leachate.
17. The annual administering and compliance fee must be paid by the Permittee within thirty
(30) days after being billed by the Division. Failure to pay the fee accordingly may cause
the Division to initiate action to revoke this permit as specified by 15A NCAC 2H .0205
(c)(4).
18. Failure to abide by the conditions and limitations contained in this permit may subject the
Permittee to an enforcement action by the Division of Environmental Management in
accordance with North Carolina General Statute 143-215.6(a) to 143-215.6(c).

In order to determine whether provisions for dual or standby power may be required for the
subject facility, the classification of the closest downslope surface waters (the surface waters that
any overflow from the facility would flow toward) must be determined. You are required to
submit this form, with items 1 through 10 completed, to the appropriate Division of Environmental
Management Regional Water Quality Supervisor (see attached listing), At a minimum, you must

11111r19. The issuance of this permit does not preclude the Permittee from complying with any and
all statutes, rules, regulations, or ordinances which may be imposed by other government
agencies (local, state, and federal) which have jurisdiction.
2a. A set of approved plans and specifications for the subject project must be retained by the
Permittee for the life of this project.
21, Noncompliance Notification:
The Permittee shall report by telephone to the Mooresville Regional Office, telephone
number 704/663-1699, as soon as possible, but in no case more than 24 hours or on the
next working day following the occurrence or first knowledge of the occurrence of any of
the following:
a. Any occurrence at the wastewater treatment facility which results in the treatment of
significant amounts of wastes which are abnormal in quantity or characteristic, such as
the dumping of the contents of a basin or tank, the known passage of a slug of
hazardous substance through the facility, or any other unusual circumstances;
b. Any process unit failure, due to known or unknown reasons, that renders the facility
incapable of adequate wastewater treatment, such as mechanical or electrical failures of
pumps, aerators, compressors, etc.;
c. Any failure of a pumping station, sewer line, or treatment facility resulting in a by-pass
directly to receiving waters without treatment of all or any portion of the influent to
such station or facility; or
d. Any time that self -monitoring information indicates that the facility is not in compliance
with its permit limitations.
Persons reporting such occurrences by telephone shall also file a written report in letter
form within 15 days following first knowledge of the occurrence. This report must outline
the actions taken or proposed to be taken to ensure that the problem does not recur.
22. Upon classification of the facility by the Certification Commission, the Permittee shall
employ a certified wastewater treatment plant operator to be in responsible charge (ORC) of
the wastewater treatment facilities. The operator must hold a certificate of the type and.
grade at least equivalent to or greater than the classification assigned to the wastewater
treatment facilities by the Certification Commission. The Permittee must also employ a
certified back-up operator of the appropriate type and grade to comply with the conditions
of Title 15A, Chapter 8A, .0202. The ORC of the facility must visit each Class I facility at
least weekly and each Class II, III, and IV facility at least daily, excluding weekends and
holidays, and must properly manage and document daily operation and maintenance of the
facility and must comply with all other conditions of Title 15A, Chapter 8A, .0202,

recycle wastewater that will be produced at their proposed ready
mix concrete plant. The Company does not appear to have any
problems with the proposed systems or any site specific concerns.
Waste residuals will not be generated by the recycling system; any
settled solids will be remixed with the concrete.

structures, and property lines. Each sheet of the plans and the first page of the specifications
must be signed and sealed.
d. For industrial wastewater, a complete chemical analysis of the typical wastewater
must be provided. The analysis may include, but shall not be limited to, Total Organic
Carbon, BOD, COD, Chlorides, Phosphorus, Nitrates, Phenol, Total Trihalomethanes,
TCLP analysis, Total Halogenated Compounds, Total Conforms, and Total Dissolved
Solids.

If lagoons arc a part of the facilities and the recycle water is industrial, provide a
hydrogeologic description of the subsurface to a depth of 20 feet or bedrock, whichever is
less. The number of borings shall be sufficient to define the following for the area
underlying each major soil type at the site: significant changes in lithology, the vertical
permeability of the unsaturated zone, the hydraulic conductivity of the saturated zone, and
the depth of the mean seasonal high water table.
Five copies of all reports, evaluations, agreements, supporting calcularions, etc., must be
submitted as a part of the specifications which are signed and sealed by a North Carolina
Professional Engineer. Although certain portions of this required submittal must be
developed by other professionals, inclusion of these materials under the signature and seal
of a North Carolina Professional Engineer signifies that he has reviewed this material and
has judged it to be consistent with his proposed design.

Please find enclosed a completed application for a water
recycling system. This proposed facility will be located at a ready
mix concrete plant on Old Nations Ford Road in Mecklenburg County, NC.
Per my conversation with dike Allen the following description is
submitted in lieu of a chemical analysis:
Water collected in the concrete recyycle basin will be
generated from two sources. One source is rain water that
falls on the area around the concrete batch plant, the
recycle basin and the drying slab. The other source
process water from batching concrete. The process water is
generated from spills when filling water tanks on the mixer
trucks, rinsing out mixers and from rinsing cement off the
body of the mixer truck after batching.
Since this concrete batch plant :is a proposed facility, there is
no waste water to analyze at this time. At other MMC facilities with
similar systems the highest recorded ph reading is 10.5. Suspended
solids have not been quantified.

c. Five sets of detailed plans and specifications signed and sealed by a North Carolina
Professional Engineer. The plans must include a general location map, a site map which
indicates where any borings or hand auger samples were taken, along with buffers,
structures, and property lines. Each sheet of the plans and the first page of the specifications
must be signed and sealed.
d, For industrial wastewater, a complete chemical analysis of the typical wastewater
must be provided. The analysis may include, but shall not be limited to, Total Organic
Carbon, BOD, COD, Chlorides, Phosphorus, Nitrates, Phenol, Total Trihalomethanes,
TCLP analysis, Total Halogenated Compounds, Total Colifonris, and Total Dissolved
Solids.
If lagoons are a part of the facilities and the recycle water is industrial, provide a
hydrogeologic description of the subsurface to a depth of 20 feet or bedrock, whichever is
less. The number of borings shall be sufficient to define the following for the area
underlying each major soil type at the site: significant changes in lithology, the vertical
permeability of the unsaturated zone, the hydraulic conductivity of the saturated zone,and
the depth of the mean seasonal high water table.
Five copies of all reports, evaluations, agreements, supporting calculations, etc., trust be
submitted as a part of the specifications which are signed and sealed by a North Carolina
Professional Engineer. Although certain portions of this required submittal must be
developed by other professionals, inclusion of these materials under the signature and seal
of a North Carolina Professional Engineer signifies that he has reviewed this material and
has judged it to be consistent with his proposed design.

RECYCLE
DESCRIPTION
CHARLOTTE SOUTH PLANT
PURPOSE:
The purpose of the recycle system is to provide an area to dry
returned concrete, collect and store process and storm water and to
provide for utilization of collected water to manufacture ready mix
concrete.
WASTE WATER COLLECTION
Areas that generate process water and areas where the storm water
is contaminated with cement are drained into the recycle basin. The
recycle basin is designed to accommodate all process water generated,
storm water runoff from normal rainfall, storm water runoff from the
100 year flood and 1100 cubic feet of settled solids. The elevation
of the drying slab in relation to the elevation, of the recycle basin
is set to allow the drying slab to store storm water runoff from the
100 year flood.
The areas that water is collected from are as folio :

3. Driveway Under Plant
4. Rinse Station

The water generated from these areas is collected by an opened
top concrete "U" ditch tn facilitate inspection and cleaning of the
drainage system. Areas that water is collected from are separated
from adjacent areas by curbs and grade changes. This prevents storm
water from noncollected areas from entering the recycle basin and
causing it to over flow.
WATER UTILIZATION SYSTEM
A 7.5 horsepower self priming centrifugal pump (catalog cut
enclosed) with a floating intake and associated piping distribute
water to points of use. The recycled water is connected to dedicated
plant water piping and is used to mix ready mix concrete. The waste
water is recirculated through the system to rinse out mixers, to rinse
off the driveway under the batch plant and to rinse off the inclined
slab in the recycle basin.
DRYING SLAB
When concrete is returned to the plant it is spread out in a thin
layer on the drying slab. When the concrete is hydrated/dryed it is
stockpiled on the drying slab, screened and incorporated into new
concrete. The settled solids from the recycle basin are mixed with
the reclaimed material prior to introduction to new concrete.

The Groundwater Section has reviewed the subject permit
application. Based on an analysis using the computer models TDAST and
Recharge/Mounding Model Program, operation of the facility as proposed
indicates a high risk of 21, Standard Exceedance beyond the perimeter
of compliance. Therefore, we would only recommend permit issuance with
the following conditions:

1. Initially after installation and quarterly thereafter, the
permittee shall collect samples of the effluent at a point
between the septic tank and the drain lines, for the
following constituents.

Volatile Organic Compounds in November Only
Samples shall be collected every March, June, September and
November. The results of sampling and analysis shall be
sent to the Mooresville Regional Office, N.C. Division of
Environmental Management on Form GW-59 (Compliance
Monitoring Report Form) every April, July, October, and
December.
2. Any groundwater quality monitoring, as deemed necessary by
the Division, shall be provided.
3. Oil drained from engine crankcases, antifreeze or degreasing
solvent wastes shall not be discharged into the disposal
system.
