Spencer has one wastewater treatment plant that produces about 200 dt/year of sludge. The
sludge is dried and stored on existing drying beds, All lab data and plant monitoring data reflect
compliance with the current land application permit, There was no land application activity at the
time of the inspection; however., a visit to the last site that had received sludge (Potts farm 43,
field 45-Ma y 2000) showed the site to be in compliance.

The Town art' permcer has applied to renew its land application of WWTP residuals pennit
with no modifications. The permit allows for 200 dry tons per year of WWTP residuals from tlre
Town of Spencer°s WWTP to be land applied on 211.6 acres of permitted land as specified in the
permit applications and current permit;
None of the subject land application sins were visited at this tiatae because the last land
application occurred iftNovember, `dace the last application was approximately six months a o, it
is unlikely that it would be passible to determine ifthe residuals had: been applied according to the
permit. Nevertheless, the writer reviewed the last three annual reports and loundrio instances of
noncompliance, Also, cumulative totals of metals and nutrients were well below tile.. maximums,
The Teen needs the subject permit in order to dispose of its sludge; therefore this Office;
recommends reissuing the subject permit.

In the unlikely event of a spill, the following action shall be taken immediately,
1 . Halt source of the spill - overturned truck, leaking valve, ruptured tank.
2. Contain spill. Use straw bales to form a barrier. In addition to straw
bales, use shovels to form an earthen barrier to augment straw bales.
3. Cleanup. Employ vacuum equipment to remove as much spill material as
possible. Complete cleanup by scattering straw from straw bales, soaking
up remaining materials. Pick up straw manually, and dispose in landfill.
4Final cleanup. Flush roadways with water as necessary to clean. Allow
to dry and incorporate if spill occurs on a non -paved and tillable area. In
the event a spill occurs on private property, final cleanup should be
completed immediately to the satisfaction of the owner.

2. The landowner or his representative authorizes the Permittee, County and State Officials or their
representatives to take necessary soil, sur-face and ground water samples during the term of, and
twelve (12) months after termination of, Otis Agreement-
3 The Permittee will provide each landowner or his representative with a copy of the land application
permit as issued by the N.C. Department of Environment, Health and Natural Resources
(NCDEHNR) Division of Environmental Management (DEM) for the land described above prior to
commencement of residual application. The NCDEHNR-DEM permit will specify maximum
application rates, limitations and other restrictions prescribed by the laws and regulations.

and to established monitoring facilities on or near the application site as required by the residual land

conveying pollutants from the residuals application area onto the adjacent property or into
any surface waters.

V. INSPECTLQ15
1.
The Permittee or his designee shall inspect the residuals storage, transport, and application
facilities to prevent malfunctions and deterioration, operator errors and discharges which
may cause or lead to the release of wastes to the environment, a threat to human health, or a
nuisance. The Pettee shall maintain an inspection log or summary including at least the
date and time of inspection, observations made, and any maintenance, repairs, or corrective
actions taken by the Pe it This log of inspections shall be maintained by the Permittee
for a period of five years from the date of the inspection and shall be made available to the
Division of Environmental Management or other permitting authority, upon request-

V1. GENERAL_fQNDITIONS-
1.
This permit shall become voidable unless the land application activities are carried out in
accordance with the conditions of this it, the supporting materials, and in the manner
approved by this Division.
2.
This permit is effective only with respect to the nature and volume of wastes described in
the application and other supporting data.
3.
This permit is not automatically transferable. In the event that there is a desire for the
facilities to change ownership or a name change of the Permittee, a formal permit request
must be submitted to the Division of Environmental Management accompanied by an
application fee, documentation from the parties involved, and other supporting materials as
may be appropriate, The approval of this request will be considered on its merits and may
or may not be approved,

5. Failure to abide by the conditions and limitations contained in this permit may subject the
Permittee to an enforcement action by the Division of Environmental Management in
accordance with North Carolina General Statute 143-215.6(a),to 143-215.6(c),
6. The annual administering and compliance fee must be paid by the Perinittee within thirty
(30) days after being billed by the Division. Failure to pay the fee accordingly may cause
the Division to initiate action to revoke this permit as specified by 15 NCAC 2H m0205
(c)(4).
7. The issuance of this permit does not preclude the Permittee from complying with any and
all statutes, rules, regulations, or ordinances which may be imposed by other government
agencies (local, state, and federal) which have jurisdiction.
8. The Permittee, at least six (6) months prior to the expiration of this permit, shall request its
extension. Upon receipt of the request, the Commission will review the adequacy of the
facilities described therein, and if wan -anted, will extend the permit for such period of time
and under such conditions and limitations as it may deem appropriate.
9. This permit may be modified, or revoked and reissued to incorporate any conditions,
limitations and monitoring requirements the Division of Environmental Management deems
necessary in order to adequately protect the environment and public health,
10. This permit shall become voidable unless the agreements between the Permittee and the
landownerstlessees are in full force and effect. The land owner agreements are considered
expired concurrent with the expiration date of the permit and must be renewed at the same
time the permit is renewed.

PART i - EVALUATION AND RECOMMENDATIONS
The Town of Spencer is applying for a modification of its
application permit to increase the amount of sludge applied per
year to 200 dry teens,

,applicant has obtained buffer zone waiver agreements from the
lard owners where some of the residences are within 75 feet of the
application sites
During the site investigation eight to nine houses were
counted around site c. and within the 40 -foot buffer. Due to
the number of dwellings in this small community, this ffice
recommends that the waiver be denied. if this recommendation is
overruled by Raleigh, please contact this office prior to issuance
of the permit.
During a telephone conversation on October 20, 1994 Hr. David
Wanucha, Director of Technical Services with Environmental masts
Recycling, was informed that the Mooresville Regional office is
recommending denial of the waivers based on the above He informed

redelineate the site according to the recommended buffer set forth
by the permit application.
Pending final review and concurrence by the Stets Review Group
and the Groundwater Section, it is recommended that the subject

permitting authorityand delegation to issue land application permits for EPA in our State.
This will allow you to avoid having two permits (one from the State and one from p for
the same activity. While this delegation process is being completed, permittees legally are
subject to the new Federal requirements' while, continuing to comply with their existing
State issued permit, At this time, the delegation process 1s progressing slowly and the
formal approval date for the delegation is unknown.

to be performed by the Permittee, plus general conditions
applicable to non -discharge permits. Failure to comply with the
terms and conditions of the Permit subjects the Permittee to
enforcement action pursuant to Section 143-215.6 of the North
Carolina General Statutes. A civil penalty of up to $10,000 per
violation may be assessed for such violations.
Please note that the subject Permit expires on September
30, 1998. Part VI. 10. of the Permit requires that a renewal
request be submitted at least six (6) months prior to
expiration. Also the Permit is non -transferable until such time
that the Permittee has requested a name change to the new
Permittee.

Dear Permittee:
Our files indicate that the subject permit issued on 3/27/90 expires on
1/31/e have not received a request for renewal from you as of this date.
A renewal request shall consist of a letter requesting renewal and completion of
the enclosed application, submitted in triplicate. A processing fee must be submitted
with the request. Please find attached a copy of the 15 NCAC 211 .0205(c) regulations.
The processing fee for your facility isr based on the design or permitted flow,
whichever is appropriate, listed in the first four categories of facilities. Sludge
renewals are based on total acres of land permitted. If the facility covered by this
permit contains some type of treatment works, a narrative descripton of the sludge
management plan that is in effect at the facility must be submitted with the
application for renewal.
The Environmental Management Commission adopted revised rules on October 1, 1990
(attached), requiring the payment of an annual fee for most permitted facilities. You
will be billed separately for that fee if applicable), after your permit is approved.
Please be advised that this permit must not be allowed to expire. If the renewal
request is not received within 180 days prior to the permit T s expiration date as
required by 15 NCAC 2H .0211, you will be assessed an automatic civil penalty This
civil penalty by North Carolina General Statute may be as much as $10,000 per day. If
a permit renewal request is not received 180 days before permit expiration, a civil
penalty of at least $250 will be assessed. Larger penalties may be assessed depending
can; how late the request is made. In addition, any permit renewal, request received

required, to pay the higher permit application fee.
