HomeMy WebLinkAboutU-4007Br• STATE OF NORTH CAROLINA DEPARTMENT OF TRANSPORTATION BEVERLY EAVES PERDUE DIVISION OF HIGHWAYS GOVERNOR May 14 2012 Belinda S Henson Regional Supervisor Surface Water Protection NCDWQ 225 Green St Suite 714 Fayetteville NC 28301 5043 Subject U 4007B Complaint and Non Compliance Dear Ms Henson EUGENE A CONn 7R SECRETARY In response to your office s letter dated May 7 2012 the Department is submitting to you the items of correction completed by our Contractor as well as future actions that will be taken by the Department and the Contractor to ensure the project s compliance with all environmental permits Actions to Correct Unauthonzed Discharge The Contractor repaired the borrow pit s dewatermg basin removing the excessive sediment deposits noted during your office s review of the site They also repaired several exposed erodible areas that had been noted as needing attention at or beyond the perimeter of the pit These areas were repaired and have been properly seeded and mulched The sediment deposits down the slope at the two tributaries were removed by the Contractor s forces utilizing shovels and buckets Action taken to prevent further Unauthorized Discharge Future measures will include adding additional locations for NTU readings along the path of the borrow pit s discharge to the pond as well as checking the background readings of any water meeting the borrow pit s discharge The dewatermg operation s NTU readings will be checked for compliance 30 minutes after the operation starts and begins discharging All readings will be recorded by the Contractor on a dewatermg log The NCDOT is also taking and recording several checks a week to verify the contractor s readings The dewatering basin itself will be added as a stormwater discharge outfall during our NPDES reviews This will insure it is closely monitored for any maintenance requirements regardless of the NTU readings The Department will work diligently to prevent this error from occurring in the future We have discussed the importance of monitoring turbidity and preventing erosion at all locations along the project 5501 Barbados Boulevard Castle Hayne NC 28429 Phone (910) 341 2000 Fax (910) 675 0143 both with the Contractor s personnel and our own staff I have emphasized to them that they continue to look for ways to go beyond the minimum requirements when ensuring compliance with our permits and ensuring the preservation of our surrounding environment Sincerely Karen Eason Fussell PE Division Engineer KEF /nm cc Mason Herndon DWQ Jackson Provost PE Division Construction Engineer David Candela PE Resident Engineer Stoney Mathis PE DEO Jim Gregson Wilmington Regional Office Brad Shaver US Army Corps of Engineers Wilmington District Office David Wainwright NCDWQ Wetlands /401 Transportation Group Sonia Carillo NCDWQ Central Office
