On most of the site, woody vegetation is well established, growing well, of varying heights and densities .. Overall, vegetative success seems to have been achieved. The site's hydrologic monitoring assessments have trended in a progression towards success for most gauges since Year 3. One gauge, Gauge 1, has shown deficiency in meeting hydrologic success until Year 5. However, increase towards hydrologic success has trended upward during the monitoring period. In Year 4 of monitoring, Albemarle Restorations completed subsoil tillage to break a subsurface hard pan allowing water to move more freely through the complete soil profile. Since that time, Gauge 1 has strongly progressed toward success and achieved an 8.6% hydroperiod in Year 5. Albemarle Restorations believes that the area associated with this gauge is approximately 1.5 acres. Considering the site's progression towards success, EEP recommends that the site be considered in the 2012 closeout round including a site visit by the IRT. EEP also recommends that Albemarle Restorations complete hydrologic monitoring on Gauge 1 through the 2012 growing season. If Gauge 1 has met or exceed hydrologic success established in the mitigation plan, the site will be considered a success and ready for closure. If in fact Gauge 1 does not make hydrologic success, Albemarle Restorations will delineate out an area believed to be associated with Gauge 1 and remove it from the final asset determination. In either case, EEP will provide a report to the IRT and request the site be considered closed and remaining assets realized. Contingencies Albemarle Restorations has agreed to monitor Gauge 1 and the two supplemental gauges: I and 1B on the site during the 2012 growing season to ensure that the area in question is in fact meeting hydrologic success. An area of non - hydric soil was identified in a visit preparing for closeout. Albemarle Restorations employed a licensed soil scientist to complete a soil delineation within the site. During this assessment 0.69 acres of soil were determined to be nonhydric. This area has been removed from wetland assets. No further action is recommended at this time. Page 9 of 16 Pre - Construction Photos Post - Construction Photos Page 10 of 16 r APPENDIX A — Watershed Planning 92227 — Modlin Site The Modlin Site project is located in HUC 03010107150010, the Deep Run Swamp watershed that was originally designated as a Targeted Local Watershed (TLW) in the 2001 Roanoke RBRP. This HU was delisted in the 2009 Roanoke RBRP. Approximately 16% of the streams in this watershed lacks adequate functioning riparian buffers. Over one - quarter of the land here is agricultural including six permitted livestock operations. EEP has no additional projects in this TLW. According to the 2001 Roanoke RBRP "Deep Run Swamp has channelized headwaters leading to severe habitat degradation in several miles of streams..." The project restored 40 acres of riparian wetlands and contributes to the watershed goals of allowing additional infiltration of runoff and removal on sediments and nutrients before draining into the swamp waters. This work will be undertaken on a 40 -acre site located off NCSR 1562 (Poplar Chapel Road) between NCSR 1552 (Jerden Thicket Road) and NCSR 1561 (Elijah Lee Road), southeast the town of Jamesville, adjacent to Cooper Swamp, in Martin County, North Carolina. Accordingly, fur the purposes of the Corps of Engineers' Regulatory Program, the Code of Federal Regulations (CFR) published in the Federal Register on March 9, 2000, lists nationwide permits. Authorization, pursuant to Section 10 of the Rivers and Harbors Act and Section 404 of the Clean Water Act, was provided for activities in waters of the United States associated with the restoration of former waters, the enhancement of degraded tidal and non -tidal wetlands and riparian areas, the creation of tidal and non -tidal wetlands and riparian areas and the restoration and enhancement of non -tidal streams and non -tidal open water areas on private lands. Your work is authorized by this nationwide permit provided it is accomplished in strict accordance with the attached General Conditions and the following Special Conditions: a. This authorization in no way obligates the U.S. Army Corps of Engineers to recognize this work as a stream or riparian wetland restoration project. b. This authorization in no way obligates the U.S. Army Corps of Engineers to accept this project for use as compensatory mitigation prdposed by the North Carolina L•'cosystem Enhancement Program (NCEEP), or any other person, program, or entity.
