A review has been conducted of the City of Statesville's self reported Sanitary Sewer
Overflows (SSOs) 5-Day Report(s) for March 2010. This review has shown Statesville to be in
violation of the requirements found in Collection System Permit WQCS0003O and/or G.S. 143-
215.1(a)(1). The violations that occurred during March 2010 are summarized in Attachment A.
Remedial and corrective actions, if not already implemented, should be taken to prevent
further SSOs. As of December 1, 2007, any reportable SSO may be issued a Notice of Violation
(NOV) and some may be assessed a civil penalty. Civil penalties will be issued for SSOs based
on volume, volume reaching surface waters, duration and gravity, impacts to public health, fish
kills, and recreational area closures. Other factors considered in determining the amount of the
civil penalty are the violator's history of spills, the cost of rectifying the damage, whether the
spill was intentional, and whether money was saved by non-compliance.

Be advised that G.S. 143-215.6A provides for a civil penalty assessment of not more than
twenty-five thousand dollars ($25,000), or twenty-five thousand dollars ($25,000) per day when the
violation is of a continuing nature, against any person who is required but fails to apply for or to
secure a permit required by G.S. 143-215.1. Penalties may also be assessed for any damage to the
surface waters of the State that may result from the unpermitted discharge.

This letter is in response to the Notice of Violation letter dated April 14th, 2010
informing us of a violation and recommended enforcement due to a sanitary sewer overflow on
March 9th, 2010.
It is standard practice for us to routinely flush and rod the system to prevent overflow
events from occurring. This particular line is one that we check even more frequently due to
the threat of grease buildup in the lines. There are a number of restaurants and other grease
producing entities located upstream of the location of sanitary sewer overflow. Our records
indicate that staff performed cleaning services on this line in July 2009, and were working on
this exact line one week before the sanitary sewer overflow and did not report any pooling or
change in flow depths that would indicate blockages. Upon receiving notification of the spill,
staff was immediately dispatched to the site and clean-up activities were commenced.
Additionally, WWTP staff was immediately contacted to inspect the grease traps upstream of
the spill to ensure compliance with our collection permit limits of 200mg/I. All remedial and
corrective actions were implemented to ensure no subsequent blockages would occur after the
initial spill.
The City of Statesville Water/Sewer Division staff has shown tireless effort to ensure
system -wide compliance of the collection system with very few incidents observed. We
maintain and operate over 245 miles of gravity sewer and 7 miles of force main sewer within
our system. In 2009, our staff cleaned approximately 530,750 linear feet of sewer line,
performed 26,588 linear feet of video inspection, and visually inspected just over 7,000
manholes. We deeply regret this spill occurred, however it is clear that this was not due to staff
negligence or failure to adequately maintain the system. The W/S Maintenance staff will
continue to maintain and operate the system with increased diligence to minimize sanitary
sewer overflows in the future.

In reply to your letter dated March 28, 2008 regarding the subject Notice of Violation, we
offer the following information:
Subject: Sewer Spill at Newton Alley
Spill: #200800536
Date: 2/20/08
Pipe Size: 12in
The Spill was caused by roots and debris in the line. After the clean up was completed
the line was inspected with a sewer camera and it was discovered that the roots were from
breaks in the pipe and joints. We replaced 190 Ft of the pipe and the work was completed
on 2/29/08. A follow up inspection has turned up no further problems.

The Spill was caused by grease and debris in the line. This is a dead end line carrying
only a small strip mall and a rest home. At the present we are monitoring the rest home
and strip mall with a portable bar screen and checking grease levels in an effort to find
out where the problem is.. Recent inspections at a contributing restaurant in the strip mall
before the spill indicated it to be in compliance with the city grease levels.

We in the Statesville sewer department maintain 244 miles of gravity sewer lines and 7
miles of force main. At present we have 2 jet trucks, 1 sewer camera van and a flexible
sewer Roding machine. In 2007 we cleaned 313,877 ft of sewer lines and inspected
73,875 ft of sewer line with the camera van.
Although we very much regret the spills that occurred we are very proud of our
maintenance record and will continue to do our very best to keep Statesville's sewer
system as spill free as possible.
