In response to your question regarding erosion control measures at the 60 pipe DWQ will allow NCDOT to
place a temporary erosion control measure on both the Inlet and outlet end of this pipe A measure on the Inlet
Is Justified to prevent the mud slurry from entering and possibly filling the pipe with a mud slurry This will also
provides a means of quantifying the material that maybe coming to the project from the Ace /Avant project As
for what type of measure to Install at these locations I would suggest that Barry and /or HDR determine what
would be most effective DWQ would prefer that the Impact area for these devices be minimized as much as
possible without Jeopardizing effectiveness If waddles are determined not to be efficient than placing a rock
device on fabric to assist in removal of the device would be a good idea
In answer to your question regarding sediment removal DWQ recognizes that some of the material on the
outlet of the pipe may have come from the Ace / Avent project However we have no means to differentiate
how much of this material Is from the 311 project and how much Is from the Ace Avent project When a
sediment loss has occurred at this site DWQ has requested that the Department remove the sediment and
realizing that all the material could not be retrieved in the Initial effort due the type of material lost and
streambed substrate we ve asked you to continue monitoring the area to remove any additional sediment that
may accumulate overtime DWQ Is Just requesting that the Department continue to abide by this commitment
to restore this reach of stream It Is unfortunate that additional sediment maybe coming from another site
however this would not be an Issue if there had never been a sediment loss from the DOT project

In response to you letter dated May 29, 2012, regarding permit site 23A bullets 2 and 3 the Department feels the
following
In regards to the placement of an erosion control measure in the stream at the outlet of the 60 pipe the
Department can get the contractor to do this work but would like to know If It would also be a good Idea to place
a measure at the Inlet end as well in an effort to keep the sediment coming from the Ace /Avant property from
filling in the pipe? Since placing measures In the stream Is not allowed without permission from the Agencies
Placing two measures would give us a way to figure out where the sediment Is coming from Also how do you
want us to construct the measure? Do you want us Just to place filter fabric down and then place class B rip rap
and filter stone? or is there something else you had in mind?
In regards to removing the sediment from the stream the Department needs clarification as to who was the
contributor of the sediment, it is our opinion that the sediment deposits in question have come from the
Ace /Avant property Since the contributor of the sediment Is coming upstream from the project the contractor
would be due extra money to go back into this area to remove the sediment from the stream
The Department and the contractor are willing to do whatever is wanted by the Division However, we Just want
to know if you would like for us to add an erosion measure at the inlet end of the stream and how you want the
measure constructed, and we need better clarification as to where you believe the sediment deposits came from
that you want removed?
