This correspondence is in reference to your February 13, 2012 request for verification to
utilize a Nationwide Permit 18 for the discharge of fill material into 0 099 acres of jurisdictional
wetlands adjacent to Davis Canal to facilitate the development of two single family residences
located on tract 8 located at the terminus of SE 19th Street on Oak Island Brunswick County
North Carolina
Your request as proposed implies that the aforementioned tract has been legally
subdivided and that building of the two lots are co dependent upon one another that together
they are considered a single and complete project Please provide additional information
supporting this as so and demonstrate why you believe that the development of two structures on
a single tract is necessary for the economic return on the property Furthermore if the
subdivision of the tract is legitimate each lot may be considered independent of one another and
have independent utility, therefore, each lot may be subject to the Nationwide Permit 18 with a
0 10 acre impact threshold This was discussed with your consultant Ms Kim Williams, via
telephone on March 5 2012
Furthermore we request that you please revise your mitigation plan Your proposal to
purchase non riparian credits from the Stone Farm Mitigation Bank (SFMB) is unsuitable as
compensatory mitigation for the proposed impacts because the wetland project is located outside
of the SFMB service area More importantly we do not believe that the wetland type and
function at the project area is comparable to that of SFMB Furthermore your 1 1 ratio is
insufficient to address the overall loss associated with the project
It is therefore our determination that your project as proposed is incomplete Please
submit information addressing the matters discussed above within 30 days of the receipt of this
letter or we will consider your application withdrawn and close the file
