Director Division of Water Quality May 15, 2007 Iredell County DWQ Project #06-1485 CERTIFIED MAIL RETURN RECEIPT REQUESTED Mr. Tom Shadrix Zion Holdings, Inc. 7195 Bridgeview Ave., Suite 117 I~aS Vegas, NV 89147-4561 Subject: Georgia Mills Plantation -Phase II Dear Mr. Shadrix: The Division of Water Quality (DWQ) received your application fora 401 Water Quality Certification for the subject project on September 12, 2006. Mr. Barry Love of this office reviewed the application and met with the project engineer (Richard Franklin) at the site on November 21, 2006. Based on Mr. Love's review and the site meeting, the following additional information was requested. a) The impact, which was applied for (901inear feet) was found to be non jurisdictional (by this office) upon the site visit. However, the U.S.A.C.E has the ultimate authority in these matters. Also, it is our understanding that a culvert may be used instead of the proposed bridge over Shinns Creek, which was listed as no impact. The application must be modified to reflect these changes with the proposed length of impact listed. b) Please provide detailed diagrams of the crossing of Shinns Creek if they are different from what was initially proposed. These must include a longitudinal stream profile and cross-section. The design for the permanent crossing should include efforts to maintain the base flow channel in the stream. Also, the bottom of the culverts must be placed below the elevation of the streambed to allow low flow passage of water and aquatic life. c) Lots 23, 24, and 25 have a stream through the middle which may cause them to be unusable or require driveway crossings. If driveway crossings are to be used at any time in the future, then these would be considered cumulative impacts for the development, and therefore, these impacts must be applied for now. Other lots with adjacent streams or wetlands will require deed notifications that no impact is allowed. To this date no additional information has been received. A written response should be submitted to this Office by May 29, 2007, addressing the above issues. Failure to provide the requested information by the aforementioned date will result in the application being withdrawn as incomplete.
