Dear Ms Fussell
This letter is in reference to a complaint and non compliance issue on the proposed improvements to US
17 from Jacksonville Bypass to Drummer Kellum Road in Onslow County Federal Aid Project No STP-
NET 17(3 1) State Project No 8 1261901, TIP U-4007 NCDWQ Project No 20100362
On April 25 2012 the DWQ Regional Office in Wilmington received a complaint from the adjacent
property owner to the U -4007B borrow pit on Halltown Road near Jacksonville in Onslow County The
complainant stated that excessive turbidity was being discharged from the borrow site into her pond
Staff from the DWQ investigated the complaint on the following day and discovered an unauthorized
discharge of sediment in two tributaries below the discharge pipe of the borrow pit s dewatering basin
Water samples were taken within the impacted reach of the tributaries and at the pond where the lower
tributary discharges into the complainant s pond The field turbidity readings for these samples were
found to exceed the state water quality standards Upon inspection of the dewatering basin it was noted
that it had not been maintained properly and contained an excessive amount of sediment which created
the discharge
The issues described above are violations of NC Statutes 15A NCAC 2B 0211(2) 15A NCAC 2B
0211(3)f and 15A NCAC 2B 0211(3)k, Conditions 24 and 29 of the 401 WQC issued to this project and
NCDOT's NPDES permit
Accordingly you are directed to respond to this letter in writing within 30 calendar days of receipt of
this letter Your response should be sent to this office at the footer address and include the following
• Actions taken to correct the unauthorized discharge into waters associated with the
unnamed tributaries to Northeast Creek
• Actions that will be taken to prevent further unauthorized discharges to surface waters
If the above mentioned correspondence is not received within the allotted tune and/or if any violation of
the conditions of the 401 Water Quality Certification NPDES permit or Water Quality Standards occurs

on this project in the future DWQ may be forced to issue a Notice of Violation and possibly seek
enforcement action and civil penalties
