My understanding of this is that the plaintiffs in this matter, the Pittmans, live along or own property on Corpening Creek downstream of the WWTP. The stream is characterized as an urban stream in a developing area that is significantly affected by non point source factors, yet the Pittmans don't appear to be able to discern between the point source and non point source factors and appear to believe that erosion on their property is due wholly to effect of the WWTP discharge. Mr. Pittman's assertions as to the degree the stream flow is altered by variations in the WWTP discharge seem to be beyond the realm of possibility. They wish to seethe City compensate them for damage they feel has been done to their property and while elements of the suit may have merit, its purpose may only be leverage. As to the enumerated violations, I haven't gone through the list thoroughly. It is assumed that most of the monitoring violations noted are indeed true. I would be curious to look at the DMR to see if there were any explanations for their omissions (most were in the winter and Marion is in an area where weather impacts can cause significant problems). The region reports that the plant is operated very well and produces a quality effluent. Since the time of most of the noted violations, the City has contracted for operation of the WWTP with a reputable and professional operating firm. When toxicity became a repeated problem in 1997, the political leadership in the City put their industrial users on notice that toxic discharges would not be tolerated and the problem soon disappeared. There are problems with elements of the collection system and all involved would like to see these problems resolved sooner. The Asheville Region has forwarded an enforcement package to the central office for the Director's consideration regarding some of the unauthorized discharges. Please be advised that I have not had the opportunity to consult with Liz Dickson -- 1 -- Wed, 30 Jun 1999 18:16:18 a my superiors on this matter, but I cannot imagine this is a lawsuit we would want to join, nor would I anticipate that the EPA would feel it necessary to take action. This letter hereby places you on notice"that my clients believe that the City of Marion's Corpening Creek WWTP is in violation of Sections 301, 308 and 402 of the Act [33 U.S.C. §§ 1311, 1318, 1342] by virtue of the fact that this plant has violated and continues to violate "an effluent standard or limitation' as defined by Section 505(f) of the Act [33 U.S.C. § 1365(f)] by failing to comply with NPDES Permit # NC0031879. My office has performed a preliminary review of some of the records kept at the NC DENR office in Asheville, North Carolina, pertaining to the City of Marion's Corpening Creek WWTP. This preliminary review has identified-442 violations of the City of Marion's NPDES Permit. These violations are set forth on the document labeled Exhibit "A" which is attached hereto. We believe that the City of Marion's Corpening Creek WWTP's violations of its NPDES Permit are likely to continue in the future. There was a slight dip in 1985 (Good bioclassification), and a parallel change in the biotic index value suggested that this pattern reflected a real change in water quality. In addition '. to the decline in some intolerant species, there was an increase in some tolerant midges, especially ric tQI2-u bicinctus and Procladius. A fish kill was reported from the upper Linville River during 1985 (near the Land Harbor development), but .this change in an upstream area may be unrelated to the change seen at the Nebo site. While there have been no dramatic changes -in water chemistry at the Linville River, the suggestion of improvement at this site is substantiated by a decline in average conductivities after 1986. Management Strategies General Recommended Strategies for Expanding and Proposed Dischargers in the Catawba Basin The transitional environment between free flowing streams and lakes is a potentially sensitive area to loading -of oxygen demanding wastes. As stream waters slow and deepen as they enter a lake, the rate at which oxygen enters the water is reduced. This means that a concentration of oxygen demanding waste that was acceptable in a free flowing stream may result in dissolved oxygen levels below the State standard. The seven major reservoirs that make up the chain of lakes along the Catawba River create many transition zones between streams and lakes. The hundreds of tributaries to the seven major reservoirs create local environments where waters may be relatively sensitive to oxygen demanding . wastes. Due to the transitional nature of such waters, the exact allowable amount of oxygen demanding wastes that can be discharged without impairing water quality is difficult to determine. Water quality studies can be conducted. on a case -by -case basis to support wasteload allocations. However, due to the widespread occurrence of transitional waters in the Catawba Basin and the high demand on water for the assimilation of oxygen -consuming wastes, a basinwide strategy is recommended. Over the past five years, DEM has implemented a minimum treatment strategy for discharges of oxygen demanding waste in the Lake Norman watershed. It is recommended that this strategy, described below, be extended to all seven major lakes in the Catawba Basin. All new and expanding dischargers of oxygen -consuming .wastes that discharge to the Catawba: River Chain of Lakes or are predicted to increase oxygen -demanding waste loading to the lakes, (Lake James, Rhodhiss Lake, Lake Hickory,' Lookout Shoals Lake, Lake Norman, Mountain .: Island Lake, and Lake Wylie) .will be required to meet a minimum of advanced treatment limits.:. Typical NPDES permit conditions for advanced treatment facilities are 15 mg/1 BODS and 4 mg/l,.: NH3-N. These limits will help to protect water quality standards in the Catawba River chain of lakes and will allow for cdntinued growth in the region. 6.3.1 Catawba River Mainstem Watersheds (Subbasins 03-08-30 to Subbasin 03-08-30 (Catawba River Headwaters, Lake Tames) 03-08-33) Corpening Creek has been listed as an impaired stream due to non -point source pollution .from agricultural and urban runoff from the City of Marion. In addition, Corpening Creek receives treated wastewater from the 3.0 MGD -Marion WWTP via Youngs Fork Creek. - Benthic'r_ macroinvertebrate studies conducted above and below the Marion WWTP indicate only Fair water quality above the discharge and Fair (1985) or Poor (1990) water quality below the discharge. This suggests that the Marion WWTP was affecting the invertebrate community but that upstream non -point pollution sources play a significant role in the stream impairment _ Over the past three years, the Marion WWTP has averaged less than 5 mg/1 BODS and less than 1 '- mg/1 NH3-N. These concentrations of oxygen -consuming .wastes are well below the facilities secondary treatment based limits. Therefore it is recommended that efforts to address water quality issues- in the Corpening Creek - watershed be concentrated upon non -point source. pollution reduction. Section 6.8 contains several recommendations that the City of Marion should consider in'order to begin addressing urban stormwater pollution. As I understand it, the following situation exists: Staff from the Division of Water Quality - Asheville Regional Office, sampled Corpening Creek on your property ors September 25, 1998. All of the results showed good water quality. The Corpening Creek Wastewater Treatment Plant is considered to be one of the best operated plants in Western North Carolina. Most plants have primary and secondary treatment. The Corpening Creek Wastewater Treatment Plant also has a third stage of treatment, called tertiary sand filters. These sand filters remove very small solid particles in the wastewater. Overall, the effluent from the plant is very good quality. I understand that the Prison Pump Station was a chronic problem in 1998. Four (4) overflows from the Prison Pump Station to Corpening Creek were reported to the Division of Water Quality. These overflows occurred from March to November 1998. I understand that the Division of Water Quality will probably fine the City of Marion for these overflows. To address this problem, The City of•Marion had a telephone line installed to the Prison Pump Station in December 1998. The telephone will automatically call if an alarm situation occurs. The Prison Pump Station is part of the sewer collection system for the City of Marion's Corpening Creek Wastewater Treatment Plant. The four discharges are as follows: p On March 7, 1998, approximately 30,000 gallons of untreated sewage discharged from the Prison Pump Station to Corpening Creek, Class C Waters in the Catawba River Basin. The discharge was due to a grease obstruction in the suction line and pump. On June 27-28, 1998, approximately 50,000 gallons of untreated sewage discharged from the Prison Pump Station to Corpening Creek, due to the bubbler system failure and an obstruction in one pump which was primarily grease. p On October 15, 1998, approximately 500 gallons of untreated sewage discharged from the Prison Pump Station to Corpening Creek. The discharge resulted when the bleed off valve was not completely closed after routine maintenance, which created an artificially low head pressure on the bubbler system that indicated the wet well level was low. p On November 18, 1998, approximately 9,000 gallons of untreated sewage discharged from the Prison Pump Station to Corpening Creek. This discharge resulted when the air line on the compressed air bubbler system blew off the fitting and indicated an artificially low wet well level. On January 13, 1999, a letter was sent to the City of Marion as notification that the Asheville Regional Office of the Division of Water Quality is considering sending a recommendation for enforcement action to the Director of the Division of Water Quality. The recommendation concerns the violations by the City of Marion of North Carolina General Statute 143-215.1 for making four outlets to waters of the State without a permit, as described above. In December 1998, the City of Marion had a telephone line installed to the Prison Pump Station. If an alarm situation occurs, the autodialer will automatically call the Marion Police Department. The Police Department will then call the appropriate person to respond to the alarm and correct the problem before an overflow occurs. This new system is currently being tested. When it is fully operational, it is expected to minimize the occurrence of overflows from the Prison Pump Station. Also in December 1998, the Natural Resource Conservation Service (NRCS) conducted a stream survey of the section of Corpening Creek that flows through Mr. Wayne Pittman's property. The NRCS will develop a restoration plan for the eroded stream banks and obtain funding.
