SUBJECT: Notice of Post -Construction Requirements for
Department of Defense NPDES MS4 Permittees
The purpose of this memorandum is to provide the following notice to permitted National
Pollutant Discharge Elimination System (NPDES) Municipal Separate Storm Sewer Systems
(MS4s) that are owned and operated by the U.S. Department of Defense (DOD).
DOD MS4s that do not already review, approve, and enforce Post -Construction
permit applications within their own jurisdictions are required to develop and
implement a Post -Construction program by October 1, 2023.
This memo will not result in any changes for those DOD MS4s who currently implement
their own compliant Post -Construction program throughout their MS4 permitted area.
However, DOD MS4s who do not currently implement a Post -Construction program will
need to develop the ability to do so. This will require completing the tasks summarized in
Table 1. The status of these tasks shall also be included in the appropriate MS4 permit
annual reports.

In the 20 Coastal Counties, DEQ implements stormwater management requirements in
accordance with 15A NCAC 02H .1019. However, 15A NCAC 02H .1019(1)(a) states that
"this Rule shall be implemented by local governments and other entities within the 20
Coastal Counties that are required to implement a Post -Construction program as a
condition of their NPDES permits." This currently applies to the following DOD MS4
permits:
• NCS000290 Camp Lejeune Marine Corps Base
• NCS000335 Seymour Johnson Air Force Base
• NCS000314 Marine Corps Air Station Cherry Point
Outside of the twenty coastal counties, the requirements for post -construction in NPDES
and Urbanizing Areas are established in 15A NCAC 02H .1017(1) which states, "The
requirements of this Rule shall be implemented by permittees, delegated programs, and
regulated entities in accordance with Rule .0151 of this Subchapter and Rule .1016 of this
Section." This currently applies to DOD MS4 permit:
