Actions taken in regards to the NOV are as follows:
Corrective Action it 1:
• Immediately began repairing pathway of the center pivot irrigation system along with repair of
the drainage areas of the property. The center pivot travels through irrigated paths which
stopped the center pivot at the point of the spill. These were corrected within 2 weeks of the
occurrence as we want to make sure this does not repeat itself. Review of reaction with OIC was
conducted initially and will continue.
Corrective Action # 2:
• The statement for requested Corrective Action for Violation #2 is not accurate. Please let me
clarify:
o Production Manager changed post previous occurrence
o Site Manager started in September of 2020
o Director of Operations started on January 23rd, 2020

o OIC started in May of 2019
• The area of concern took less than 5 minutes to clean up nor was any risk to state waters as it was
responded to quickly. The area of concern was less than 200 gallons including rain water that had
not drained. There was no natural movement of the water in the area that was cleaned up. The
OIC could not of reacted any sooner unless he was sitting there watching it's every move. We will
change this in our system even though it is not a requirement.
